GREAT PLACE JET SKI WAIVER AND RENTAL AGREEMENT

 

I. WAIVER AND RELEASE OF LIABILITY AGREEMENT DISCLAIMER

This Waiver and Release Agreement is applicable to all renters, operators, passengers, and users of equipment provided by Great Place Jet Ski* (For purposes of this Waiver and Release, the term “Great Place Jet Ski” includes all principles, directors, officers, employees, agents, representatives, servants, assigns, successors, insurers and subsidiaries of Nauti Side Boat Rentals). If any other rental agreement is supplemented with this Release, the provisions of this Release will prevail over any clauses in the rental agreement that is inconsistent with this Release. The undersigned agrees that he/she is also signing this Release on behalf of undersigned’s minor children. Renter agrees that he/she will disclose to Great Place Jet Ski all potential operators, passengers, and users of said rental equipment. Renter further agrees that in the a event that he/she fails to notify Great Place Jet Ski of all potential operators, passengers, or users of said equipment, he/she will be personally liable for any damages to the undisclosed individuals, even if such damages arise out of the negligence or fault of Great Place Jet Ski.

II. ACKNOWLEDGEMENT OF RISKS

The undersigned hereby acknowledges that some, but not all of the risks of participating in watersport activities include: 1) Changing water flow, tides, currents, wave action and ships’ wakes; 2) Collisions with any of the following: other participants, the boat’s, other boats, and manmade or natural objects; 3) Collision, capsizing, sinking or other hazard which results in wetness, injury, expose to the elements, hypothermia, drowning and/or death; 4) Attack by or encounter with insects and marine life forms 5) Equipment failure or operator error; 6) My sense of balance, physical coordination, ability to operate equipment, swim and/or follow directions; 7) Wind, inclement weather, lightning, variances and extremes of wind, weather, and temperature, 9) Heat or sun related injuries or illnesses, including sunburn, sunstroke or dehydration of these risks is not complete and that unknown or unanticipated risks may result in injury, illness or death.

III. EXPRESS ASSUMPTION OF RISK

The undersign herby agrees that he/she is renting, operating or using the equipment provided by Great Place Jet Ski at his/her own risk. The undersigned agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental equipment, The undersigned assumes full responsibility for the risks of personal injury, accidents or illness, including but not limited to sprains, torn muscles and/or ligaments; fracture or broken bones; eye damage; cuts, wounds, scrapes, abrasions, and/or contusions; head, neck, and/or spinal injuries; animal or insect bite or attack; shock, paralysis, drowning, and/or death; and any resultant expenses from any of the foregoing risks and assumes all risk injury, illness, damage or loss that might result, regardless of the cause, even if the risks arise out of the negligence or fault of Great Place Jet Ski.

IV. ALCOHOL AND RELEASE OF LIABILITY POLICY

Here at Great Place Jet Ski, we do not sell or serve alcoholic beverages. We will allow you to bring in alcohol, under the circumstances, that we will not be held accountable for any injuries sustained while under the influence of alcohol. It is also your responsibility, that if you are under the influence of alcohol you must prepare your own transportation when unboarding Great Place Jet Ski’s vessels. Methods of safe transportation include but are not limited to ride share programs such as Uber and Lyft. Taxi services or family members/friends. Failure to do so, risk violating Texas Penal Code 49.04 Driving While Intoxicated. By signing below, you agree that you will be held accountable for any and all injuries sustained here at Nauti Side Boat Rentals and that you participate at your own risk.

V. WAIVER/RELEASE OF LIABILITY

By the execution of this Release, the undersigned voluntarily releases, forever discharges and agrees to indemnify and hold harmless Great Place Jet Ski from any and all liability of any nature for any and all injury or damage arising from personal injuries sustained by the undersigned or any minor children under the undersigned’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Great Place Jet Ski, regardless of the cause. The undersigned assumes full responsibility for any such injuries or damages, which may occur, and further agrees that Great Place Jet Ski shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that Nauti Side Boat Rentals shall not be responsible for such injuries, damages, loss or theft. EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY GREAT PLACE JET SKI, whether such negligence is present at the signing of this Release or takes place in the future. This Waiver and Release does not apply to gross negligence or intentional torts by Great Place Jet Ski.

VI. LIABILITY TO THIRD PARTIES

The undersigned hereby agrees that he/she will indemnify and hold harmless Great Place Jet Ski for all personal injuries, property damages, or any other damages to any and all third parties, including but not limited to, operators and passengers of other boat’s and minor children under the undersigned’s custody, care, and control as a result of any and all activities related to the rental, operation, or use of equipment provided by Great Place Jet Ski, even if such damages arise out of the negligence or fault of Great Place Jet Ski.

VIII. ACKNOWLEDGEMENT OF WAIVER AND RELEASE

The undersigned states that he/she has had sufficient time to review the Waiver and Release and to ask any questions associated with said release. The undersigned further states that he/she has carefully read the foregoing Waiver and Release, knows the contents thereof, and has signed this Release as his/her own free act. The undersigned warrants that he/she is aware that he/she may rent, operate, or use equipment from another rental facility, but has chosen to rent, operate, or use equipment from Great Place Jet Ski with the knowledge that signing this Release is a requirement for rental, operation, and use of said equipment. The undersigned further warrants that he/she is fully aware that he/she is waiving any right he/she may have to bring a legal action to assert a claim against Great Place Jet Ski for Great Place Jet Ski’s negligence.

