WAIVER AND RELEASE AGREEMENT

For Camp Gladiator Classes at The Boardwalk

 

PHOTO RELEASE FORM – GRANITE PROPERTIES: Permission to Use Photograph

Subject: Camp Gladiator Classes 

Location: The Boardwalk & The Pavilion (5880 State Highway 121 Plano, TX 75024)

I grant to Granite Properties, its representatives and employees the right to take photographs of me, and my property, in connection with the above-identified subject. I authorize Granite Properties, its assigns and transferees to copyright, use and publish the same in print and/or electronically.

I agree that Granite Properties may use such photographs of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.

WAIVER and RELEASE:  I, the above-named Participant, am aware that participating in this Event is a potentially hazardous activity, and that I should not so participate unless physically able. I certify that I am medically fit to participate. I am willingly and voluntarily participating in this Event and understand that I am assuming all risk associated with participation in this Event, including but not limited to falls, contact with other participants, effects of the weather such as high or low temperatures, humidity, and/or precipitation of whatever nature, and traffic/road/sidewalk/parking lot/path conditions, airborne illnesses, bacteria or viruses (including but not limited to COVID-19), all such risks being known and appreciated. In full consideration of the above-mentioned risks and hazards and in full consideration of the fact that I am willingly and voluntarily participating in this Event, and with my full understanding of all of the above, I HEREBY WAIVE, RELEASE, REMISE AND DISCHARGE ANY AND ALL CLAIMS, DEMANDS, LIABILITY, DAMAGES, ILLNESSES, OR INJURY WHATSOEVER RELATED TO THIS EVENT, AND FULLY RELEASE GRANITE PROPERTIES, INC.; GPI DEVELOPMENT LTD; TOLLWAY – 121 RESTAURANTS, LTD; TOLLWAY – 121 PARTNERS, LTD.; GPI BOARDWALK, LP; GRANITE PARK ASSOCIATION; GPLP, LLC; GPGP, LLC; NM TWIN CREEKS GP, LLC; THE NORTHWESTERN MUTUAL LIFE INSURANCE COMPANY; GRANITE PARK JV, LP; GRANITE PARK NM/GP, LLC; GRANITE PARK NM/GP I, LP; GRANITE PARK NM/GP II, LP; GRANITE PARK NM/GP III, LP; GRANITE PARK NM/GP IV, LP; GRANITE PARK NM/GP V, LP; GRANITE PARK VII, LTD; GRANITE PARK III, LTD; GRANITE PARK II, LTD;  AND ALL OF THEIR RESPECTIVE AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, AND REPRESENTATIVES (COLLECTIVELY, “THE RELEASED PARTIES”), FROM ANY AND ALL CLAIMS, DEMANDS, LIABILITY, DAMAGES, ILLNESSES, OR INJURY OF ANY KIND ARISING TO ME OR BY ME AND RESULTING FROM MY PARTICIPATION IN THIS EVENT, INCLUDING ANY CLAIMS, DEMANDS, LIABILITY, DAMAGES, ILLNESSES, OR INJURY ALLEGEDLY ATTRIBUTED TO THE NEGLIGENT ACTS OR OMISSIONS OF THE ABOVE-NAMED RELEASED PARTIES.
