Stratton Adventures Liability Release Waiver

Operator/Passenger (parent or legal guardian if minor) hereby represents and certifies that the operator is at least 16 years of age with a valid driver license. Operator/Passenger understands that the improper operation or use of ATV/UTVs, such as the failure to observe and obey all laws and safety briefing rules may pose a risk of serious injury to the operator and or passenger of such ATV/UTV. Although operator/passenger is aware of the possible risks incident to operating such ATV/UTV, operator/passenger wishes to rent the ATV/UTV for a guided tour. Operator/passenger voluntarily requests a rental tour and agrees to assume the entire risk/any all accidents or personal injury, including death. Operator/passenger participates in the rental tour knowing the existing weather conditions and factors, which might affect the rental tour. Operator, in consideration of the opportunity to rent the ATV/UTV on behalf of operator and operator’s heirs, personal representatives, successors, and assigns, gives the following release, waiver and indemnity. Operator/passenger does hereby agree not to sue the tour operator, Stratton Adventures, LLC its owners, its employees and Stratton Corporation for injury, damages, or death, which occurs during or as a result of operator’s rental tour.

Operator forever releases and discharges releases, from any and all claims, demands, causes or action, or liability of any kind whatsoever, which operator/passenger may now or in the future have, known or unknown, which in any way result from or arise out of during the course of the rental tour. Operator/passenger further agrees to indemnify, defend and hold harmless from and against any claim to have or hold for injury, damages or death arising out of operator’s use or operation of the ATV/UTV while participating in the rental tour, even if caused in whole or part by the released parties. This release and waiver extends to any and all claims the operator/passenger may have, specifically including, but not limited to claims with respect to the design, manufacture, repair, or maintenance of the ATV/UTV which operator/passenger will be riding, or with respect to the conditions, qualifications, instructions, rules, or procedures under which the rental tour is conducted, or for any other cause. I hereby agree to accept and freely assume all the risks that are inherent in the use and operation of the rental of a ATV/UTV and I, for myself, for my heirs, and assigns, waive all rights and claims against Stratton Adventures ATV/UTV, LLC and Stratton Corp arising from or by reason for any injury resulting from any accident which may result by the use and operation of or any activities in connection therewith whether by negligence or not. That said operator assumes any and all liability for damages to the ATV during the rental period. “Optional damage waiver with deductible is available”.

I HEREBY AGREE TO ACCEPT AND FREELY ASSUME ALL FINANCIAL OBLIGATIONS FOR ANY DAMAGE TO THE ATV/UTV AND AGREE TO IMMEDIATE FINANCIAL RESTITUTION TO STRATTON ADVENTURES. THIS WAIVER STATES THAT HE/SHE HAS CAREFULLY READ THE FOREGOING RELEASE AND KNOWS THE CONTENTS THEREOF AND SIGNS THIS RELEASE AS HIS/HER OWN FREE ACT. ANY DAMAGE WILL BE CHARGED TO THE CREDIT CARD ON FILE VIA BROWN ENTERPRISES, INC, SOUTH LONDONDERRY, VT. I will use a helmet correctly at all times when operating the ATV/UTV and all passengers will also wear their helmets. I will respect the rights of all ATV/UTV operators/passengers and hikers while in control of the ATV/UTV. I agree that I will not be refunded due to my inability to begin/finish my ATV/UTV rental agreement. I hereby waive my rights to dispute charges within my original reservation/rental agreement. IN WITNESS WHEREOF, RELEASER HAS EXECUTED THE RELEASE AT STRATTON, VT. OPERATOR/PASSENGER (PARENT OR LEAGAL GUARDIAN IF MINOR) HAS READ AND VOLUNTARILY SIGNS THIS RELEASE AND WAIVER AND FURTHER AGREES THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTS APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE.
