Volunteer Waiver, Acknowledgement, and Release


Thank you for volunteering your time and energy to assist Ningaloo Whaleshark Swim’s crew to deliver our tours. There’s a few things we need you to know and agree to before you can start your Volunteer program. Please read this entire document carefully before signing as this is a legal document that affects your rights. All volunteers must accept these conditions to board our vessel to ensure you are covered by our insurance policies.

  • I acknowledge that volunteering onboard the tour vessel 'Seazone' will be a strenuous activity. In my judgement I have sufficient competence, experience, and I am physically able to volunteer in the agreed position in a manner safe to myself and others.
  • I acknowledge that I will be spending extended periods of time at sea and need to take responsibility for any seasickness medication necessary
  • I release and hold harmless, Ningaloo Whaleshark Swim, Department of Biodiversity Conservations and Attractions, and all employees, owners, Directors and stakeholders involved in the operations of Ningaloo Whaleshark Swim, from any and all liability for death, injury, property theft and other loss or injury whatever and however, occurring which I may suffer as a result of, or in connection with my volunteering for Ningaloo Whaleshark Swim.
  • I understand that the scope of my relationship with Ningaloo Whaleshark Swim is limited to a volunteer position and that no compensation is expected in return for services provided by myself. 
  • I acknowledge that to the maximum extent permitted by law Ningaloo Whaleshark Swim and all related parties and individuals are excluded from all liability to me, including negligence and whether my loss or damage has occurred to my person or my property. Where that liability cannot be excluded, the liability of Ningaloo Whaleshark Swim is limited to the maximum extent permitted by law.
  • I acknowledge that Ningaloo Whaleshark Swim shall not be responsible to me for any punitive, exemplary, incidental, special or consequential damages including, but without limitation, loss of profits, loss of revenue, loss or denial of opportunity, indirect/remote/abnormal or unforeseen loss, or any similar loss whether or not in the reasonable contemplation of Ningaloo Whaleshark Swim or me.
  • I understand that I cannot claim against Ningaloo Whaleshark Swim, its staff and volunteers, or any related organisation or individual, for any loss, damage or injury incurred as a direct or indirect result of volunteering on its tour program.
  • I agree to allow my photograph, video, multimedia or film likeness and or name to be used for any legitimate purpose by Ningaloo Whaleshark Swim or its assigns, without payment or compensation.
  • I further state that I am of lawful age (18 years or older) and legally competent to sign this acknowledgement, or that it has been signed for the Volunteer by their designated legal Guardian.
  • I understand that the terms herein are contractual, serious, not a mere recital and form the basis of the Agreement by which I participate; and that I have signed this document of my own free act.
  • I give my consent to receive any first aid and medical treatment which may be deemed advisable in the event of any accident, injury and/or illness as a result of my involvement in the tour program.
  • I acknowledge that I am responsible for my personal possessions and equipment before, during and after each Tour.
  • I acknowledge that the activities assigned to me as a volunteer may involve me being outdoors in the elements and that I should be prepared for all weather conditions and ensure I bring sufficient sun and rain protection. I acknowledge that I am fit and physically able to take on the volunteer role requirements and shift/s I have applied for.
  • I further acknowledge that I have been advised by the principals, servants and/or agents of Ningaloo Whaleshark Swim, of the risks associated with volunteering and to the extent permitted by law, I have voluntarily assumed those risks.
  • I acknowledge that Ningaloo Whaleshark Swim retains all intellectual property arising out of activities relating to the Tours I volunteer on, and that as a volunteer I am required to surrender any copyright material arising out of these activities to this company.
  • I further acknowledge that this document may be relied upon in any proceedings instituted in any Court by me or my heirs, executors and assigns.
  • I agree that at all times whilst volunteering for Ningaloo Whaleshark Swim I will act in a professional manner so as to uphold the principals and standards under which Ningaloo Whaleshark Swim works, and at no time will act in a way that is likely to bring Ningaloo Whaleshark Swim or its associates into disrepute. Similarly, I agree to uphold the ethics and standards of the company and shall not do anything to bring Ningaloo Whaleshark Swim or its staff or associates into disrepute.
  • I WAIVE, RELEASE AND DISCHARGE from any and all liability for death, disability, personal injury, property damage, property theft and all other risks, claims or actions of any kind (including breach of contract, acts of negligence to the fullest extent permitted by law) whatsoever and however occurring, together with any legal fees incurred as a result of any such claim whether it is valid or not, which I at any time had or have as a result of or in connection with, directly or indirectly, my volunteering in and my travelling to and from Ningaloo Whaleshark Swim’s operations, including the following person or entities:
  1. Ningaloo Whaleshark Swim Pty Ltd
  2. Ningaloo Reef Dreaming Pty Ltd
  3. Department of Biodiversity Conservations and Attractions and its Director, Director General: Matthew Winter and all crew and staff and volunteers of any of the above organisations and its agents, suppliers or customers, all community organisations, all State, Federal and Local Government authorities in which the Tours are run, and the owners, licensees or occupiers of any property upon which I enter and their (its) respective officers, directors, employees, independent contractors, sponsors, representatives, agents, members and participants, including medical and paramedical personnel.

