WAIVER AND RELEASE FORM

Please note that once completed this document becomes effective immediately and will stay in effect until the end of this calendar year.

Newcastle Disc Golf Course is located at 2429 Golf Course Rd, Newcastle, ON, on the Newcastle Golf and Country Club property.

I, the undersigned, recognize that entering the Newcastle Golf and Country Club property and/or the disc golf course on the property includes exposure to potentially harmful hazards including, but not limited to: i) uneven tee pads, ii) sharp branches and sticks on the ground and on the trees, iii) uneven, slippery and varied terrain, iv) uneven, slippery bridges and walkways that should be inspected prior to using and, v) golf balls hit by ball golfers.

I understand that as a condition of using or visiting the property, I fully and completely release and discharge Newcastle Golf and Country club, its owner Blaise Pucci, his employees, agents, sponsors, contractors and Newcastle Disc Golf Inc (Kevin MacLeod, Catherine MacLeod, Tanya Ramsay and Chris Beatty (henceforth known as the Indemnitees) from any and all liability and obligation of any kind or nature for injury to or death to me or any family members I bring with me, or for loss or damage to my property arising during, in connection with or in any way related to my use of the property and/or participation in any events from any cause whatsoever, INCLUDING THE NEGLIGENCE OF THE INDEMNITEES, OR ANY OF THEM. Further, I agree to INDEMNIFY and hold the Indemnitees, and each of them, harmless from any and all liability or obligation of any kind or nature for injury to or death of any person or damage to any property caused by me, or in any way related to or in connection with my use of the property or participation in any event, including, but in no way limited to, damage to the property of the Indemnitees.

The release and indemnity set forth in this document (a) shall be binding on me, and person or entity claiming by, through, or under me, my heirs, executors, administrators, legal and personal representatives, successors and assigns; and (b) shall inure to the benefit of the Indemnitees, their heirs, executors, administrators, legal and personal representatives, successors and Assigns. Further, I understand and agree that I am and will be responsible for acts of any minors (12+) admitted to the property and/or event with me or over whom I have control. If I am the parent or legal guardian of any minors present at the property and/or event, the release set forth above is also given for such minor in my capacity as the parent or legal guardian of such minor, and the indemnity set forth above shall extend to any injury, death, or damage caused by such minor.

RECOGNITION OF RISK; The participant expressly acknowledges that being a physical participant in disc golf is an activity with inherent risks of injury to persons and property; they are also aware of those risks and understand them. The admitted participant alone has determined the sufficiency of any safety gear or other precautions that the admitted participant decides to take to minimize the risks of the activity. No party related to Newcastle Disc Golf Club and Newcastle Golf and Country Club, including Owner and employees, has made any representations regarding the safety of, or the risks of, the activity. The admitted participant expressly assumes the risks of the activity.

Newcastle Golf and Country Club and Disc Golf Course Rules

  • Obey all golf marshals and course rules as posted at the golf course.
  • Do not bring any alcohol nto the property.
  • Do not smoke while on the property. The risk of fire hazard is simply too great.  
  • Do not vend/sell any products without the permission of the Newcastle Golf and Country Club.
  • No littering. Pack in and Pack out or dispose of them in the appropriate containers at the clubhouse or in the containers provided along the regular golf course.
  • Do not bring dogs on the property.
  • Ensure that all your group members abide by all rules.
  • Stay on the disc golf course and the clubhouse areas of the property.
  • Do not, for any reason, go onto a creek or pond that has ice on it.

I have read the above rules and and I acknowledge that I will follow all of them.

I understand this waiver will remain in effect from the date below, at any time that I am on the Newcastle Golf and Country Club property including the disc golf course or clubhouse.

I understand that this course is in the forest and so there is a risk of getting ticks and poison Ivy. For these reasons it is recommended that players use bug spray with Deet and wear long pants that are tucked into their socks.

I understand that the disc golf course is on a private golf course and for insurance reasons children under 12 cannot be on the course and children aged 12-17 must be accompanied by an adult.
