TERMS OF LEASE
In consideration of the use of the equipment, facilities, and/or services of Wiesen Properties, LLC, doing business as Crystal River Outfitters (“Crystal River Outfitters”), the undersigned acknowledges and agrees as follows:

  1. I accept for use, as is, the equipment in good condition and accept full responsibility for care of the equipment while in my possession.  I will be responsible for the prompt replacement, at full retail value, of all rental equipment not returned or otherwise damaged, other than reasonable wear and tear, which results from the use of the equipment.  All instructions on use of the equipment have been made clear to me and I understand the function of the equipment.
  2. I agree to pay one additional day’s rental rate for all equipment not returned to Crystal River Outfitters on or before the date and time due.
  3. I agree to obey all State and Local boating regulations, and all lawful directives from appropriate emergency or law enforcement personnel while operating or renting the equipment.  In the event of a citation for violation of these rules, I shall be solely responsible.  I agree to immediately notify Crystal River Outfitters of any incidents or injuries occurring while renting the equipment.
  4. I understand that in some places on the Crystal River there are deep holes (over my head).
  5. I realize that I may capsize my craft and if so I will immediately vacate the downstream path so I won’t be pinned between the watercraft and any obstacles.
  6. I understand that I must steer the rented equipment around all obstacles.
  7. I understand that the Crystal River is considered Class I and Class II, which means moving water with some riffles, and maneuvering skills are required.
  8. I understand that a U.S. Coast Guard approved, wearable PFD life vest is given to all participants, and children under the age of 16 are required to wear their life vest at all times.
  9. The undersigned has read and understands this Rental Agreement, including but not limited to the terms and conditions on Page 2 of this Agreement.  The undersigned understands that this Agreement relates to surrendering valuable legal rights and assuming important legal responsibilities and does so freely and voluntarily.

I agree to take full responsibility for the above participants and agree to the Agreement of this Rental Agreement.


Additional Terms and Conditions 

WARNING. There are significant elements of risk in any adventure sport or activity associated with the use or presence water craft, including but not limited to canoes, kayak, and the use of related equipment. These risks are inherent is canoeing and kayaking and may be present even if the equipment is used properly and even in still water.

SCOPE OF AGREEMENT. This Agreement covers all activities indirectly or directly associated with the use of Crystal River Outfitters equipment, facilities, services, and activities organized by, sponsored by, or directed by Crystal River Outfitters (“Crystal River Outfitters Activities”).

RISK FACTORS. I understand and acknowledge that the Crystal River Outfitters Activities involve risks such as, but not limited to, the following: (i) changing water flow, conditions or current; (ii) collision with other participants, any portion of the interior of the craft, other water craft, manmade or natural objects, including overhanging, submerged and/or semi-submerged trees, branches, rocks and boulders; (iii) cold weather and heat related injuries and illnesses including hyperthermia, frostbite, heat exhaustion, sun stroke, and dehydration; (iv) inclement weather, vari­ances and extremes of wind, weather and temperature, the presence of insects and animals; (v) sense of balance, physical coordination, ability to swim, and/or ability to follow directions; (vi) loss of control of the craft, collision, capsizing, and sinking of the craft which can result in wetness, injury, exposure to the elements, hypothermia and drowning; (vii) getting in and out of the craft; (viii) travel, including hiking, portaging and travel to and from the related and unrelated activities; (ix) the presence of wild animals, including marine life forms, (x) unavailability of emergency aid services and emergency medical care. I acknowledge that Crystal River Outfitters Activities, as well as other foreseeable or unforeseeable factors or circumstances, may result in a RISK OF PROPERTY DAMAGE, BODILY INJURY, AND POSSIBLY DEATH.

ASSUMPTION OF RISK. By executing this Release of Liability, I expressly assume all risk that arises from participation in Crystal River Outfitters Activities, the acts of others, the unavailability of emergency care, and any other foreseeable or unforeseeable factors or circumstances related to the Crystal River Outfitters Activities. I assume all risk of injury, wrongful death or property damage related to the Crystal River Outfitters Activities.

ACKNOWLEDGMENT OF RULES, POLICIES AND PROCEDURES. I acknowledge that I have read and understood all of the rules, policies and procedures relat­ing to Crystal River Outfitters Activities and understands that the safe and proper use of the facilities, equipment and participation in Crystal River Outfitters Activities is dependent upon carefully following such rules, policies and procedures. I agree to wear a properly fitted and fastened U.S. Coastguard approved flotation device (lifejacket) while aboard a boat or on or in the water. I understand that canoeing and kayaking should only be undertaken after proper instruction and training and that Crystal River Outfitters is not providing such training in connection with the rental of equip­ment. I assume full responsibility for deciding where, when and with whom to paddle. I acknowledge and agree that the rental equipment provided by Crystal River Outfitters is for my sole and exclusive use of the Participants listed on this Agreement and may not be used by any other persons.