1. You are a volunteer

The position of Volunteer at Ningaloo Whaleshark Swim is a volunteer position. This means that, if you accept the role, you perform all duties on a voluntary basis and you will not receive remuneration or payment for your work, other than reasonable reimbursement of expenses (see below at paragraph 9). Neither Ningaloo Whaleshark Swim or you (the individual signing this agreement) intend any employment or contractual relationship to be created (ie. you are not an employee, independent contractor or consultant at Ningaloo Whaleshark Swim). If this changes at any time, we will advise you of this in writing.

2. What you can expect when volunteering at Ningaloo Whaleshark Swim

Ningaloo Whaleshark Swim values its volunteers and we will endeavour to provide you with:

a) A written position description so you understand your role & the tasks you are authorised to do

b) A full induction, orientation and any training necessary for the volunteer role

c) A safe environment in which to perform your role

d) Respect for your privacy, including keeping your private information confidential

e) A supervisor, so that you have the opportunity to ask questions and get feedback (see para. 4 below)

f) Reimbursement for your reasonable expenses so you are not out-of-pocket as a result of volunteering for us (for further information see para. 8 below), and

g) Insurance to cover you for the volunteer duties you are authorised to perform (see para. 10.)

3. What Ningaloo Whaleshark Swim asks of its volunteers?

We ask that you to:

a) Support Ningaloo Whaleshark Swim aims and objectives

b) Participate in all relevant induction and training programs

c) Only undertake duties you are authorised to perform and always operate under the direction and supervision of nominated staff. Obey reasonable directions and instructions.

d) Understand and comply with the organisation’s policies and procedures

e) Immediately notify your supervisor or another member of staff if any health and safety issues or potentially hazardous situations arise that may pose a risk to you or others, and report any accidents or incidents relating to staff, volunteers, or the workplace.

f) Behave appropriately and courteously to all staff, clients and the public in the course of your role

g) Use any property or equipment given to you in your role safely & only for purpose of the role and return it to the organisation when you finish your volunteer role

h) Let us know if you wish to change the nature of your contribution (e.g. hours, role) to Ningaloo Whaleshark Swim at any time

i) Comply with the law at all times, and

j) Be open and honest in your dealings with us and let us know if we can improve our volunteer program and the support that you receive.

4. Contact person

Your contact person at Ningaloo Whaleshark Swim will be Jasmin O’Brien. If you have any questions or concerns about your role, your health and safety, or if there is any assistance you need to help you undertake your role, please contact Jas on 08 9949 4777 as soon as possible – please note that we are in Western Australia, the time zones vary between 2 and 3 hours behind the Eastern States.

5. Role description and details

You agree to assist our crew on our whaleshark tour from the start to the finish of the day, from Monday to Sunday on the week you are volunteering. This will involve you meeting at the Booking Office at Shop 4/1 Kennedy St at 6:20 each morning from Monday to Sunday. Most of our tours will have you returning to this same location around 4-6pm each day.  

Your role is to support the crew in the following tasks:

  • Preparing the tour assets (boat, tender, snorkel gear, etc) for the tour and cleaning this during and after the tour.
  • Assisting with catering for the cruise including preparation, lunch and morning and afternoon teas, drinks throughout the day, and cleaning up.
  • Assisting crew providing service to customers as they request this of you.

You are also welcome to socialise with customers throughout the day, in a manner that is both professional and very sensitive to their needs and wishes. If you are unsure whether a particular task or work is authorised, please do not hesitate to talk to your Volunteer Manager or the Skipper on any particular day. It is important that you only perform the tasks in this role description and that you follow the instructions of those crew members appointed to roles relating to your duties. 

It is critically important that you are not affected by drugs or alcohol when you are volunteering. Additionally, you are required to have at least six hours sleep before attending for your Volunteering duties each day.

