LIABILITY RELEASE, COVENANT NOT TO SUE, AND INDEMNIFICATION AGREEMENT (“RELEASE”)

LIABILITY RELEASE AND COVENANT NOT TO SUE. In consideration for receiving authorization to use the gun range facilities at MD Arsenal, Inc., I hereby release and covenant not to sue MD Arsenal, Inc. or its members, officers, managers, agents, instructors, and employees (collectively referred to as “Releasees”) from and with respect to any an all liability, claims, expenses, demands, actions, and causes of action whatsoever arising out of or relating to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Releasees, or otherwise, while at MD Arsenal, Inc. I acknowledge and assume full responsibility for risk of injury, death, or property damage due to any negligence of Releasees or otherwise while I am at the gun range at MD Arsenal, Inc. 

INDEMNIFICATION. I agree to indemnify and save and hold harmless Releasees, and their personal representatives and assigns from any and all actions, causes of action, claims, demands, damages, costs (including reasonable attorney fees), loss of services, expenses, compensation, and all consequential damages caused by my breach of this agreement. I further agree to indemnify Releasees for any damages or harm to persons or property that I may cause while making use of the gun range at MD Arsenal, Inc. 

SCOPE. I agree that this document is intended to be as broad and inclusive as permitted by the law of the State of Maryland, and that if any portion of it is held invalid, it is agreed that the balance, notwithstanding, continue in full legal force and effect. I have read and I voluntarily sign this RELEASE and further agree and acknowledge that no oral representations, statements, or inducements apart from the foregoing written agreement have been made. It is my further intent that this RELEASE shall bind members of my family including my spouse and children, as well as my heirs, personal representatives and assigns.

GOVER NANCE. This release is governed by the laws of the State of Maryland. In the event any legal action is commenced as a result of damages suffered in accordance with the activities anticipated under this agreement, the exclusive venue for such action shall be Washington County, Maryland and the exclusive jurisdiction shall be the Circuit Court for Washington County, Maryland.

RELEASE, AND INDEMNIFICATION, AND HOLD HARMLESS AGREEMENT

 

I recognize and understand that there are risks associated with the use of firearms and being in proximity to their use. I voluntarily assume all risk of injury and loss from all such activities of MD Arsenal INC. Therefore, in consideration of MD Arsenal INC., allowing me to participate in firearms and safety classes, for and on behalf of myself and my heirs, executors, administrators, successors, and assigns, irrevocably and unconditionally release, indemnify, and hold harmless MD Arsenal INC., and its affiliates, managers, members, representatives, agents, servants, officers, insurers, employees, successors and assigns, from any and all liability for all claims, damages, losses, and injuries that I might suffer or incur from any and all causes whatsoever as a result of participation in practice and/or presence at any events conducted with MD Arsenal INC., including but not limited to losses caused wholly or in part by the negligence of MD Arsenal INC., or any other persons for whose acts or omissions MD Arsenal INC., could be held liable in any manner. I recognize that there are risks associated with the use of firearms and being in proximity to their use, and assume all risk of injury from all such activities of MD Arsenal INC. I acknowledge that MD Arsenal INC., cannot guarantee that safe firearms practices will be used by every invitee and licensee at every moment. Therefore, for and on behalf of myself and my heirs, executors, administrators, successors, and assigns, I covenant and agree not to sue MD Arsenal INC., and its affiliates, managers, members, representatives, agents, servants, officers, insurers, employees, successors and assigns for any loss that arises from or results from my conduct or the conduct of other persons, or that arises from or results while participating in or attending any event sponsored by MD Arsenal INC. I grant to MD Arsenal INC., and their legal representatives and assigns, the ability to record my image, voice and actions for use in print, film, television, radio or other digital medium and I grant to MD Arsenal INC., and their legal representatives and assigns, the irrevocable right to use and publish photographs, still or moving, digital or otherwise, of me or in which I may be included, for the purposes of self-promotion, including advertising’s business, in any manner and medium; and to alter and composite the same without restriction and without my inspection or approval. I hereby release and its legal representatives and assigns from all claims and liability relating to said photographs. I agree that MD Arsenal INC., and their legal representatives and assigns, are the sole owner of all rights in and to said photographs and recordings, for all purposes absolutely and in perpetuity, including the right to telecast and/or distribute the film, programs, commercials, or recordings. I agree to hold MD Arsenal INC., and any other third parties harmless against liabilities, loss, or damages caused by, or arising out of the telecast and/or distribution, or the use of my likeness, appearance, or any vocal statements made by me. Further, I understand and acknowledge that in the course of firearms safety and accuracy instruction, there may be incidental physical contact between the instructor and the student. I agree to hold MD Arsenal INC., its agents and assigns harmless against any liability, loss, or damages caused by or arising out of such physical contact.  

           I have had a full and ample opportunity to read and understand this Agreement before signing it.
