GUEST AGREEMENT

TO:   Bliss Stays Inc. (the “Owner”)

FROM (the “Guest”)

RE:    Guest of 53 Woodhouse Avenue, Port Dover, ON N0A 1N4 (the “Property”)

 

FOR GOOD AND VALUABLE CONSIDERATION, the receipt and sufficiency of which is hereby acknowledged, the Guest agrees to the following terms and conditions:

 1. Air BnB

It is acknowledged by the Guest that although the Property is listed on Air BnB, the Guest is required to sign and deliver this Agreement as a condition to staying at the Property.

2. Security Deposit

The Guest acknowledges that a security deposit of $500 will be charged to the Renter’s credit card two days before the reservation, to be held and applied in accordance with Air BnB’s terms, conditions and policies. The Renter confirms that he/she has reviewed, or has had the opportunity to review, all Air BnB terms, conditions, policies and guidelines.

3. Rental Period

(1) The rental period (the “Rental Period”) shall be the period commencing on the Arrival Date and ending on the Departure Date, unless terminated in accordance with the provisions of this Agreement.

4. Check In and Check Out

The guest shall check in no earlier than the specified time on the Arrival Date (as shown on the AirBnB reservation) and shall check out no later than the specified time on the Departure Date (as shown on the AirBnB reservation). Neither the Renter nor any of the Guests shall be entitled to access the Property at any time outside of those times.

5. Rental Rate

The rental rate (the “Rental Rate”) for the Property is as what is outlined on the AirBnB Reservation.  This ranges from $400 -$650 a night.

6. Keys/Access

The Renter shall be given a passcode to access the Property on the Arrival Date. At this time, the Renter will be able to use the passcode to enter the Property. The Renter shall lock the Property when departing for activities and when checking out.

7. Number of Guests at Property

The number of overnight Guests at the Property on any night during the Rental Period shall not exceed six persons at any time. In the event the number of overnight Guests at the Property exceeds the said maximum number, the Renter shall pay to the Owner $100 per night + HST per overnight Guest(s) over the maximum number, or the Owner may elect to terminate this Agreement in the Owner’s sole discretion, without refund or reimbursement to the Renter. The Renter shall at all times be responsible for the Renter’s Guests’ compliance with the terms and conditions herein, and the Renter shall indemnify and hold the Owner harmless for any damages or losses of any nature suffered by the Owner which are caused or contributed to by, directly or indirectly, the Renter and/or the Renter’s Guest(s).

8. Use of Property by Guest

During the Rental Period, the Renter and his/her Guest(s) shall:

(a)       maintain the Property at all times in a good and tidy condition;

(b)       refrain from smoking and vaping from inside the property and dispose of any cigarette butts outside the Property in a safe manner;

(c)       not cause or create a nuisance in any way, including, but not limited to, refraining from playing loud music inside or outside the Property;

(d)       properly use and operate all equipment, machinery and appliances at the Property;

(e)       not move or rearrange any furniture inside the Property;

(f)       not flush sanitary items down the toilets;

(g)       not sit on furniture in wet bathing suits, and shall ensure that sand is removed from shoes and feet before entering the Property;

(h)       comply with all applicable laws in connection with their use of the Property; and

(i)       leave the Property in the same condition in which it found the Property.

9. Use of Water Toys

The Renter and guests may use the Rubber Ducky and the two stand-up paddle boards that are provided at the Property. Life jackets are available for the Renter and shall be worn by the Renter and/or his or her Guests at all times. The Guest agrees to take care of the equipment and put it back into the storage when they are done, just the way they found it. The Guest agrees to follow the Water Toy Rules, as they are posted in the garage.

10. Maintenance by Owner 

(1) In the event of failure of any piece of equipment, machinery or appliance at the Property during the Rental Period, the Owner [or the Owner’s designate] may be contacted.

(2) Notwithstanding the foregoing, the Owner does not guarantee the operation of any piece of equipment, machinery or appliance serving the Property, and there shall be no discount to or refund of any portion of the Rental Rate for failure, during the Rental Period, of any piece of equipment, machinery or appliance serving the Property.

11. Access by Owner

The Owner shall be entitled to access the Property upon reasonable notice during the Rental Period for the purposes of supplying services, effecting maintenance or repairs and performing inspections.

12. Damage and Replacements

(1) The Renter shall report any damage to the Property upon arrival or occurrence. The Renter shall be responsible for any damage to or loss from the Property which occurs during the Rental Period, whether such damage is caused by the Renter, his or her Guest(s), or otherwise.

(2) The Owner or its representative shall inspect the Property on the Departure Date prior to the Renter’s departure and advise the Renter of any damage or replacements in respect of which the Renter is required to reimburse the Owner. Such items will be charged according to repair or replacement value at the time of such repair or replacement, as reasonably determined by the Owner. All such charges shall be deducted from the Security Deposit.

