This Rental Agreement (the Agreement”) is made effective this March 28, 2024 between ANCHORAGE YACHT BASIN INC., hereinafter, the LESSOR, and hereinafter, the LESSEE, (LESSOR and LESSEE shall collectively be known as the “Parties”) and states the agreement of the Parties as follows:

Therefore the Parties agree to the following terms:

The LESSEE agrees and acknowledges that the Agreement is for recreational purposes only and Vessel shall not be used to push or tow any other vessel or for any transportation of cargo.

The LESSEE agrees and acknowledges that the Vessel shall only be operated in the designated waters and shall not be placed on a trailer, lift or in any way removed from the water.

The LESSEE shall provide evidence that he/she is at least twenty-one (21) years of age.

The LESSEE shall ensure that all guest/participants on their Vessel has completed a liability waiver and any minors have a liability waiver signed by a legal guardian.

LESSEE acknowledges his/her responsibility for the safe and proper operation of the Vessel and for the safety and welfare of other Vessel operators and persons. It is AGREED AND UNDERSTOOD BY LESSEE that LESSOR shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunction of the Vessel. LESSEE FURTHER AGREES to indemnify and hold harmless the LESSOR from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of the Vessel. LESSEE further agrees to hold the LESSOR harmless should loss or damages occur to any of the LESSEES personal property while carried in, or on, the Vessel, including loss or damage caused by fire, water, theft or any other cause whatsoever.

LESSEE expressly agrees to indemnify and hold LESSOR harmless of, from, and against any and all loss, costs, damages, attorney fees and/or liability in connection with the enforcing of the foregoing rental contract by LESSOR, including expenses incurred in collection or attempting to collect delinquent rent and in the event of suit by LESSOR to recover possession of the Vessel and/or to enforce any of the terms, conditions and/or provisions hereof. It is understood and agreed that Venue of any action hereunder shall be in the county of the LESSOR.

The LESSEE acknowledges he/she has carefully examined the Vessel and finds it suitable for the purpose for which it is leased, and that other accessory equipment is in suitable and acceptable condition; that he/she will maintain Vessel and equipment in a safe, dependable, condition while in his/her custody.

SECURITY DEPOSIT: Applies to motorized vessel rentals only. In addition to the rental payment, the LESSEE shall pay a minimum $500.00 security deposit (by credit card) at the time this rental agreement is signed for each motorized vessel rented. If a cash security deposit is made, the LESSEE must also provide the LESSOR with a valid credit card. This deposit will be returned to the LESSEE upon termination of this rental agreement, less any expenses incurred to retrieve the Vessel and/or to repair any damage caused to the Vessel by the LESSEE or anyone else during the rental period. Should damages exceed the minimum $500.00 deposit, the LESSEE agrees to make payment in full immediately upon the LESSOR presenting an itemized repair bill, any loss of, or damage to, the Vessel and its accessories; any consequential damage, loss or costs incurred by the LESSOR, including salvage costs, loss of ability to lease and loss of revenue; and any loss of, or damage to, vessels and property of third parties, arising during the term of rental. This security deposit shall not bear interest.

INHERENT DANGER: The LESSEE understands and agrees that vessels and their operation is an inherently dangerous activity. The LESSEE certifies that he/she understands the rules and regulations for the safe operation of vessels. The LESSEE further agrees not to let anyone else operate the Vessel without likewise instruction on the rules and regulations for safe operation of the Vessel.

HEALTH OF LESSEE: The LESSEE certifies that he/she is in good health, has no physical or mental defects or deficiencies that may be of danger to themselves or anyone else, and that he/she is capable of safe operation of the Vessel. Furthermore, the LESSEE certifies that he/she is NOT under the influence of alcohol or drugs (legal or otherwise) and will remain so during the rental period.

CARE AND OPERATION: The LESSEE agrees to operate the Vessel only in a careful and proper manner, and to obey and comply with all laws and regulations for safe vessel operation.

