RELEASE, INDEMNIFICATION AND ASSUMPTION OF RISK

The Undersigned, hereinafter referred to as the Participant, desires to participate axe throwing provided by Lang Business Ventures, LLC, d.b.a. Bullseye’s Axe Throwing, 4146 Burbank Road, Suite C, Wooster, Ohio 44691, hereinafter Business.

In consideration for and as a condition of being allowed to participate in said axe throwing, Participant hereby irrevocably agrees as follows:

1. Persons Permitted. Only persons who execute this Release shall be permitted to engage in axe throwing. No person under the influence of alcohol or other substance shall be permitted to engage in axe throwing. No person under the age of 8 shall be permitted to engage in axe throwing. If Participant is under the age of 18, this Release must also be signed by Participant’s Parent or Legal Guardian.

2. Assumption of Risk and Release. Participant hereby acknowledges that axe throwing is an extremely dangerous activity, that participation in axe throwing exposes Participant to serious and substantial hazards and risks of property damage, physical injury and/or death, and that Participant has been fully warned with regard to all such risks and hazards by Business. Participant further acknowledges that the risks are not restricted to only throwing but also include being in the general vicinity of axe throwing and being in any other area associated with axe throwing. Participant is fully aware that the participation in and presence within axe throwing activities will result in Participant’s exposure to substantial and serious hazards and risks of property damage, physical injury and/or death. Further, Participant hereby agrees to release Business, its heirs, successors, assigns, family members, invitees and agents from all claims for damage to persons or property, whether to the person or property of the Participant or of third persons, arising out of axe throwing or the presence of the Participant within the vicinity of axe throwing.

3. Indemnification. Participant agrees to indemnify and hold Business, its heirs, successors, assigns, family members, invitees and agents harmless from any and all claims, damages, injury, costs, fees, including reasonable attorney’s fees and costs for defense, for any and all injury to persons or property, whether to the person or property of the Participant or of third persons, arising out of axe throwing or the presence of the Participant on the Premises, or arising out of a violation of any of the terms of this Release.

THE UNDERSIGNED HAS READ AND FULLY UNDERSTANDS THIS RELEASE, ASSUMES THE RISK FOR ALL ACTIVITIES COVERED HEREUNDER, AND AGREES THAT BUSINESS SHALL NOT BE LIABLE TO THE PARTICIPANT FOR INJURIES, ALL AS SET FORTH ABOVE.
