AMERICAN CANOE ASSOCIATION WAIVER & RELEASE OF LIABILITY PLEASE READ COMPLETELY BEFORE SIGNING IN CONSIDERATION of being permitted to enter upon the grounds of the American Canoe Association Camp at Lake Sebago in Harriman State Park (“the Camp”) and to be present therein, and to participate in any way in the activities, sports and recreation activities, whether on land or water, including swimming, hiking, boating and social, together labeled as “Activities” to be held at the Camp I, for myself, my minor children and those minor children I have brought into Camp and therefore serve as guardian for (Accompanied Minors), as well as their personal representatives, assigns, heirs, and next of kin: ACKNOWLEDGE, agree, and represent that I understand the nature of paddlesports and the natural environment of the Camp, and the Activities to be conducted at the Camp, and that I, and my Accompanied Minors, am qualified, in good health, in proper physical condition to participate in such Activities we engage in and willingly agree to comply with the stated and customary terms and conditions of participation. I further agree and warrant that if at any time I believe conditions to be unsafe at any time and place in the Camp for myself and my Accompanied Minors, I will immediately discontinue my and their further participation in the Activity and presence in the Camp. If I decide to leave early and not complete the Activity as planned, I assume all risks inherent in my decision to leave. I assume full responsibility for my Accompanied Minors and agree to be responsible for supervision of my Accompanied Minors while on the premises of the Camp and participating in any Activity.
I FULLY UNDERSTAND that: a) Paddlesports and the Activities to be experienced at the Camp involve risks including presence in the natural environment of the Camp, and dangers of damage to personal property and serious bodily injury, including permanent disability, paralysis, and death ("risks"); b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or the negligence of the "releasees" named below; c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES for myself and my Accompanied Minors incurred as a result of my participation or that of the Accompanied Minors in the Activity, or their presence in the Camp. I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE the American Canoe Association, Inc., its Paddle America Clubs, the Camp Committee at the Camp and the ACA Atlantic Division, its affiliated clubs and organizational affiliates, their respective ACA-certified instructors, certified instructor trainers, and certified instructor trainer educators, administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "releasees" herein) from all liability, claims, demands, losses, injuries, damage to property, or other damages on my account caused or alleged to be caused in whole or in part by any action including the negligence of the "releasees" or otherwise, including negligent rescue operations; and I further agree for myself and Accompanied Minors that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement I and my Accompanied Minors, or anyone on their behalf, makes a claim against any of the Releasees, I will indemnify, save and hold harmless each of the releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim. I have read this agreement, fully understand its terms, understand that I have given up substantial rights for myself and Accompanied Minors by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
Paddler's Pledge: Clean, Drain and Dry – Keep Our Lake Free of Aquatic Invasives All paddlers who bring their own boats to the ACA Camp must Clean, Drain, and Dry them before putting them into Lake Sebago. All paddlers who keep their boats stored at the lake, and only use them on Lake Sebago, must also take steps to stop the spread of invasive organisms. Scientists have recently found AIS (Aquatic Invasive Species) in Lake Sebago. Some of these organisms spread through fragmentation, which means if a small piece of this plant breaks off and attaches to your boat or paddle – and then you put your craft back into the water – you will spread them more widely, to new parts of the lake. What exactly do we mean by “Clean, Drain and Dry”? Inspection points: Paddles, hatches, hull/boat bottom, rudder/keel. Clean: Always inspect your boat for AIS before and after every paddle. Remove mud, plants and organisms from your boat and gear. AIS can reproduce from tiny fragments, so dispose of what you find in a trash container or on dry land – not back into the water. Drain: Always drain all water from your boat, gear and any other equipment. Do this before you bring your boat to any other waterway – FROM Lake Sebago or TO Lake Sebago, and any other change of paddling venue. Dry: Always dry your boat completely before using it in Lake Sebago, especially if your last paddle occurred on a different waterway. Use of the Swimming Facilities at the ACA Camp at Lake Sebago: THE SWIMMING FACILITIES AT the ACA Camp SB2 on Lake Sebago are not always supervised by a lifeguard or other responsible person. At any time that a lifeguard is not on duty, in place of on-site supervision, this facility has established a series of safeguards to be followed by all guests. We are required to notify you of these rules, to ensure that water rescue equipment is at the beachside and that the swimming area is maintained in a sanitary manner. In the interest of your safety and that of your guests, we require you to follow these rules. Please read the safety rules located at the entrance and outlined in this document. If you have any questions, we will be happy to discuss them with you. - NEVER SWIM ALONE. A minimum of two adults 18 years of age or older, must be present whenever this swimming facility is in use, with at least one adult on the swim dock.
- THERE IS NO SUBSTITUTE FOR ADEQUATE SUPERVISION. Children under 18 years of age must be accompanied to the bathing facility by a parent or guardian, or similar adult responsible for their safety and behavior.
- IN AN EMERGENCY, NOTIFY THE CAMP DIRECTOR AND CONTACT HELP IMMEDIATELY. A free telephone is provided at this facility. It is located in the top right cubby on the swim area dock. Dial 911 in the case of an emergency.
- Only use this facility during posted hours of operation and swim only in the designated bathing area.
- Don’t drink alcohol and swim.
Injuries can be prevented and safety is everyone’s responsibility. If you notice any problems with the water quality or the absence of safety equipment, please notify the camp director or lifeguard. YOUR SAFETY IS IMPORTANT TO US. HAVE A SAFE & ENJOYABLE STAY. After you have read this brochure, please sign below. Only guests of this facility who have received and read this brochure may use the bathing area. I have read and understand the bathing safety rules at this facility. I understand that at times there will be no lifeguard on duty at this facility. I will abide by the rules listed above.
