("Execution Date") TODAY'S DATE: December 21, 2024 STATE ISSUED IDENTIFICATION OF LICENSEE 1. Limited License. This Limited License, Release, Waiver and Indemnity Agreement for Shooting Ranges Agreement, is made by Licensee in favor of Leadfeather Guns and Archery (LLC "Leadfeather") and grants to Licensee the limited right to enter onto the premises of the Leadfeather shooting ranges (individually the "Range" and collectively the "Ranges") and to use the Ranges for firearm and archery target practice solely in accordance with the rules and regulations of Leadfeather, and the terms of this Agreement. Any violation of the terms of this Agreement results in the immediate revocation of the license otherwise granted herein WITHOUT NOTICE whereupon Licensee shall no longer have any right to use or occupy the Ranges, and Licensee shall immediate,/ thereupon become an unlawful trespasser on the Ranges premises, and the Licensee shall immediately exit the Ranges premises or be removed by law enforcement as a trespasser This Agreement is effective as of the Execution Date indicated above and you are bound by the terms of this Agreement for this visit and for all subsequent visits at the Ranges unless and until this Agreement is superseded by another written agreement presented by Leadfeather to Licensee and executed and made by Licensee in favor of Leadfeather). 2. Terms of the License. The license granted under this Agreement is strictly conditional upon compliance with and consent to the terms of this Agreement. A. Range Rules, Licensee shall at all times abide by the following Range Rules. (1) Alcoholic beverages, drugs or persons who have been consuming or are Under the Influence of such Items are not allowed on the Ranges premises. Use of any tobacco products is prohibited. (2) Eye and hearing protection must be worn at all times while on the gun Range premise Eye and hearing protection is not a requirement for use of the archery Range premises (3)Tracers, explosive or armor piercing ammunition is prohibited. Black powder firearms are prohibited. Shotguns are allowed on the gun Range for use with buckshot or slug only. (4) Load and unload firearms only at the firing line and In the assigned lane. All weapons must be pointed down range at all times. (5) All firearms must be cleared and open when removed from the firing line. (6) No one is allowed beyond the firing line at any time under any circumstances. (7) Children under 21 years of age must be supervised at all times and under the direct and continuous control of their guardian. (8) Firearms and archery equipment may be inspected by the staff at any time while on the Leadfeather premises. (9) No more than two (2) persons are permitted at each firing station at anytime and only one (1) person may be firing or shooting at any given time. (10) If Licensee becomes aware of any problem while in the Range or has reason to suspect a violation of these rules or any unsafe conduct the Licensee will Immediately notify the Safety Range Officer or a staff member. (11) Only firearms and bows in good repair are allowed on the Ranges. (Licensee is responsible for the proper function of his weapon or archery equipment.) (12) Only factory produced ammo is allowed to be used on the gun range Hand or privately loaded ammo Is strictly prohibited. (13) Drawing and firing from a holster, shooting at objects on the floor, and rapid fire of more than one shot per second is prohibited. (14) Cell phone calls, text messaging and horseplay are prohibited. Licensee must at all times be attentive to the Range and the Range conditions. Licensee must at all times conduct himself in a responsible and prudent manner and exercise extraordinary care in handling any firearm and all Archery Shooting Devices (Long-bow, Recurve, Compound Bow, or Cross-Bow). (15) Licensee must follow and adhere to the posted rules for each specific Range, as they are specific to that specific Range. B. Covenants and Warranties. Licensee covenants and warrants each of the following as a continuing condition to use of the Ranges' premises. (1) Licensee is over the age of 21 , if not, is under the Supervision of the guardian described in Section 7 & below,) (2) Licensee is not under the Influence of alcohol or drugs, whether or not illegal, (3) Licensee is not subject to a restraining order or any other Judicial process pertaining to any act of violence, including domestic violence. (4) Licensee is not under any treatment for depression or any mental Illness. (5) Licensee is competent and knowledgeable in firearm and archery safety and can handle any weapon that the Licensee uses on the Ranges. (6) Licensee agrees to immediately bring to the attention of the Range Safety Officer or a staff member any conduct, act or omission in the Ranges by any person that is or may be in violation of the Range Rules or that creates or could foreseeably create a risk of injury to any person. (7) Licensee has no knowledge nor any reason to believe that the covenants and warranties stated herein are untrue with respect to any person in Licensee's party. (8) Licensee has read and understands the Disclosure of Risks stated below and assumes all such risk, (e) Licensee has read the Range Rules as stated in Section 2.A above and agrees to abide by them at all times. (10) The Covenants and Warranties are continuing throughout the term of this Agreement and are applicable to each visit to the Ranges. 