WARRANTY: The LESSOR makes no warranties, express or implied, as to the Vessel. The LESSEE assumes the responsibility for the condition of the Vessel. In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental Vessel the LESSEE will immediately report same to LESSOR. Continued use of the Vessel shall be entirely at the LESSEES risk and thus LESSEE assumes all liabilities of injury and damage to all persons and property that may become involved by its continued use. LESSORS duty to provide a rental vessel, if reserved, is contingent upon and subject to the return of the unit by the previous LESSEE. LESSOR reserves the right to cancel this rental agreement due to inclement or impending bad weather. Rental fees will be prorated based on the time used. The rules and regulations contained herein and as posted in the office and/or by the grounds by the LESSOR are for the safety and welfare of all who use the facilities. The LESSEE certifies that he/she has read and understands said rules and regulations, and further assumes the responsibility to see that his/her family and/or guest(s) will obey the rules.

LIABILITY AND INDEMINITY: The LESSEE hereby agrees to bind him/her self, their heirs, personal representatives and assignees and hereby release and discharge the LESSOR, its owners, employees, agents and assignees from any and all claims, loss, costs, damages, expenses, actions, judgments and attorney fees, which the LESSEE or the LESSEEs heirs, personal representatives or assignees may have, or claim to have and releases the LESSOR, its owners, employees, agents and assignees from any claims for negligence created by or arising from the use, operation, handling, or transportation of the Vessel by the LESSEE or anyone else during the LESSEEs rental period. Further, the LESSEE hereby agrees to defend, indemnify and hold harmless, ANCHORAGE YACHT BASIN INC. and ANCHORAGE YACHT BASIN, LLC.,  its owners, employees, agents and assigns from all claims, damages, demands, costs, losses, expenses, actions and judgments, which are created by or arise out the LESSEEs operation of the vessel during the rental period. The LESSEE agrees to pay all claims brought by third parties resulting from the operation and/or use of the Vessel during the rental period. Should any term or condition of this Agreement be held void or unenforceable, then that term shall be deemed severed from this Agreement and the enforceability of the remainder shall not be affected and will remain in full force and effect.

THE TERMS AND CONDITIONS ON THIS CONTRACT CONTAINS THE ENTIRE UNDERSTANDING BETWEEN LESSEE AND LESSOR AND THAT NO OTHER REPRESENTATION OR INDUCEMENT, ORAL OR WRITTEN, HAS BEEN MADE WHICH IS NOT INCLUDED IN THIS RENTAL AGREEMENT.

RISK OF LOSS OR DAMAGE: The LESSEE assumes all risks of loss or damage to the vessel from any cause, and agrees to return the vessel in the condition received from the LESSOR, with the exception of normal wear and tear. The LESSEE certifies that he/she has examined the vessel and finds it acceptable and suitable for the purpose for which it is rented. The LESSEE agrees to return this vessel on or before the expiration of the rental period in the condition it is in now.

LESSEE agrees not to use, nor permit the use:

a. of the Vessel for any unlawful purpose;

b. of the Vessel in a careless or negligent manner;

c. of the Vessel while under the influence of liquor and or narcotics;

d. of the Vessel by any other person not the signatory of this agreement, or not equally qualified.

Overloading Vessel, towing of any other vessel, operating boat while impaired, while in possession of contraband, and/or Night Operation of Vessel is strictly forbidden, upon violation of these terms LESSEE agrees to forfeiture of deposit and loss of possession of the Vessel.

Florida Statute 327.54: "When the livery (Anchorage Yacht Basin Inc.) has complied with subsections (1), (2), and (3) its liability ceases and a person leasing the boat from the livery is liable for any violations of this chapter and is personally liable for any accident or injury occurring while in charge of such boat." I have read Florida Statute 327.54.

LESSEE acknowledges receipt of all EQUIPMENT listed on the checklist provided and that the propeller, and hull are satisfactory or duly noted. LESSEE agrees to report any accident, malfunction, or breakdown of the Vessel to LESSOR immediately.

