ACKNOWLEDGMENT OF RISKS, and ASSUMPTION OF RISK AND RESPONSIBILITY

WARNING: There are significant elements of risk in any activity associated with outdoor adventures, including but not limited to camping, horseback riding, UTV/ATV trail riding, hiking, fishing, hunting, trap/skeet shooting, the presence of wild and domesticated animals, watercraft, firearms, and the use of any related equipment (referred to herein as “activity”). Although we (Prairie Prime Wingshooting) have taken responsible steps to provide you with appropriate information, equipment, and/or skilled guides (when applicable) so you can enjoy an activity for which you may not be skilled, we wish to remind you this activity is not without risk. Certain risks cannot be eliminated without destroying the unique character of the activity. The same elements that contribute to the unique character of the activity can be causes of loss or damage to your equipment, motorized vehicles, personal property (including dogs), or cause accidental injury, illness, or in extreme cases, permanent trauma or death. We do not want to frighten you or reduce your enthusiasm for this activity, but we do think it is important for you to know in advance what to expect and to be informed of the inherent risks.

ACKNOWLEDGMENT OF RISKS: I acknowledge that the following describes some, but not all, of those risks:

1) Falling; 2) Cold weather-related injuries and illnesses including frostbite, hypothermia, dehydration as well as hot weather-related injuries and illnesses including heat stroke and dehydration.  3) an “act of nature” which may include rock fall, tree/limb fall, inclement weather, severe and or varied wind, temperature or weather conditions. 4) Creek and other bodies of water requiring navigation, fording, portaging, including travel to or from the activity. 5) Risk associated with crossing, climbing up or climbing down of rock, embankments, mud, snow, and/or ice. 6) Equipment failure and/or operator error. 7) Discharge of firearms and other weapons; 8) Risks typically associated with watercraft including change in water flow, submerged, semi-submerged and overhanging objects, capsizing, swamping or sinking of watercraft and resultant injury, hypothermia, or drowning. 9) My sense of balance, physical coordination, and ability to follow instructions; 10) Attack by or encounter with insects, snakes, or animals both domesticated and wild; 11) Accidents or illnesses occurring in remote places where there are no readily available medical facilities; 12) Fatigue, chill and/or dizziness, which may diminish my reaction time and increase the risk of accident.

I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness or death. 

EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY: I am aware that this "activity" entails risks of injury or death to me and minor children for which I may be responsible. I agree to assume responsibility for the risks identified herein and those risks not specifically identified. My/Our participation in this activity is purely voluntary. No one is forcing me/us to participate and I/we elect to participate despite all risks. I am (We are) physically and mentally capable of participating in the activity and/or safety using the equipment. I accept that wearing a U.S.C.G approved personal flotation device provided by myself for waterborne activities is a basic safety precaution.

I assume full responsibility for the risks of personal injury and/or any injury to my dog(s), accidents or illness, including but not limited to sprains, torn muscles, and/or ligaments, fractured or broken bones; eye damage, ear damage, cuts, wounds, scrapes, abrasions, and/or contusions, dehydration, oxygen shortage (anoxia), exposure, head, neck, and/or spinal injuries; animal (domesticated and wild) or insect/snake bite or attack; injury caused by discharge of any firearm and weapon: shock, paralysis, drowning, and/or death; and any resultant expenses from any of the foregoing risks. I also assume responsibility for damage to or loss of my/our personal property. 

COVENANT OF GOOD FAITH: I recognize that you, Prairie Prime Wingshooting, as provider of goods and/or services, will operate under a covenant of good faith and fair dealing, but that you may find it necessary to terminate an activity or refuse or terminate the participation of any person for the safety of myself and/or other participants. I acknowledge that no guarantees have been made by Prairie Prime Wingshooting with respect to achieving objectives.

AUTHORIZATION; I hereby authorize any medical treatment deemed necessary in the event of any injury while participating in the activity. I either have appropriate insurance or, in its absence, agree to pay all costs of rescue and/or medical services as may be incurred on my/our behalf.

ACKNOWLEDGMENT; “In consideration of the services provided by Prairie Prime Wingshooting, their managing members, agents, employees, contracted staff, and all other persons or entities associated with those businesses I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death, loss of personal property, and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified and as a result of my/our negligence in participating in this activity.”

I have read the foregoing acknowledgment of risks, assumption of risk and responsibility, and am voluntarily completing this waiver.