3. Disclosure of Risks. Licensee acknowledges and assumes fully all risks associated with the use of or presence on the Ranges. Licensee acknowledges that shooting and handling firearms and archery equipment has inherent risks and that Licensee is familiar with those risks, which include, without limitation, malfunction of ammunition or firearms and the failure of others, including other licensee's to safely and properly handle firearms. Leadfeather does not examine the firearms, ammunition or archery equipment used by any licensee or any other person on the Ranges to determine the safety of such firearms, ammunition or archery equipment. Licensee acknowledges that Florida law does not allow Leadfeather to conduct background examinations on any person who uses the Ranges and that Leadfeather is not allowed by privacy taws to access medical records of anyone who uses the Ranges. Leadfeather requires that all persons who use the Ranges execute a copy of this Agreement and Leadfeather relies upon the statements in this Agreement to screen Individuals who have access to the Ranges. Leadfeather and Licensee acknowledge that it is possible that individuals may lie or make misrepresentations in completing this Agreement. Licensee has read and agreed to the Range Rules and the Covenants and Warranties stated herein and acknowledges that the failure of any person to abide by the Range Rules or the Covenants and Warranties herein creates a risk of harm to Licensee and others. Licensee acknowledges that Leadfeather maintains on the premises a Range Safety Officer to oversee the Ranges who is available for any questions, complaints or assistance to any Individual on the Ranges. Licensee agrees to promptly bring to the attention of the Range Safety Officer any condition on the Ranges or any other person on the Ranges that Licensee has reason to believe presents a threat or danger to the property of any person (Including Leadfeather) or to the body of any person. 4. Waiver, Release and Covenant Not to Sue. Licensee assumes full responsibility for any and all risks of injury, property damage, or death while on the Ranges. Licensee hereby releases and waives any and all claims including, without limitation, death, bodily injury and property damage (collectively referred to as "Claims") that Licensee has or may have against Leadfeather, its owners, officers, agents, employees, members and affiliates (collectively, the " Released Parties ") in connection with use by or presence of Licensee or any other person on the Ranges, the operation of the Ranges, or arising out of or related to any act or omission of any one or more of the Released Parties, and Licensee further covenants not to sue or maintain any legal or administrative action whatsoever against any one or more of the Released Parties in connection with any such act or omission. I have read this Agreement and understand that I have given up substantial rights by signing it and have signed it freely and without any Inducement and assurance of any nature and Intend It to be a complete and unconditional release of all liability to the greatest extent allowed by law. 5. Indemnity Licensee shall indemnify, hold harmless and defend Leadfeather, its owners, officers, agents, employees, members and affiliates (collectively, the "Indemnified Parties') against any and all costs, liability, expense or damage, including attorney fees and the costs of enforcing this indemnity, incurred by any one or more of the Indemnified Parties arising out of or related to breach of the terms of the Agreement by Licensee, including but not limited to, violation of the Range Rules or the Covenants and Warranties, the negligence, gross negligence, recklessness or intentional wrongdoing of Licensee or of any minor who is under the supervision or control of the Licensee. All such indemnities shall be made on demand of any one or more of the Indemnified Parties. 6. Miscellaneous: This Agreement is binding on Licensee, his heirs, his assigns and representatives. Licensee expressly agrees to the Waiver, Release and Covenant Not to Sue and the Indemnity provisions of this Agreement are intended to be as broad and inclusive is permitted by the law of the State of Florida, and if any portion thereof or otherwise of this Agreement is determined to be invalid such portion or determination of invalidity shall not affect the remainder of this Agreement. Licensee has carefully read and understands this Agreement. Licensee acknowledges that Licensee is competent and that all Covenants and Warranties and other declarations made herein are true and correct. Whenever used in this Agreement, the singular shall include the plural and the plural shall include the singular. The use of any gender shall include all genders as the context so requires. The section headings are inserted for convenience only and are in no way intended to describe, interpret, define or limit the scope or content of this Agreement or any provision thereof. This Agreement binds Licensee, Guardian (as applicable), and his executors, administrators, heirs. An executed copy of this Agreement transmitted, scanned or stored electronically (e.g., via facsimile or e-mail, including in a "pdf" format) shall be deemed to be an original and shall be effective for all purposes, 7. Minor. If Licensee is a minor the undersigned Guardian represents and warrants to Leadfeather that he has the authority to execute this Agreement on behalf of the minor, and the undersigned Guardian personally undertakes responsibility for and guarantees compliance with this Agreement (including, but not limited to, all indemnities under Section 5) on behalf of such minor Licensee. 8. Guardian of Minor. If Licensee is a minor, the undersigned Guardian certifies that he is the legally authorized guardian of Licensee, a minor, and warrants to Leadfeather that he has authority to execute this Agreement on behalf of the minor Licensee. The undersigned Guardian personally guarantees and assumes responsibility for minor Licensee's compliance with this Agreement and further personally assumes and guarantees the Indemnity under Section 5 and the Waiver, Release and Covenant Not to Sue under Section 4 with respect to any cost, liability, expense damage or claim whatsoever against Leadfeather, arising out of or related to the use or the presence of the minor Licensee on the Ranges. 9. Images. During the course of visiting the Ranges, Licensee acknowledges that Licensee's image may be captured by closed circuit television and possibly by attendees or staff taking photographs or videos of activities. Any such images or photographs may be used for promotional purposes and Licensee releases his likeness to be used by Leadfeather without further consent. BY SIGNING THE LIMITED LICENSE, RELEASE, WAIVER AND INDEMNITY AGREEMENT FOR SHOOTING RANGES.