If LESSEE is requested by the LESSOR, its owners, employees, or assignees to return to shore due to weather conditions, LESSEE will do so immediately.

LESSEE is responsible for any and all CITATION(S) incurred during the operation of the Vessel.

Under no circumstances will LESSEE allow anyone to enter the water while the Vessel’s engine is running. The key must be out of the ignition while passengers are in the water.

LESSEE has been shown and instructed in BOATING SAFETY RULES and does not need additional information. A CLEANING CHARGE of $100.00 applies to any boat not returned in a clean and orderly condition.

ALL rentals MUST be back by the reservation designated end time.  Standard designated times are as follows (unless stated otherwise in writing) Half-day Morning = 9:00 AM – 1:00 PM; Half-day Afternoon = 12:00 PM - 4:00 PM; Full-day = 9:00 AM - 4:00 PM. LESSEE is automatically charged a $75.00 late fee, and then charged a $75.00 fee every 15 minutes thereafter. The United States Coast Guard will be notified if LESSEE is more than 30 minutes late; LESSEE will be required to pay all rescue and associated fees.

A $100 GROUNDING FEE applies for any grounding of the vessel.

A $100 PER HOUR RESCUE FEE plus FUEL EXPENSE applies if the LESSOR, its owners, employees, or assignees have to come to get LESSEE.

LESSEE is given the boat full of fuel and is responsible for replacing the fuel he/she uses upon returning to the dock.

LESSOR reserves the right to cancel this Agreement at its sole discretion due to inclement or impending bad weather.  Rental fees will be prorated based on the amount of time used or a gift certificate will be issued for the amount of time remaining on the rental.  NO REFUNDS WILL BE ISSUED.

LESSEE has read, understands, and agrees to the charges as invoiced and to the Terms and Conditions of this Agreement.

Florida Boating and Safety Rules:

Children six years old or younger must wear a U.S. Coast Guard approved Personal Flotation Device at all times.

EXTREME DANGER AREAS: Fixed structures such as bridges, docks, pilings, channel markers, crab markers are all dangers to the Vessel.

RENTAL BOATS must stay within the designated AREA AS OUTLINED BY LESSOR, its owners, employees, or assignees.

RENTAL BOATS must observe the NO WAKE ZONE while leaving and returning from the marina. The marina is in a manatee zone.

RENTAL BOATS must stay a minimum of 50 yards from all boats and other hazards.

Steer to RIGHT of all APPROACHING BOATS and WATER VESSELS.

RENTAL BOATS must stay a minimum of 100 yards from all docks and shorelines while underway.

ABSOLUTELY NO RECKLESS OPERATION OF RENTAL BOATS WILL BE TOLERATED.

NO PERSON SHALL OPERATE ANY VESSEL WHILE UNDER THE INFLUENCE OF ALCOHOL OR DRUGS OR A COMBINATION OF ALCOHOL AND DRUGS. YOU CAN BE ARRESTED AND CHARGED WITH D.W.I. JUST AS IF YOU WERE IN AN AUTOMOBILE.

If the VESSEL becomes disabled for any reason I (LESSEE) have received instructions and understand these instructions are for my safety as well as protection of the VESSEL. BY SIGNING THIS AGREEMENT I UNDERSTAND AND WILL FOLLOW THE ABOVE RULES. I ALSO UNDERSTAND THAT IF I BREAK ANY OF THE RULES, MY RENTAL WILL BE TERMINATED WITHOUT REFUND. I WILL BE HELD ACCOUNTABLE FOR ANY DAMAGES I CAUSE TO THE VESSEL.