Terms and Conditions 1. Consuming alcohol before or during a hunt is strictly forbidden 2. All clients and guests are responsible to immediately correct any unsafe conditions 3. If clients and guests observe unsafe conditions please report them immediately to 405-400-0960 4. Shooting is only to occur in authorized hunting/training areas and the wobble trap field 5. Never shoot at a target that you cannot clearly see and never shoot at a sound 6. Never shoot at a bird on the ground or on the water 7. Never climb a fence or obstruction with a loaded weapon in your hands 8. Do not carry a loaded weapon on the ranch until you are ready to hunt and are in an acceptable area to discharge a firearm 9. Clients and guests assume all risk of handling firearms and being near others that have firearms in their possession 10. Clients and guests assume the risk of ear damage from gunshots and are encouraged to wear ear protection 11. Clients and guests assume the risk of injury to themselves and their dogs from ammunition while hunting and from shooting at clay targets from other guns. 12. Clients and guests assume the risk for themselves and their dogs from walking in rugged country, including but not limited to: encounters with debris, fencing, barbed wire, wildlife, domestic animals and livestock, snakes, & insects 13. Clients and guests assume the risk of injury to themselves and their dogs from riding in a UTV, on an ATV, or riding in any other motorized vehicle while on the ranch 14. Firearms must be unloaded and cased when entering and exiting the ranch; Never ride in vehicle with a loaded gun 15. Clients and guests assume all risk of eye damage and are encouraged to wear eye protection 16. Guests under 18 must be with a parent or legal guardian who has a valid ID 17. No person who is a convicted felon may be a member or guest of Prairie Prime Wingshooting 18. Prairie Prime Wingshooting reserves the right to inspect and deny use of any member/guest supplied ammunition, firearms, etc. 19. No shotgun larger than 12 gauge may be used for any bird hunting, training activities, or wobble trap field 20. Open breach shotguns SxS or OxU are the only acceptable shotguns allowed for upland bird hunting on the property 21. Carrying of any shotgun for upland hunting should be done with breach open until ready to fire the shotgun 22. In case of misfire, point shotgun in a safe direction, muzzle pointed down, clear misfire and proceed with caution 23. Know how your firearm operates (i.e. controls and safety features); use only correct and reliable ammunition 24. Clients and guests must collect used shotgun shells and dispose of them properly. Do not leave in the field 25. Clients and guests must stay on the established road system with any motor vehicle at all times. It is understood the road system may be closed on certain days due to weather related issues. Clients and guests assume all risk for any damage, flat tires, etc. to their motorized vehicles and trailers while at Prairie Prime Wingshooting. 26. Clients and guests must be in full compliance with ODWC regulations and carry on their person their hunting license(s). It is understood Prairie Prime Wingshooting can process a 5 day upland bird license for $10 to clients and guests. 27. Clients are 100% responsible for the actions of their guest(s) and family members. Clients must not be separated from guests or family members while on the ranch 28. Clients and their guests must adhere to our game daily harvest limits per hunter. It is understood all hunting parties must disclose and present their harvest for record keeping purposes by Prairie Prime Wingshooting after their hunt. 29. Hunting parties for upland bird and waterfowl hunts are limited to 3 guns unless being guided by Prairie Prime staff 30. All harvested game must be removed from property by clients and it is understood Prairie Prime Wingshooting does not process game for clients and guests. Clients and guests should bring a cooler and necessary tools and packaging to appropriately process their game. We operate under a simple rule: if you take the animal's life, please respect it, process it, and utilize the protein. 31. Clients and guests must have a waiver signed and dated online in accordance with Prairie Prime Wingshooting policies prior to entering the ranch to participate in any activity 32. Clients must fully pay for scheduled hunts including their guest charges online prior to entering the ranch 33. Absolutely no fire of any type will be started on the property by clients and guests 34. Upland hunting hours are between 8:00 AM and 5:00 PM during our specified hunting seasons 35. Wobble trap field may not be used prior to 7:30 AM at any time of the year and no later than 30 minutes before official sunset during off-season and no later than 5:30 PM during hunting season. 