CANOE, KAYAK, PADDLEBOARD & OTHER EQUIPMENT RENTAL AGREEMENT AND RELEASE OF LIABILITY, ASUMPTION OF RISK AND INDEMNITY

This CANOE, KAYAK, PADDLEBOARD & OTHER EQUIPMENT RENTAL AGREEMENT AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY ("Agreement") is entered into by the undersigned for the benefit of Summit Aviation, LLC ("Summit") 

In consideration of the use of the property, facilities and/or services of Summit, the undersigned acknowledges and agrees as follows: 

WARNING. There are significant elements of risk in any adventure sport or activity associated with the use or presence of water craft, including but not limited to canoes, kayak, paddleboards and rafts, and the use of related equipment and hiking or other on-shore activities related thereto (herein "Paddlesport Activities"). These risks are inherent in such Paddlesport Activities and may be present even if the equipment is used properly and even in still water. 

SCOPE OF RELEASE. This release of liability covers all activities indirectly or directly associated with the use of Summit equipment, facilities, services, and activities organized by, sponsored by or directed by Summit. 

RISK FACTORS. The undersigned understands and acknowledges that the Paddlesport Activities involve risks such as, but not limited to, the following: (i) changing water flow, conditions or current; (ii) other water craft, manmade or natual objects, including overhanging, submerged and/or semisubmerged trees, branches, rocks and boulders; (iii) cold weather and heat related injuries and illnesses including hypertermia, frostbite, heat exhaustion, sun stroke, and dehydration; (iv) invlement weather, variances and extremes of wind, weather and temperature, the presence of insects and animals; (v) sense of balance, phyiscal coordination, ability to swim, and/or ability to follow directions; (vi) loss of control of the craft, collision, capsizing, and sinking of the craft which can result in wetness, inhury, exposure to the elements, hypothermia and drowning; (vii) getting in and out of the craft; (viii) travel, including hiking, portaging, and travel to and from the related and unrelated activities; (ix) the presence of wild animals, including marine lif forms, (x) unavailibily of emergency aid services and emergency medical care. The undersigned acknowledges that such Paddlesport Activies, as well as other foreseeable or unforseeable factors or circumstances, may result in a RISK OF PROPERTY DAMAGE, BODILY INJURY, AND POSSIBLY DEATH. 

ASSUMPTION OF RISK. By executing this Agreement, the undersigned expressly assumes all risk that arise from the participation in Paddlesport Activities, the acts of others, the unavailability of emergency care, and any other forseeable or unforseebale factrs or wrongful death or property damage related to the Paddlesport Acitivites. 

ACKNOWLEDGMENT OF RULES, POLICIES AND PROCEDURES. The undersigned acknowledges that he or she has read and understood all the rules, policies and procedures relating to Paddlesport Activities and understands that the safe and proper use of the facilities, equipment and participation in Paddlesport Activites and understands that the safe and proper use of the facilities, equipment and participation in Paddlesport Activities is dependent upon carefully following such rules, policies and prodecures. The undersigned agrees to comply with laws and Summit rules reguarding wearing a properly fitted and fastened U.S. Coastguard approved floation decivce.

INSURANCE.  The undersigned understands that Summit does not carry participant insurance. The undersigned acknowledges that they either have appropriate insurance or, in its absence, agree to pay all cost of rescue and/or medical services as may be incurred on their behalf. 

RESPONSIBILTY OF MINORS. The undersigned certifies that the undersigned is at least 18 years of age and fully capable of participating in this activity. Therefore, the undersigned assumes and accepts full responsibility for the undersigned, including all minor children in the undersigned's care, custody or control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risk and dangers not specifically identified, and as a result of the undersigned's negligence in participating in this activity. With respect to any minor children of the undersigned, the underisnged signs as parent or legal guardian of such minor children. 

INFORMING GROUP PARTICIPANTS. The undersigned also certifies that prior to undertaking the activity, the underigned will inform all participating members of the undersigned's group of the full contents of this risk agreement, including but not limited to the inherent risk of participating in a Paddlesport Activity on the Bentonville Lake, as well as the personal responsibilities of each participant, and that damages to rented equipment can result in additional personal cost. 

ACKNOWLEDGMENT. The undersigned has carefully read and understands this Agreement and realizes it relates to surrendering valueable leagal rights and assuming important legal responsibilities and does so freely and voluntarily. The undersigned has carefully read, clearly understood and accepted the terms and conditions stated herein and acknowledges that this Agreement will be effective and binding upon the undersigned, the undersigned's heirs, assigns, personal representative and estate, and for all members of the undersigned's family, including minor children.