WAIVER AND RELEASE OF LIABILITY AGREEMENT - Florida

I. DISCLAIMER - This Waiver and Release Agreement is applicable to all renters, operators, passengers, and users of equipment provided by Anchorage Yacht Basin *(For purposes of this Waiver and Release, the term Rental Company includes all principles, directors, officers, employees, agents, representatives, servants, assigns, successors, insurers and subsidiaries of Anchorage Yacht Basin. If any other rental agreement is supplemented with this Release, the provisions of this Release will prevail over any clauses in the rental agreement that are inconsistent with this Release. The undersigned agrees that he/she is also signing this Release on behalf of undersigned minor children. Renter agrees that he/she will disclose to Rental Company all potential operators, passengers, and users of said rental equipment. Renter further agrees that in the event that he/she fails to notify Rental Company of all potential operators, passengers, or users of said equipment, he/she will be personally liable for any damages to the undisclosed individuals, even if such damages arise out of the negligence or fault of Rental Company. 

II. ACKNOWLEDGMENT OF RISKS - The undersigned hereby acknowledges that some, but not all of the risks of participating in watersport activities include: 1) Changing water flow, tides, currents, wave action and ships wakes; 2) Collisions with any of the following: other participants, the watercraft, other watercraft, and manmade or natural objects; 3) Collision, capsizing, sinking or other hazard which results in wetness, injury, exposure to the elements, hypothermia, drowning and/or death; 4) Attack by or encounter with insects and marine life forms, including, but not limited to sharks and/or sting rays; 5) Equipment failure or operator error; 6) My sense of balance, physical coordination, ability to operate equipment, swim and/or follow directions; 7) Wind, inclement weather, lightning, variances and extremes of wind, weather, and temperature, 9) Heat or sun related injuries or illnesses, including sunburn, sunstroke or dehydration. Further, the undersigned understands that the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness or death. 

III. EXPRESS ASSUMPTION OF RISK - The undersigned hereby agrees that he/she is renting, operating or using the equipment provided by Rental Company at his/her own risk. The undersigned agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental equipment, The undersigned assumes full responsibility for the risks of personal injury, accidents or illness, including but not limited to sprains, torn muscles and/or ligaments; fractured or broken bones; eye damage; cuts, wounds, scrapes, abrasions, and/or contusions; head, neck, and/or spinal injuries; animal or insect bite or attack; shock, paralysis, drowning, and/or death; and any resultant expenses from any of the foregoing risks and assumes all risk of injury, illness, damage or loss that might result, regardless of the cause, even if the risks arise out of the negligence or fault of Rental Company. 

IV. WAIVER/RELEASE OF LIABILITY - By the execution of this Release, the undersigned voluntarily releases, forever discharges and agrees to indemnify and hold harmless Rental Company from any and all liability of any nature for any and all injury or damage arising from personal injuries sustained by the undersigned or any minor children under the undersigned custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Rental Company regardless of the cause. The undersigned assumes full responsibility for any such injuries or damages which may occur, and further agrees that Rental Company shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that Rental Company shall not be responsible for such injuries, damages, loss or theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY RENTAL COMPANY, whether such negligence is present at the signing of this Release or takes place in the future. This Waiver and Release does not apply to gross negligence or intentional torts by Rental Company. 

V. LIABILITY TO THIRD PARTIES - The undersigned hereby agrees that he/she will indemnify and hold harmless Rental Company for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and passengers of other watercraft and minor children under the undersigned custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Rental Company, even if such damages arise out of the negligence or fault of Rental Company.

VI. ACKNOWLEDGMENT OF WAIVER AND RELEASE - The undersigned states that he/she has had sufficient time to review the Waiver and Release and to ask any questions associated with said Release. The undersigned further states that he/she has carefully read the foregoing Waiver and Release, knows the contents thereof, and has signed this Release as his/her own free act. The undersigned warrants that he/she is aware that he/she may rent, operate, or use equipment from another rental facility, but has chosen to rent, operate, or use equipment from Rental Company with the knowledge that signing this Release is a requirement for rental, operation, and use of said equipment. The undersigned further warrants that he/she is fully aware that he/she is waiving any right he/she may have to bring a legal action to assert a claim against Rental Company for Rental Company's negligence. 

By signing below you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By signing, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.