13. Waste

The Renter and his/her Guest(s) shall place all garbage and recycling in the designated containers and ensure that no garbage or recycling is left inside the house. All such garbage and recycling must be placed in the appropriate containers in the garage. However if the Renter is at the Property during the weekly garbage pick-up, is the Renter shall place the garbage containers on the curb at the appropriate time, as set forth on the instruction board in the garage.

14. Pets 

The Renter and Guest and his/her Guest(s) shall not be permitted to bring any pets on to the Property at any time. 

15. Indemnity

The Guest shall indemnify and save the Owner harmless from and against any liabilities or any loss or damage whatsoever arising from, related to or in connection with the Renter’s rental of the Property including, but not limited to, any claim or liability for personal injury or damage or loss of property which is made, incurred or sustained by the Renter or any of his/her Guests at the Property during the Rental Period.

16. Cancellation Policy

The rental of the Property may be cancelled in accordance with the cancellation policy set out in the Air BnB listing.

17. Termination by Owner

The Owner shall be entitled to terminate this Agreement if the Renter, or any of the Renter’s Guests, are in violation of any of the terms of this Agreement or, in the sole opinion of the Owner, if the Renter or any of the Renter’s Guests’ use of the Property is detrimental to the Property or creates a nuisance in any way.

The Owner shall also be entitled to terminate this Agreement prior to the Rental Period for any reason in its sole discretion, without penalty. In such a case the Owner shall return all funds received from the Renter forthwith. 

18. Non-Disparagement

During the Rental Period and for an indefinite period thereafter, the Guest agrees that he or she will not disparage the Property or the Owner in a manner that negatively impacts the reputation of the Property or the Owner.

19. Acknowledgment

The Guest acknowledges that the Property backs onto water with a beach area, and features a large, concrete pad at the bottom of the Property. The Guest further acknowledges that the landscaping may be uneven in some areas, resulting in an uneven pathway to the bank and down to the water. The Guest also acknowledges that while there is a fence in place on the concrete pad, there is still an element of personal risk in using the concrete pad. It is encouraged that the Guest takes care and watches their family members at all times, if applicable. It is acknowledged by the Guest that the fence does run along the Property, but there also is part of the bank that is not fenced.

In light of the foregoing and the general nature and geography of cottage rentals, and further due to the COVID-19 pandemic, the Guest acknowledges, agrees and understands that his or her stay at the Property may be inherently hazardous and involve some element of personal risk. The Guest acknowledges that the risks inherent in and incidental to his or her rental of the Property are substantial and may include, without limitation, serious personal injury and death. The Guest also acknowledges that the Property is equipped with video security and surveillance on the outside of the home, and includes one doorbell camera and three video cameras that are on the side of the home, as well as one at the bottom of the slope.”

The Guest also acknowledges that the Property is equipped with video security and surveillance on the outside of the home, and includes one doorbell camera and three video cameras that are on the side of the home, as well as one at the bottom of the slope. Security also includes a house alarm, that the Renter is required to set/turn off, if asked by the owner,  when entering or leaving the property. This code will be given on the Arrival Date along with the passcode.

20. Assumption of Risk

In consideration of the Owner’s rental of the Property to the Renter and Guests, the Guest recognizes and assumes all risks, hazards and injuries that the Guests may suffer during the Rental Period

21. Release of Owner and Limitation of Liability

(1) The Guest hereby waives, releases and forever discharges any and all claims or causes of action which the Guest may have now or may hereafter at any time have against the Owner, whether now known or unknown, relating to injury to the Guest’s person or property and which arise or are in any way connected to his or her stay at the Property. The Guest covenants and forever agrees not to bring any action against the Owner for the claims waived and released by this Section. For clarity, the Guest forever releases and holds harmless the Owner from any claim or liability for any injury whatsoever (including death) that is caused by or in any way related to the Guest’s stay at the Property. The Guest expressly understands that he or she is agreeing to waive, release, and to hold harmless the Owner for any claims, liabilities, damages or losses, whether to person or property, suffered by the Guest at the Property

(2) It is further acknowledged and agreed by the Renter that in all cases, the Owner’s liability for any loss or injury whatsoever to the Renter’s person or to his or her personal property is strictly limited to the amount of consideration paid by the Renter to the Owner for the rental of the Property.

22. Personal Property

The Guest acknowledges and agrees that the Owner assumes no responsibility for any of the Guest’s personal property used or placed in or about the Property, and any damage to or loss of such personal property is the sole responsibility of the Guest.

23. General

(1) This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements in regard thereto, whether written or oral.

(2) This Agreement shall be construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

(3) This Agreement shall not be amended, changed, modified or discharged other than by in writing, signed by both parties.

(4) If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, that provision only is to be deleted from this Agreement, and the other provisions shall remain in force and effect and are valid and enforceable to the fullest extent permitted by law.

(5) This Agreement may be executed in any number of counterparts, by original or electronic signature, each of which shall be deemed to be an original and all of which when taken together shall be deemed to constitute one and the same instrument.
