Covid Waiver / Release Of Liability / Hold Harmless Agreement

COVID WAIVER

COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact.  Your signature will be required as a confirmation of your intent and commitment to abide by current CDC and state and local Covid-19 policies and is a condition of participation and in consideration of the services provided by Compass Outdoor Adventures. 


ASSUMPTION OF RISK AND HOLD HARMLESS: Participant voluntarily agrees to assume all of the foregoing risks and accept sole responsibility for any expense, liability, illness, injury, disability or death related to contracting the COVID virus while attending the event and releases, discharges, covenants not to sue, and holds harmless Compass Outdoor Adventures from any and all claims related in any way to COVID-19 and the event. Participant understands and agrees that this release of liability includes any claims including any claims based on the actions, omissions, or negligence of Compass Outdoor Adventures, volunteers, and other event participants whether a COVID-19 infection occurrence exists before, during, or after attendance and participation at the event. 


MINOR CHILD: If participant is a minor child under the age of eighteen years, said person’s adult parent(s) or legal guardian(s) shall be jointly and severally liable for the participant at this event and attest that they have full authority to enter into this COVID waiver and release of liability form on behalf of such minor. 


RELEASE OF LIABILITY


RELEASE AND HOLD HARMLESS AGREEMENT: Participant acknowledges that while attending Compass Outdoor Adventures programs you may be exposed to certain risks of physical injury, and agree to assume the full risk of any injuries, including death, damages or loss which may occur as a result of participating, in any manner, in any and all activities connected with or associated with such program.


Participant agrees to waive and relinquish any and all claims that may arise as a result of my participating in the programs against Compass Outdoor Adventures, any and all independent contractors, officers, agents, employees and any and all other persons, and entities, of whatever nature, that might be directly or indirectly liable for any injuries sustained while participating in the program. (The parties described in the preceding sentence are referred to as "released parties" in the remainder of the Agreement.)


By signing this document, you hereby fully release and discharge the released parties from any and all claims for injuries, including death, damage or loss, which may have occurred due to participation in Compass Outdoor Adventures programs. You also agree to indemnify, hold harmless and defend Compass Outdoor Adventures, and any and all other released parties, from any and all claims resulting from injuries, including death, damages or losses sustained by anyone, and arising out of, connected with, or in any way associated with your participation in the program. I understand the nature of the program for which I am registering and have read and fully understand this RELEASE AND HOLD HARMLESS AGREEMENT.


PHOTO AUTHORIZATION:

I give permission to Compass Outdoor Adventures to take and retain the rights to photographs,

video or other likenesses of you while participating in your Compass Outdoor Adventures activities

for publicity and promotional purposes.


SEVERABILITY / ATTORNEYS FEES AND COSTS / APPLICABLE LAW: Should Compass Outdoor Adventures or anyone acting on their behalf incur attorneys’ fees and costs to enforce this Agreement, attendee further agrees the prevailing party shall be entitled to recovery of any such fees and costs. If any portion of this Agreement is deemed invalid or unenforceable, all other portions of this Agreement shall remain in full force and effect to the maximum extent allowed by law. This Agreement is governed exclusively by the laws of the State of Washington and the courts in King County. 


By signing this Agreement Participant is affirming that they have had sufficient opportunity to thoroughly read this document, and that they fully understand and agree to the terms set forth therein.
