Waiver of Liability, Assumption of Risk, and Indemnity Agreement Waiver

In return for being permitted to participate in activities organized by Herd & Flock Animal Sanctuary, including any associated off site activities, use of the premises, facilities, staff, equipment, transportation, and services, I, for myself, heirs, personal representatives, and assigns, do hereby release, waive, discharge, and promise not to sue Herd & Flock Animal Sanctuary, a non-profit corporation, its property owners Katherine Dwight and Meghan Dibble, its directors, officers, employees, and agents, from liability from any and all claims, including negligence, resulting in personal injury (including death), accidents or illnesses, and property loss, in connection with my presence on the property, and participation in any activity, and any use of Herd & Flock Animal Sanctuary premises and facilities.

I understand that participants will engage in activities related to the rescue, transportation, and care of farm animals and maintenance of the grounds and facilities. These activities carry certain inherent risks that cannot be eliminated regardless of the care taken to avoid injury.  I understand that farm animals are unpredictable and their behavior may endanger the health and safety of the people around them. Likewise, I understand that wild animals, such as, but not limited to, wild pigs, coyotes, raccoons, and rattlesnakes, are present on the property and their actions can lead to the injury or even death of participants.

I AM AWARE THAT MY PRESENCE ON THE PROPERTY AT 3448 LAGUNA CREEK TRAIL, VACAVILLE, CA 95688, AND MY PARTICIPATION IN ACTIVITIES ON AND OFF SITE ARE HAZARDOUS ACTIVITIES AND THAT I COULD BE SERIOUSLY INJURED OR EVEN KILLED. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED, AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY, DEATH OR PROPERTY DAMAGE, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN.

I agree to indemnify and hold Herd & Flock Animal Sanctuary, Katherine Dwight, and Meghan Dibble harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees, arising out of my involvement in activities, and to reimburse it for any such expenses incurred.

Photo/Video: I hereby grant permission to the rights of my image, likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.

Severability: I further agree that this Waiver of Liability, Assumption of Risk, and Indemnity Agreement is intended to be as broad and inclusive as permitted by law, and that if any portion is held invalid the remaining portions will continue to have full legal force and effect.

Governing Law and Jurisdiction: This Agreement shall be governed by the laws of the State of California, and any disputes arising out of or in connection with this Agreement shall be under the exclusive jurisdiction of the Courts of the State of California.

Acknowledgment of Understanding: I have read this Waiver of Liability, Assumption of Risk, and Indemnity Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I confirm that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
