Waiver and Release of Liability

READ THIS ENTIRE DOCUMENT BEFORE SIGNING

I, the undersigned, acknowledge the inherent risks involved in roller skating and all related activities, including being a spectator. Risks include (without limitation) the following: losses, injuries, disabilities, damages or death that result from or involve collisions or incidental contact with other skaters or spectators; slips, trips or falls caused by loss of balance or change in floor surfaces; collisions or incidental contact with objects or artificial structures within the building; and catching/spreading a virus, including (with out limitation) the novel corona virus. Accordingly, in consideration of being allowed to participate in skating activities and/or other activities at Skate Rock City Skating Center ("Skating Center"), I agree to all of the following:

On behalf of myself and/or my children, I hereby expressly release and forever waive any and all claims, actions, causes of action, demands, rights, damages, costs, attorney's fees, losses and expenses which I or my child may have against Michigan Skating, LLC (d/b/a Skate Rock City-Skating Center), and all of its respective agents, affiliates, associates, officers, directors, owners, and employees (collectively "Releasees") to any of the above for accident, personal injury, disability, death, property damage, or loss of any kind or nature suffered by me or my child as a result of or arising from our participation in this activity and all other activities at the premises located at 4680 Boulder Highway, Las Vegas, NV 89121 (the "Premises"), and I hereby indemnify, defend and hold the Releasees harmless from the same. Further, I understand that the Releasees are not responsible for the consequences of their own NEGLIGENCE, that is, their failure to use reasonable care in any way. In addition to the above, I agree to indemnify Releasees from any and all third-party claims caused in whole or part by my actions or inactions.

My participation in all activities at the Premises is voluntary and I (and my child) desire to participate with full knowledge and understanding of the risks. I agree to inspect the facilities and equipment at the Premises before participation in any roller skating and other activity. I agree to behave in a respectful manner toward fellow patrons and all Skate Rock City-Skating Center employees and representatives. I further agree to follow the rules of Skate Rock City-Skating Center and the instructions, directions and commands communicated by its employees or posted on the premises. I also understand that Skate Rock City —Skating Center reserves the right to remove anyone (including me and my child) from the Premises at any time for any reason. I, for myself and/or my child, agree to assume all the foregoing risks and accept personal responsibility for myself and/or my child's own damages following such injury, permanent disability or death. This Waiver and Release of Liability is signed voluntarily of my own free will.

I agree that this Waiver and Release of Liability will be governed by the laws of the state of Nevada. If any portion of this Waiver and Release of Liability is found to be void or unenforceable, then all other portions thereof shall remain in full force and effect.

I have carefully read this Waiver and Release of Liability in its entirety and understand that it is a release of claims and a waiver of liability regarding my participation in this activity. I further understand that by signing below I have given up substantial rights. I warrant., represent, and agree that I have the full power and authority to enter into this Waiver and Release of Liability.


 General Rules and Guidelines

1.    Customers must follow all posted and verbal rules.

2.    Everyone renting skates must wear socks.

3.    Fast, reckless, tag playing or skating in an unsafe manner is not allowed.

4.    GUM is not allowed!

5.    If you are PREGNANT, have a SERIOUS medical condition or injury, you will not be allowed to skate.

6.    WE ARE NOT RESPONSIBLE FOR LOST/STOLEN ARTICLES (INCLUDES ARTICLES LEFT IN LOCKERS)

7.    MANAGEMENT reserves the right to refuse entrance to anyone for any reason

8.    No In & Out privileges or loitering around the building.

9.    No outside food or drinks are allowed to be brought in.

10. No REFUNDS!

11. Everyone who enters must pay the general admission.

12. We are NOT responsible for ACCIDENTS OR INJURIES!

13. SKATE AT YOUR OWN RISK!

14. We do not allow parents to carry small children while skating.

15. We do not allow SMOKING, E-CIGS/VAPING or ALCOHOL in our facility.

16. Wheelchairs, Strollers, Push toys, skateboards, scooters are not allowed during public skating sessions.