I have read this Vessel Rental Agreement and fully understand the terms and conditions as set forth. I agree to report any accident, malfunction, or breakdown of rental vessel to LESSOR immediately. I am experienced and capable in all aspects of handling and operation of the vessel I am renting.

Anyone born on or after January 1, 1988 who operates a vessel powered by 10 horsepower or more must have in his/her possession a photo ID and a boating safety education identification card issued by the Florida Fish and Wildlife Conservation Commission.

ASSUMPTION OF RISK, RELEASE OF LIABILITY & WAIVER OF CLAIMS AGREEMENT In consideration of being allowed to use the facilities and participate in the operation of Vessels, Waterskiing, Wakeboarding, Tubing and Related Activities (collectively the Activities) provided by Anchorage Yacht Basin Inc. (the Host), the Participant [or his/her parent(s) or legal guardian(s)] do hereby agree, to the fullest extent permitted by law, as follows:

TO WAIVE ALL CLAIMS that they have or may have against the Host, its owners, affiliates, employees, and/or agents arising out of the inherent risks of participating in the Activities;

TO ASSUME ALL RISKS INHERENT IN PARTICIPATING IN THE ACTIVITIES and using the Equipment, even those caused by the negligent acts or conduct of the Host, its owners, affiliates, operators, employees, agents, and/or officers. The Participant [or his/her parent(s) or legal guardian(s)] understand(s) that there are inherent risks of participating in the Activities and using the Equipment, which may be both foreseen and unforeseen and include serious physical injury and death; 

TO RELEASE the Host, its owners, affiliates, employees, and/or agents, from all liability for any loss, damage, injury, or expense forming the basis for a claim and/or cause of action that the Participant [or his/her parent(s) or legal guardian(s)] may suffer, arising out of the inherent risks of participation in the Activities.

Personal Responsibility

The Participant and his/her parent(s) or legal guardian(s) certify that Participant has no physical or mental condition that precludes him/her from participating in the Activities and that he/she is not participating against medical advice.

The Participant and his/her parent(s) or legal guardian(s) understand that Participants participation in the Activities is voluntary and further understand that they have the opportunity to inspect the Hosts equipment and facilities before any participation.

The Participant and his/her parent(s) or legal guardian(s) understand that Participant is obligated to follow the rules of the Activities and that he/she can minimize his/her risk of injury by doing so and through the exercise of common sense and by being aware of his/her surroundings.

If, while participating in the Activities, the Participant and/or his/her parent(s) or legal guardian(s) observe any unusual hazard or condition, which they believe jeopardizes Participants personal safety or that of others, Participant and/or his/her parent(s) or legal guardian(s) will remove Participant from participation in the Activities and immediately bring said hazard or condition to the attention of the Host.

To the extent that any portion of this Agreement is deemed to be invalid under the law of the applicable jurisdiction, the remaining portions of the Agreement shall remain binding and available for use by the Host and its counsel in any proceeding.

I/WE HAVE READ THE ABOVE WAIVER AND RELEASE, UNDERSTAND THAT I/WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, HAVE NOT CHANGED IT ORALLY, AND SIGN IT VOLUNTARILY.

BY SIGNING THIS AGREEMENT, YOU AND YOUR MINOR CHILDREN ARE GIVING UP YOUR RIGHTS TO SUE THE HOST, ITS OWNERS, AFFILIATES, EMPLOYEES, AND/OR AGENTS FOR ANY REASON WHATSOEVER FOR ANYTHING OCCURRING UPON THESE PREMISES OR DURING OUR EVENTS FOREVER.

I UNDERSTAND I EXPRESSLY ASSUME ALL RISK INHERENT TO THE USE OF THE FACILITIES, AS WELL AS PARTICIPATING IN AND OBSERVING ANY WATERSPORT, INCLUDING BUT NOT LIMITED TO THE USE OF BOATS, AND ANY AND ALL EQUIPMENT.

Please read and be certain you understand the implications of signing. Express Assumption of Risk Associated with use of Personal Watercraft, Waterskiing, Wakeboarding, Tubing and Related Activities.