36. Clients may not hunt any area (field and water) that has not been authorized by Prairie Prime Wingshooting. Patrons must stay on their approved hunting course and waterfowl area at all times 37. Clients upon entering and exiting property must always shut and lock the gate setting the combination lock to “0000” 38. Clients must enter property with their guests and escort their guests off the property 39. Clients and guests should assume a Game Warden will inspect legal compliance with ODWC regulations at any time 40. Clients, guests, and non-hunting guests must comply with ODWC safety regulations in the field concerning the wearing of Hunters Orange 41. Prairie Prime Wingshooting reserves the right to escort any client and guest off the premises for not adhering to terms and conditions and for practicing unsafe activities 42. All clients and guests must exit the club no later than official sunset during hunting season 43. Clients and guests should be prepared to provide their own snacks and drinks while on the property 44. Clients should carry their phones with them into the field for emergency communication 45. 4x4 motorized vehicles with high ground clearance are best for use on the property's road system 46. Clients must keep their dogs under control at all times. Dogs may not be loose around hunt camp, parking area, barn, dog yards, or wobble trap field at any time. They must be leashed or on a tie out in these areas 47. Dogs may only be off lead in approved hunting areas during hunting season 48. Prairie Prime Wingshooting reserves the right to cancel any hunt due to illness, inclement weather, or safety considerations and will provide a full refund if Prairie Prime Wingshooting must cancel 49. Clients and their guests that cancel a hunt after they are paid are non-refundable but are bankable to be used in the future 50. Smoking is prohibited on the ranch except for the approved area around hunt camp 51. Annual ranch access fee of $1,000 are strictly non-refundable 52. Dry camping is allowed for clients only in approved areas for a fee of $30 per night and only with prior approval. Prairie Prime Wingshooting is not responsible for any damage to camper’s property incurred while on the ranch 53. Clients and their guests accept full liability for any activity on our around the ranch's bodies of water including but not limited to: fishing, wading, waterfowling, swimming, and boating. If a patron cannot swim and/or is not willing to wear an approved floatation jacket while on or around bodies of water do not go around the water. 54. Off-season dog training is open to clients only. Only client owned dogs may be on the ranch during off-season for any reason. 55. Clients and guests must finalize payment for extra goods and services prior to exiting the ranch for the day including but not limited to: drinks and snacks, ammo, any merchandise purchased at hunt camp, and rentals of equipment. Prairie Prime Wingshooting accepts credit/debit cards, checks, and Venmo. It is understood clients are fully responsible for their guest’s purchases at the ranch. 56. Clients and guests are prohibited from entering certain posted areas at any time on the ranch 57. The ranch barn is not accessible to clients and guests without accompaniment by Prairie Prime staff 58. Clients and guests accept full responsibility for damage done to others property including vehicles and dwellings on or off Prairie Prime Wingshooting as a result of their shooting of a firearm. It is understood hunters should be aware of their surroundings including proximity to county roads and off ranch vehicles and dwellings when hunting. 59. Clients must not disclose combination lock codes to anyone. Rule of thumb: if client unlocks anything they should lock it back when entering/exiting or when done at wobble trap field 60. Prairie Prime Wingshooting retains the right to modify terms and conditions when deemed necessary 61. Client official communication occurs through email to the address provided by the client 62. Only members may enter the wobble trap house and manipulate wobble trap machine for any reason 63. Prairie Prime Wingshooting makes no guarantees in regards to the harvesting of birds during a hunt. It is understood the weather, the hunter's gun dog(s) ability, the hunters shooting ability, and other factors are out of the control of Prairie Prime Wingshooting. 64. It is understood Prairie Prime Wingshooting is a quail club. No guarantees are assumed for encountering other gamebirds at any time. 65. The intentional harvesting of game numbers greater than the assigned 12 point system for each hunter is strictly forbidden. If any hunter engages in such activity their privilege of hunting at Prairie Prime Wingshooting will be immediately suspended. 66. Annual ranch access fees must be paid up to date to hunt at Prairie Prime Wingshooting. 67. All hunts/goods and services will be documented with an invoice sent to the client's email and must be paid by credit/debit card. 68. All hunts must be scheduled through the "Book a Hunt" form on the Prairie Prime Wingshooting member web page. 69. Prairie Prime Wingshooting retains the right to change pricing for hunts during the season if external factors necessitate. 70. Normal ½ day hunts have a strict 12 point system in place. Quail = 1 point, Pheasant = 3 points, Ogridge = 2 points. The total sum harvest of Bobwhite Quail and California Valley Quail are defined as “quail."
Parent(s) or court-appointed legal guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above. Only 1 minor is allowed in a maximum 3 person hunting party at any time.