DECLARATION OF FITNESS TO OPERATE PERSONAL WATERCRAFT

I hereby declare that I am physically fit. I do not, and have not, suffered from any of the following conditions, which I understand may lead to a dangerous stituation with regard to other person or myself during operation of rental personal watercraft.

Epilepsy, fits, severe head injury, recurrent blackouts or giddiness, disease of the brain or nervous system, high blood pressure, lung or heart disease, recurerent weakness or dislocation of limbs, diabetes, mental illness, drug or alcohol addiction, recent back injury, arthritis, severe joint sprains, chronic bronchitis, asthma, rheumatic fever, thyroid adrenal or other glandular disorder, recent blood donation or any condition that requires the regular use of drugs.

I hereby declare that I have no physical or mental condition that should preclude me from participating in my chose anctivity, that I am not participating against medical advice or treatment, and that I have not been diagnosed by a registered doctor as having a terminal illness.

Even if I have a health condition as stated above of which I may be unaware, by signing this form I still choose to participate in this activity with the rental property and agree to waive all responsibilities to all above mentioned parties concerning any consequences that would result from my actions.

I further Declare that in the event that I feel ill or unwell, have any physical complaints whatsoever or if any injury is sustained of any kind during the course of Personal Watercraft Rental, I will notify the rental Manager immediately and when returning equipment.

Renter acknowledges his/her responsibility for the safe and proper operation of the craft; and for the safety and welfare of other boaters, personas, and passengers. IT IS AGREED AND UNDERSTOOD by RENTER that the RENTAL COMPANY shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunction of the rental craft. RENTER FURTHER AGREES to indemnify and hold harmless the RENTAL COMPANY and its agents, affiliates and personnel from, and against any and all claims for loss or damage to property or injury to persons (including death) resulting through the use, operation or possession of said rental craft. RENTER further agrees to hold the RENTAL COMPANY harmless should loss or damages occur to any RENTER's personal property while carried in, or on, the rental craft, including loss or damage by fire, water, theft, or any other causes whatsoever.

RENTER understands that rental deposits become non-refundable within 48 hours of booking.

RENTAL COMPANY's ability to provide a rental craft if reserved, is contingent upon and subject to the return of the unit by the previous RENTER, or any other cause beyond RENTAL COMPANY's control.

RENTAL COMPANY reserves the right to cancel this rental agreement due to inclement or impending bad weather, based upon personal observation or weather forecasts. Rental fees will be prorated based upon time used. Should RENTER desire to cancel their reservation due to inclement weather forecasts, a joint agreement between RENTAL COMPANY and RENTER will be made NO EARLIER than the day of rental.

Should any term or condition of this Rental Agreement be held void or unenforceable, then that term shall be deemed severed from this Agreement and the unenforceable, then that term shall be deemed served from this Agreement and this enforceability and the remainder shall not be affected and will remain in full force and effect.

In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental craft, the RENTER willl IMMEDIATELY REPORT it to RENTAL COMPANY. Continued use of it shall be entirely at the RENTER's risk and thus RENTER assumes all liability of injury and damage to all persons and property that may become involved by its continued use. RENTER acknowledges and understands that RENTAL COMPANY cannot guarantee against mechanical failuers of the rental equipment. Any cost of repair(s) due to normal wear and tear on the equipment will be borne by the RENTAL COMPANY. Should the RENTAL COMPANY, or a repair person, repair or replace a unit that is due to RENTER's oversight, neglect, or misues, RENTER agree that the repair call costs will be billed to the RENTER's security deposit. If the anticipated cost of repair or replacement of damaged watercraft exceeds the security deposit, RENTER agrees to pay for cost of replacement equipment and labor, based upon fair market value of parts and cost of labor (labor averages around $100 per hour, but varies depending upon the type of repair needed).

Prohibited uses: RENTER may not use Personal Watercraft for any use not intended by manufacturer. In addition, RENTER shall not use the boat in any of the following manners:

  • By any other person not an approved operator listed above
  • In any type of race or competitive event
  • For any illegal purpose or in an illegal manner
  • To carry any type of hazardous or explosive substance
  • To push or tow any other watercraft, except in emergency retrieval situations
  • After dusk or during the night
  • To carry loads beyond stated capacity
  • In a reckless, abusive, or negligent manner
  • By any person consuming drugs
  • In violation of the terms and conditions of this agreement in any way

THE TERMS AND CONDITIONS ON ALL PAGES OF THIS CONTRACT CONTAIN THE ENTIRE UNDERSTANDING BETWEEN RENTER AND RENTAL COMPANY AND NO OTHER REPRESENTATION OR INDUCEMENT, ORAL OR WRITTEN, HAS BEEN MADE WHICH IS NOT INCLUDED IN THIS RENTAL AGREEMENT.