By signing this waiver I hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with the operation of Personal Watercraft, Waterskiing, Wakeboarding, Tubing and activities, transportation to and from the vessel and related watersports activities to which I am about to engage, including but not limited to:

Changing water flow, tides, currents, wave action, and ship's wakes;

Collision with any of the following:

a) Other participants, b) the watercraft, c) other watercraft, d) man made or natural objects, e) shuttle boat;

Wind shear, inclement weather, lightning, variances and extremes of wind, weather and temperature;

My sense of balance, physical condition, ability to operate equipment, swim and / or follow directions;

Collision, capsizing, sinking, or other hazard that may result in wetness, injury, exposure to the elements, hypothermia, impact of the body upon the water, injection of water into my body orifices, and/or drowning;

The presence of insects, bacteria and marine life forms;

Equipment failure or operator error;

Heat or sun related injuries or illnesses, including sunburn, sun stroke or dehydration;

Fatigue, chill and / or reaction time and increased risk of an accident.

If any provision in this agreement is invalid or unenforceable under applicable law, the remaining provisions will continue and in full force and effect.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of being allowed to participate in the above described Watersports, Transportation, and Water Ski / Wake Board/ Tubing activities, as well as the use of any of the facilities, boats, personal watercraft, specifically, including transportation and the use of the equipment of the below listed releasees, I hereby agree as follows:

1) To waive and release any and all claims based upon negligence, active or passive, with the exception of intentional, wanton, or willful misconduct that I may have in the future against all of the following named persons or entities herein referred to as releasees:

Anchorage Yacht Basin Inc. Owner (Company and/or Individuals)

Anchorage Yacht Basin, LLC. (Company and or Individuals)

2) To release the releasees, their officers, directors, employees, representatives, agents, and volunteers, and vessels from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, executors, or assignees may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releasees or otherwise, with the exception of gross negligence. By executing this document, I agree to hold the releasees harmless and indemnify them in conjunction with any injury or loss of life that may occur as a result of engaging in the above activities.

3) By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releasees, other than what is set forth in this Agreement.

I hereby declare that I am of legal age and am competent to sign this Agreement or, if not, that my parent or legal guardian shall sign on my behalf and that my parent or legal guardian is in complete understanding and concurrence with this Agreement.

DECLARATION OF FITNESS TO PARTICIPATE IN WATERSPORTS ACTIVITIES

I hereby declare I am physically fit. I do not, and have not, suffered from any of the following conditions, which I understand may lead to a dangerous situation with regard to other persons or myself during Watersports activities:

Epilepsy, fits, severe head injury, recurrent blackouts or giddiness, disease of the brain or nervous system, high blood pressure, lung or heart disease, recurrent weakness or dislocation of any limb, diabetes, mental illness, drug or alcohol addiction, recent back injury, arthritis or severe joint sprains, chronic bronchitis, asthma, rheumatic fever, thyroid adrenal or other glandular disorder, recent blood donation or any condition that requires the regular use of drugs. I hereby declare that I have no physical or mental condition that should preclude me from participating in my chosen activity, that I am not participating against medical advice or treatment, and that I have not been diagnosed by a registered doctor as having a terminal illness. Even if I have a health condition as stated above of which I am unaware, by signing this form I still choose to participate in the activity of Personal Watercraft, Waterskiing, Wakeboarding, Tubing and Related Activities, and agree to waive all responsibilities to all above mentioned parties concerning any consequences that would result from my actions. I further declare that in the event that I feel ill or unwell, have any physical complaints whatsoever or if an injury is sustained of any kind during the course of the Activities, I will notify the Host immediately and before leaving the premises.

The term Vessel shall include any additional equipment LESSEE rents from LESSROR including but not limited to skis, tubes, wakeboards, any type of towable, ski ropes, life jackets and dock lines. If, for any reason, prior to or during the rental, the Vessel is substituted for another vessel, such substitute vessel shall be deemed the Vessel.
