Upward Basketball Waiver & Photo Release

Simple Terms: by participating in a HRMC athletic event, you accept any risk of injury to you, your guests and to any minor children you bring to it. You agree not to hold HRMC liable for any injury or harm incurred as a result of your participation in this event.

Parties - This Waiver and Release is given by you to Huron River Methodist Church (“HRMC”), a Michigan entity. The terms “participant”, “user”, “guest” or “you” include you, your guests, and any minor children you bring into HRMC’s facilities.

Waiver and Photo Release - You hereby acknowledge that while exercise is encouraged to promote both physical and mental health, your attendance or participation in this event may result in injury. You further acknowledge it is impossible to eliminate the risk of injury, which may result from or arise out of your participation. You further acknowledge that you have the responsibility to help reduce the risk of injury to yourself while participating in the event.

You agree, on behalf of yourself and your heirs, executors, administrators, and assigns, to fully and forever waive, indemnify, hold harmless, release and discharge HRMC, its affiliates, operators, and all of their respective officers, employees, agents, successors, and assigns, from any and all claims, damages, demands, rights of action or causes of action, present or future, known or unknown, anticipated or unanticipated, resulting from or arising out of your participation in the event, whether or not based on the acts or omissions of the released parties. Further, you hereby agree or waive any and all such claims, damages, demands, rights or action or causes of action. You assume the sole responsibility for your personal property and the personal property of your guests and acknowledge and agree that HRMC shall not be responsible for any loss, theft, or damage to any personal property while participating in the event.

Further, you hereby release and forever discharge and hold harmless, HRMC, its affiliates, operators, and all of their respective officers, employees, agents, successors, and assigns, from any and all liability, claims and demands of whatever kind of nature either in law or in equity, which may arise or hereafter arise from all causes described herein.

By registering for and/or participating in this event, you acknowledge that you agree to the terms of this waiver and release and fully understand that it is a waiver and release of any and all liability.


Additionally, you hereby grant and authorize on behalf of the minor(s) listed below the right to take, edit, alter, copy, exhibit, publish, distribute, and make use of any and all pictures or video taken of Minor(s) to be used in and/or for any lawful promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits, and submissions to journalists, websites, social networking sites and other print and digital communications, without payment or any other consideration. 

This authorization extends to all languages, media, formats, and markets now known or later discovered.

This authorization shall continue indefinitely, unless you otherwise revoke this authorization in writing, or the Minor(s) revokes this authorization in writing upon reaching majority age.

You waive any right that you or the Minor(s) may have to inspect or approve any finished product in which Minor’s likeness appears, including written or electronic copy.