I (WE) HAVE READ ALL PAGES OF THE AGREEMENT AND FULLY UNDERSTAND THE TERMS AND CONDITIONS AS SET FORTH ON ALL PAGES; THAT I (WE) ACKNOWLEDGE RECEIPT OF A COPY OF THIS AGREEMENT.

PWC Renter Orientation Checklist

Protective Clothing/Equipment for Operators and Passengers

Wear PFD and Other Protective Clothing/Equipment

  • You must wear an appropriate personal flotation device (PFD) at all times.
  • Severe internal injuries can occur if water is forced into body cavities as a result of falling into water or being near jet thrust nozzle.
  • Additional protective equipment (such as footwear, eyewear) may be needed.

PWC Controls

Keep Lanyard Attached

  • Securely attach engine shut-off cord (lanyard) to your wrist or PFD (as directed) and wear it at all times. If you fall off the PWC, the engine will automatically stop.

Know How to Start and Stop the Engine

  • ENSURE YOU ARE IN AT LEAST 36" OF WATER BEFORE TURNING ON YOUR PWC. FAILURE TO DO SO CAN CAUSE DEBRIS TO ENTER THE CRAFT'S INTAKE, DAMAGING THE EQUIPMENT.
  • Press the red button on the left handlebar oncd to start engine electronics, and then hold for 2-3 seconds to fully start the engine.

Know Operational Controls

  • The throttle controls your speed. Apply the throttle lever on the handle to accelerate and release it to slow down.
  • The handlebars move the jet thrust nozzle directing thrust in different directions to steer the PWC. Without thrust you cannot steer the PWC.

​AVOIDING COLLISIONS - Most PWC Injuries and Deaths Result from Collisions

Do not release throttle when trying to steer - YOU NEED THE THROTTLE TO STEER.

Take early action to avoid collisions

  • Remember, PWCs and other boats do not have brakes.

Scan Constantly

  • Scan constantly for people, objects and other watercrafts.
  • Be alert for conditions that limity your visibility or block your vision of others.

Operate Defensively

  • Operate at safe speeds.
  • Keept a safe distance (minimum 50 feet) away from people, objects, shorelines and other watercrafts.
  • Do not follow directly behind PWCs or other boats.
  • Do not go near others to spray or splash them with water.
  • Avoid sharp turns and other maneuvers that make it difficult for others to avoid colliding with you or that make it difficult for others to understand where you are going.

Other Hazards

Avoid Agressive Maneuvers

  • This is a high-performance watercraft, not a toy.
  • Ride within your limits and avoid aggressive maneuvers to reduce the rise of loss of control, ejection, and collision.
  • Sharp turns or jumping wakes or waves can increase the risk of back/spinal injuries, facial injuries, broken limbs or other bones.

Do not apply throttle when anyone is at the rear of the PWC

  • Items such as long hair, loose clothing, PFD straps, or lines can become entalged in moving parts resulting in severe injury or drowning.
  • Water and or debris exiting jet thrust nozzle can cause serious injury to those on or behind the craft.

Know how to right the PWC in open water

  • If you capsize in open water, swim to the rear of the PWC and turn it upright, then board it from the rear.

OTHER RULES AND SAFETY INFORMATION THAT MAY APPLY TO YOUR SITUATION

Follow rental agency rules and boating laws

  • Review all rental agency rules and applicable boating laws.
  • Do not overload PWC. Know and follow all State requirements related to towing.

Know the waters

  • Know the area in which you will be operating and observe all navigational markers and signs

Follow the additional PWC warnings and instructions that may apply

  • Depending on the circumstances, the Owner's Manual and product labels may have relevant information not covered in this basic orientation.

FINAL CHECK

Ready and Able?

  • Do you understand that you should scan constantly, operate defensively and avoid aggressive maneuvers?
  • Do you understand that PWCs do not have brakes?
  • Do you understand that you should not release the throttle when you are trying to steer away from people, objects, or other watercrafts?
  • Do you have any question about the PWC or its operation?

 

THREE CONSIDERATIONS

  1. Never start or operate a ski in 36 inches of water or less.
  2. If you think you have run over something, or something has been drawn into the intake, IMMEDIATELY shut off the engine and tow it to shore to see what the situation is. YOU WILL NOT CLEAR AN OBSTUCTION BY RUNNING THE ENGINE FASTER AND PUSHING THE OBSTRUCTION THROUGH.
  3. You will not allow anyone who has not filled out a waiver, received a safety brief, and completed the proper education or waiver (for those born after 1 September 1993) to operate a ski.

THREE THINGS TO AVOID WHILE ON THE WATER

  1. Too many people on the ski. Our skis are rated for three people, which includes anyone being towed behind the craft on an inner tube, water skis, or wake board.
  2. Not wearing a life jacket. If the ski is in the water and the engine is running, all peope on either the ski or being towed behind the craft MUST wear a well-fitted life preserver at all times.
  3. Violating the 50-foot rule. All jet ski operators must be in a NO-WAKE mode anytime they are within 50 feet of other watercrafts, a shoreline, exposed trees, swimmers, floating or permanent docks, or any other item.
