  • PHOTOGRAPHY/VIDEO ACKNOWLEDGEMENT ​
  • INDEMNIFICATION AGREEMENT

I understand that if I strictly follow all safety rules, training, and instruction during TEXAS MUDDAUBER POTTERY events, classes, or workshops injury can be PREVENTED. 

1. AGREEMENT TO FOLLOW DIRECTIONS.  I agree that I and/or my child/children will: 

  • obey all/posted rules and warnings
  • follow any oral instructions or directions given by Texas MudDauber Pottery, or the employees, representatives or agents.
  • I understand that if I or my child/children do not obey rules, requests, instructions, or training as above, I or my child/children could be asked to discontinue event/class without refund. 

2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with participation at any creative ceramic making or other art events or classes. I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Texas MudDauber Pottery for injury, loss or damage arising from participation in Texas MudDauber Pottery LLC events, workshops, and classes, whether caused by the fault of myself, my family, Texas MudDauber Pottery LLC or other third parties.

3. INDEMNIFICATION. I agree to indemnify and defend Texas MudDauber Pottery against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may arise from my or my child/children's participation in Texas MudDauber Pottery events, workshops, or classes.

4. FEES. I agree to pay for all damages to the facilities and/or equipment of Texas MudDauber Pottery caused by any negligent, reckless, or willful actions by me or my family

I further understand and agree that:

5.  TEXAS MUDDAUBER POTTERY activities are not child care as defined by the State of Texas;

6.  TEXAS MUDDAUBER POTTERY is not responsible for unattended children on the premises;

7. I understand that TEXAS MUDDAUBER POTTERY will NOT use any image or video for social media or advertising purposes that I or my minor child/children can be personally identified in without my written consent. However, TEXAS MUDDAUBER POTTERY may use photos or videos that are artistically altered or distorted to conceal identity or could use images just of just hands or feet, or maybe use photos/videos of participants from the side or behind in a manner that participant cannot be personally identified.

8.  I understand and agree that all photographs and video recordings will remain the property of TEXAS MUDDAUBER POTTERY LLC, and that TEXAS MUDDAUBER POTTERY LLC may use such photographs or video recordings for archival, security, and training purposes only.

 

 

I have carefully read this Waiver of Liability, Photography/Video recording Acknowledgement, Release and Indemnification Agreement and fully understand its contents. I am aware that this is a release of liability and a contract between myself and TEXAS MUDDAUBER POTTERY, and that I sign it of my own free will.