PHYSICAL CONDITIONS AND SKILLS. I represent that I haves the requisite skills, physical abilities and mental abilities necessary for proper and safe use of the Crystal River Outfitters equipment, facilities and services and to participate in the Crystal River Outfitters Activities. I agree that if I have any questions as to what skills, qualifications or training are necessary to properly use the equipment or facilities, or to participate in the Crystal River Outfitters Activities, then I shall direct such questions to the appropriate staff member on site.

RELEASE. I hereby release, discharge, waive, disclaim. and relinquish all claims, actions or causes of action against Crystal River Outfitters and its officers, employees and agents and agrees not to sue them on account of or in conjunction with any claims, causes of action, injuries, damage, cost of expenses arising out of Crystal River Outfitters Activities not conducted on National Park Service Property, including those based on death, bodily injury or property damage whether or not caused by participation in Crystal River Outfitters Activities or the negligence of Crystal River Outfitters.

WAIVER. I waive the protection afforded by any statute or law in any jurisdiction whose purpose, substance, and/or effect is to provide that a general release shall not extend to claims, material or otherwise which the person giving the release does not know of or suspect at the time of executing the release. This means, in part, that I am releasing unknown future claims.

INDEMNITY. I agree to indemnify and defend Crystal River Outfitters, and its officers, employees and agents (each, an “Indemnitee”) and hold them harmless from any or all claims, causes of action, damage judgments, costs or expenses, including attorney fees which in any way arise from my participation in the Crystal River Outfitters Activities not conducted on National Park Service Property which include but are not limited to damages to or destruction of any property of an Indemnitee, of any others, injury or death of the undersigned or anyone else or any liability arising from the act or negligent act of an Indemnitee, myself, or anyone else.

ACKNOWLEDGMENT AND ASSUMPTION OF RESPONSIBILITY.  Although Crystal River Outfitters has taken reasonable steps to provide me with appropriate equipment to enjoy the Crystal River Outfitters Activities, Crystal River Outfitters has informed me the Crystal River Outfitters Activities are not without risk. Certain risks are inherent in the Crystal River Outfitters Activities and cannot be eliminated without destroying the character of the Crystal River Outfitters Activities. These inherent risks are some of the same elements that contribute to the unique character of the Crystal River Outfitters Activities and can cause loss or damage to equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. Crystal River Outfitters does not want to frighten me or reduce my enthusiasm for the Crystal River Outfitters Activities, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks. I acknowledge those risks have been set forth in this Agreement. I am aware that the Crystal River Activities entail risks of injury or death to any participant. I understand that a description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for these inherent risks identified herein and those specifically not identified herein. My participation in the Crystal River Outfitters Activities is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks. I acknowledge that engaging in the Crystal River Outfitters Activities may require a degree of skill or knowledge different from other activities and that I have responsibilities as a participant. I acknowledge that the staff of Crystal River Outfitters has been available to more fully explain to me the nature and physical demands of the Crystal River Outfitters Activities and the inherent risks, hazards, and dangers associated with the Crystal River Outfitters Activities. I certify that I am fully capable of participating in Crystal River Outfitters Activities. Therefore, I assume and accept full responsibility for myself, including all minor children and other Participants in my care, custody, and control, for bodily injury, death, or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and danger not specifically identified, and as a result of my negligence in participating in the Crystal River Outfitters Activities.

PROPERTY DAMAGE. I agree to pay for any or all damages to any property or equipment of Indemnitee caused by myself or any listed Participants either negligently, willfully, or otherwise.

REPRESENTATIVES. I have executed this Release of Liability for myself and my heirs, assigns, and legal representatives.

INSURANCE. I understand that Crystal River Outfitters may not carry participant insurance. I acknowledge that I either have appropriate insurance or, in its absence, agree to pay all cost of rescue and/or medical services as may be incurred on my behalf.

CONSENT AND RELEASE ON BEHALF OF MINOR. In the event that the Participants listed on Page 1 of this Agreement are minors or are under the age of 18 years old, I acknowledge that I am the parent and/or legal guardian of said minor. I agree that I have read and understand the terms and conditions of this Agreement which involve surrendering valuable legal rights of the minor and myself and agree to be bound by all the terms of this Agreement.  I also consent to the minor’s participation in the Crystal River Outfitter Activities by the minor.

CRYSTAL RIVER OUTFITTERS.  For purposes of this Agreement, Crystal River Outfitters shall mean Wiesen Properties, LLC, d/b/a Crystal River Outfitters and The Cyclery, and their officers, agents, employees, stock holders, and all other persons or entities associated with those businesses.

ACCEPTANCE.  I have carefully read, clearly understand, and accept the terms and conditions stated in this Agreement and acknowledge that this Agreement shall be effective and binding upon myself, my heirs, assigns, personal representatives, and estates for all members of my family, including minor children, and all Participants.

COVID-19 WAIVER. I represent that no one using Crystal River Outfitters’ equipment has Covid-19 or any symptoms thereof.  I agree to release and hold Crystal River Outfitters harmless from any potential claims that I or any Participants were exposed to or infected by Corvid-19 at the Cyclery property or while using Crystal River Outfitters’ equipment.
