Release Of Liability

Please read this document carefully. It must be signed by adult visitors to Wildwood Outdoor Adventures, LLC. d/b/a as Wildwood Outdoor Adventures & Campground, located at 5230 Livin' the Dream Way, Eagle River, WI 54521 (referred to in this agreement as Wildwood Outdoor Adventures & Campground), and by a parent or legal guardian of a visitor who is a minor (under 18yrs of age, and sometimes referred to in this agreement as the child.) Whether participating in an organized activity on or off Wildwood Outdoor Adventures & Campground property or merely being on the premise of Wildwood Outdoor Adventures & Campground (vistor).

  • In consideration of being allowed to participate/visit in any of Wildwood Outdoor Adventures & Campground including, but not limited to camping, services, rentals, trips, tours, shuttle service or its related events and activities, I acknowledge, appreciate, and agree for myself and for my minor visitor for whom I sign for below as follows:
  • The risk of injury from the activities that Wildwood Outdoor Adventures & Campground offers is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce the risk, the risk of serious injury does exist; and,
  • I knowingly and freely assume all such risks, both known and unknown, even if arising from negligence of the releases or others, and assume full responsibility for my participation and/or the participation of my minor; and,
  • I willingly agree to comply with the stated rules and customary terms and conditions for participation. If however, I and/or the minor observes any unusual significant hazard during our presences or participation, I will remove myself and/or the minor from participation and bring such to the attention of Wildwood Outdoor Adventures & Campground staff. 
  • I, for myself, the minor and behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless Wildwood Outdoor Adventures & Campground; their officers, officials, contractors, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity, (“Releases”), with the respect to any and all injury, disability, death, or loss or damage to person or property associated with my presence or participation, whether arising from the negligence of the releases or otherwise, to the fullest extent permitted by law.
  • I agree that I will not condone, serve or purchase alcohol for anyone under the age of 21 at anytime while adventuring with or staying at Wildwood Outdoor Adventures & Campground. 
  • I understand that I am responsible for and will pay for any damages done to my campsite, rental items and/or Wildwood Outdoor Adventures & Campground personal property.
  • I understand that I am and remain personally liable to pay the total amount of my reservation prior to or upon arrival of my scheduled check-in date, or at such earlier date communicated to me. If I fail to pay the total due, I agree that Wildwood Outdoor Adventures & Campground may charge any remaining balance (in addition to any damage charges or other amounts owed under these Terms and Conditions) to any credit or debit card on file with my reservation. Any amounts due after 30 days will be subject to the maximum late charge permitted under state law.
  • I give Wildwood Outdoor Adventures & Campground permission to take/use/share my photo,video, and or audio. I understand that often participants' image, likeness, may be recorded using audio, video, or photography equipment while on property or doing an activity with Wildwood Outdoor Adventures & Campground. I understand that these images may possibly be used in promotional materials and authorize this use. 
  • I understand that as a courtesy Wildwood Outdoor Adventures & Campground staff, if so requested, may assist with directing, loading and unloading my vehicle and/or equipment for rentals/trips & tours or may assist with directing me to my designated campsite and/or dock slip. It is my sole responsibility to ensure that the rental/site/dock slip will accommodate my specific item. I agree to indemnify and hold Wildwood Outdoor Adventures & Campground, its owners, employees, and agents harmless from any loss, liability, damage or cost (including attorney’s fees) that may result from an employee assisting or directing. Furthermore, I release, waive, discharge and covenant not to sue Wildwood Outdoor Adventures & Campground for any and all liability, loss, or property damage relating to an employee assisting/directing.
  • I understand that I am responsible for making sure my rental items or personal items are secured to the vehicle properly prior to leaving Wildwood Outdoor Adventures & Campground is not liable for my rentals once in my possession. 
  • I understand that depending on my rental, wearing a personal floatation device (PFD) may be required by law and that Wildwood Outdoor Adventures & Campground offers PFDs at no additional cost with all of their watercraft rentals and understand that it is in my best safety to wear one during any water sport activity. I agree to wear my PFD at all times. 
  • I understand that any dispute between a Visitor, Including a Minor Visitor and a released party must be resolved in accordance with the laws of the state of Wisconsin, excepting those laws which may invoke the laws on another jurisdiction; and any suit must be filed and maintained solely in Vilas county circuit court for the district of Wisconsin, and each of the parties consent to jurisdiction of such courts (and the appropriate appellate courts) in any such action or proceeding and waives any objection to such venue. 
  • I understand that soliciting is not allowed by myself or anyone registered in my party at any time.
  • I voluntarily agree to the conditions of this release of liability and assumption of risk agreement to the fullest extent by law on behalf of myself and my minor visitor, and my, and the minor Visitor heirs, executors and administrators. No person or persons have pressured or coerced me to participate, or to allow my minor child to participate in these activities, or to sign this agreement. If I or my child decides to participate, then, I , or my child understands the risks and agrees to make the decision to participate without consideration of outside pressure or coercion. If I feel pressured or coerced in any way to participate or to sign this agreement against my will, I will not sign the agreement and will not participate. 
  • Participants may be required to complete this agreement upon each visit to the property, however, in the absence of a replacement or cancellation, in writing, this agreement is valid for subsequent visits to Wildwood Outdoor Adventures & Campground
  • This agreement must be signed by the participant if he or she is OVER the age of 18.  
  • This agreement must be signed by a parent or legal guardian if the participant is UNDER the age of 18.

I acknowledge that I have read the release of liability and assumption of risk agreement, fully understand its provisions and implications. My execution of this release is an entirely voluntary intended to be binding on my heirs, executors, legal representatives, and assigns. I understand that I have given up substantial rights for myself and/or my minor by signing it, and sign freely and voluntarily without any inducement.