6. The health and safety of you and others

At Ningaloo Whaleshark Swim volunteer safety, and the safety of everyone who is involved in our organisation, is a priority. Under the relevant WHS Acts and legislations, Ningaloo Whaleshark Swim has a duty of care to minimise risks to everyone affected by its conduct. It also means that as a volunteer, you may have OHS duties too. These include:

a) To take reasonable care for your own health and safety

b) To take reasonable care for the health and safety of others

c) To comply with any reasonable instruction by Ningaloo Whaleshark Swim

d) To let Ningaloo Whaleshark Swim know of any concerns you may have about safety and/or fitness in undertaking your role, and

e) To cooperate with any reasonable policies and procedures of Ningaloo Whaleshark Swim as advised to you by your Supervisor, or relevant crew member before, during or after your tour.

We will provide you with an induction and role training. Ningaloo Whaleshark Swim is committed to providing suitable training in support of our health and safety, discrimination and privacy policies.  

7. Return or Withholding of your $500 deposit (For Option One bookings)

Ningaloo Whaleshark Swim commits to refunding you $500 from the deposit you have paid to secure your position as a Volunteer. You will be refunded within 14 days of you completing your seven-day Volunteer position. This deposit shall not be reasonably withheld and will be refunded when you complete the seven day volunteer period agreed to by both parties OR Ningaloo Whaleshark Swim chooses to end the Volunteer agreement between the two parties before the end of the seven day period.

The deposit is not refunded to you if:

a) You don't turn up on the agreed date to start your Volunteer position 

b) You don't turn up to work each day during your Volunteering period looking clean, neat and professional and with a great attitude ready to work 

c) We need to ask you to leave due to poor attitude or unsafe behaviours, after we have raised issues of concern with you on at least two previous occasions.

If your deposit is not refunded, we will be donating this sum of money to Ecocean, one of the world's leading whaleshark research organisations.

8. Volunteer expenses and other benefits

As a volunteer, Ningaloo Whaleshark Swim will provide you with reimbursement for any reasonable out-of-pocket expenses that you incur when performing authorised tasks associated with your role.

We do this to ensure that you are not financially disadvantaged as a result of your volunteer position with us. These payments are not remuneration or wages. You will need prior approval from a relevant crew member and will always need to produce receipts.

We may provide you with other benefits as part of your volunteering role including whaleshark swim, Reef snorkel, Reef dive or Try SCUBA dive. Where this occurs, it is on a gratuitous basis at the discretion of Ningaloo Whaleshark Swim and is not payment in lieu of salary.

Whilst we commit to doing everything we reasonably can do provide the above benefits, Ningaloo Whaleshark Swim reserves the right to not provide one, two, three or all of the benefits offered if operational situations arise that make providing these benefits unsafe or impractical.

10. Insurance

We are committed to providing adequate insurance cover for volunteers whilst carrying out their volunteering roles that have been approved and authorised by us & have insurance covers for this.)

To ensure this insurance covers you for any incidents that occur while you are volunteering with us, you need to ensure you do not engage in unsafe practices, or practices that could reasonably be viewed as likely to be unsafe, report all incidents within 24 hours of them having occurred, and that you are recorded as boarding the vessel by the Skipper or Trip Leader.

We want to let you know that the following events are unlikely to be covered by our insurance:

a) Actions that are beyond the scope of your volunteer role, or that occur without appropriate authority or permission from us

b) Criminal activity (including criminal charges arising out of driving incidents)

c) Dishonest or reckless activities

11. Intellectual Property

All volunteers at Ningaloo Whaleshark Swim agree to transfer all intellectual property rights and interests (including copyright) in any ideas or materials they create relating to their provision of voluntary services at Ningaloo Whaleshark Swim to Ningaloo Whaleshark Swim. Volunteers are taken to consent to Ningaloo Whaleshark Swim use of such creations in a manner reasonably contemplated by the voluntary services provided under this document. As a volunteer you also agree not to bring any claim for infringement of your moral rights in respect of that use.

1) You agree to us have ongoing rights to use all footage taken by you during our tours, including all video and photos, for any purpose whatsoever, without the need to obtain permission from you for this (You retain the rights to use video and photos taken during our tour for your purposes.)

2) You will provide us with the opportunity to download all videos and photos taken by you during the tours you join us for after the final tour. (Please arrange this with our photographer onboard the vessel on this day.)

3) You agree to us having the right to require you to destroy any videos or photos taken on our tours at our absolute discretion. (We will require this solely for images that we deem may be damaging to our brand.)

4) You agree not to circulate any photos or videos, through any media whatsoever, that can reasonably be assumed to damage our brand in any way whatsoever.
