Onewheel Demo Release and Waiver of Liability Agreement

PLEASE READ THE FOLLOWING CAREFULLY BEFORE SIGNING.

In consideration of my willingness to participate in a “Onewheel Demo” as provided by The Ski Shack Enterprises Inc., hereinafter “Ski Shack”, along with its partners and affiliates, I hereby acknowledge and agree to the following Onewheel Demo Release and Waiver of Liability Agreement (the “Agreement”) on behalf of myself and any minor for whom I am acting:

I am an adult age 18 years or older voluntarily registering myself as a participant in the Onewheel Demo; or I am the parent/legal guardian acting on behalf of and registering a minor between the ages of 14 and 17 who wishes to participate in this Onewheel Demo and that I have the legal authority to act and consent on his/her behalf.

I understand that voluntarily participating in this Onewheel Demo may be considered a hazardous activity which can result in injury or even death. I attest that I am physically capable and properly trained to participate in this Onewheel Demo and am not under the influence of drugs or alcohol. I understand that wrist guards and a helmet are provided for my use. I understand that Ski Shack does not provide knee pads, elbow pads, or any other safety gear. If I feel that I need any other safety gear/ equipment (such as knee pads or elbow pads) it is my responsibility to provide my own.

I understand that all product provided during the Onewheel Demo is issued in AS IS condition and I accept full responsibility for the care of the equipment during the Onewheel Demo. I assume all responsibility for any and all damages to or the theft of Onewheel Demo products, personal property, or any bodily injury (including death) that may occur to me (or the minor) as well as any property damage and bodily injury (including death) that I (or the minor) may cause to others, in each case arising or resulting from, incident from, incident to, or as a consequence of, participation in the Onewheel Demo presented by Ski Shack.

I ACKNOWLEDGE THAT BY SIGNING THIS DOCUMENT I AM RELEASING THE SKI SHACK ENTERPRISES, INC. DBA SKI SHACK AND THEIR RESPECTIVE AGENTS, EMPLOYEES, MEMBERS, SPONSORS, PROMOTERS, AND AFFILIATES (COLLECTIVELY “RELEASEES”) FROM ANY AND ALL LIABILITY, REGARDLESS OF ANY NEGLIGENCE, INCLUDING BREACH OF CONTRACT ON THE PART OF THE “RELEASEES” IN THE DESIGN, MANUFACTURE, SELECTION, INSTALLATION, MAINTENANCE OR ADJUSTMENT OF THE EQUIPMENT USED IN THIS ONEWHEEL DEMO.

I acknowledge that I (and the minor) are aware of and fully understand and agree to abide by all of the rules, safety guidelines, and requests that are made available at the Onewheel Demo and agree to (and will ensure that the minor will) follow all rules, safety guidelines, and requests as set forth by Ski Shack.

If any part of this Agreement shall be held invalid or unenforceable, such term or condition shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

I attest that I have had carefully read and fully understand this entire document and am signing of my own free will, intending to be legally bound. I understand that by signing this Agreement I am giving up important legal rights.
