The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021 (7) and 627.736, Florida Statutes 

Failure to return rented property or equipment upon expiration of the rental period and failure to pay all amounts due (including costs for damage to the property or equipment) are prima facie evidence of intent to defraud, punishable in accordance with ss.812.155, Florida Statutes.

By signing below, you agree to the terms and conditions of this Agreement, and you acknowledge that you have been given an opportunity to read this Agreement before being asked to sign. All Terrain Vehicle Rental Agreement Terms and Conctitions

1. Definitions. "Agreement' means all terms and conditions found in this form. "You" or "your" means the person identified as the renter on the reverse, any person signing this Agreement, any Authorized Driver and any person or organization to whom charges are billed by us at its or the renter's direction. All persons referred to as ''you" or "your" are jointly and severally bound by this Agreement. "We", "our' or "us" means the independent business named on the reverse side of this Agreement. "Authorized Driver" means the renter and any additional driver listed by us on this Agreement, provided that each such person has a valid all terrain vehicle drivers license and, is at least 25 years of age unless the age restriction is changed by us elsewhere in this Agreement. 'Vehicle" means the all terrain vehicle identified in this Agreement and any vehicle we substitute for it. and all its tires, tools, accessories, equipment, keys and vehicle documents. "CDW' means Collision Damage Waiver. "Physical Damage" means damage to, or loss of, the Vehicle caused by collision or upset; it does not include comprehensive damage, such as damage to, or loss of, the Vehicle due to theft, vandalism, act of nature, not or civil disturbance, hail, flood or fire. "Loss of use" means the loss of our ability to use the Vehicle for any purpose due to damage to it or loss of tt during this rental. Loss of use is calculated by multiplying the number of days from the date the Vehicle is damaged until it is repaired or replaced, times the daily rental rate. 

2. Rental, Indemnity and Warranties. This is a contract for the rental of the Vehicle. We may repossess the Vehicle at your expense without notice to you, if the Vehicle is abandoned or used in violation of law or this Agreement. You agree to indemnify us, defend us and hold us harmless from all claims, liability, costs and attorney fees we incur resulting from, or arising out of, this rental and your use of the Vehicle. We make no warranties, express, implied or apparent, regarding the Vehicle, no warranty of merchantability and no warranty that the Vehicle is fit for a particular purpose. 

3. Condition and Return of Vehicle. You must return the Vehicle to our rental office or other location we specify, on the date and time specified in this Agreement, and in the same condition that you received it, except for ordinary wear. If the Vehicle is returned after closing hours, you remain responsible for the loss of, and any damage to, the Vehicle until we inspect it upon our next opening for business, Service to the Vehicle or replacement of parts or accessories during the rental must have our prior approval. You must check and maintain all fluid levels.

4. Responsibility for Vehicle Damage or Loss; Reporting to Police. You are responsible for all damage to the Vehicle, including damage caused by weather, acts of god or terrain conditions. You are responsible for the cost of repair, or the actual cash retail value of the Vehicle on the date of the loss if the Vehicle is not repairable or if we elect not to repair it, whether or not you are at fault. You are responsible for theft of the Vehicle, loss of use, diminished value of the Vehicle caused by damage to it or repair of it, and a reasonable charge to cover our administrative expenses connected with any damage claim, whether or not you are at fault. You must report accidents or incidents of theft and vandalism to us and the police as soon as you discover them.

5. Collision Damage Waiver. If you purchase CDW, we will waive our right to collect from you for a portion of Physical Damage to the Vehicle. We will not waive this right If damage to the Vehicle: (a) is caused by anyone who is not an Authorized Driver, or by anyone whose driving license is suspended in any jurisdiction; (b) is caused by anyone under the influence of prescription or non-prescription drugs or alcohol; (c) is caused by anyone who obtained the Vehicle or extended the rental period by giving us false, fraudulent or misleading information; (d) occurs while the Vehicle is used in furtherance of any illegal purpose or under any circumstance that would constitute a violation of law, other than a minor traffic violation ; (e) occurs while pushing or towing anything, or in any race, speed test or contest, or while teaching anyone to drive the vehicle; (f) occurs while carrying dangerous or hazardous items or illegal materiel in or on the Vehicle; (g) occurs outside the geographic limitations indicated on the reverse; (h) occurs and the odometer has been tampered with or disconnected; (I) occurs when the Vehicle's fluid levels are low, or it is otherwise reasonable to expect you to know that further operation would damage the Vehicle; (j) is a result of your willful, wanton or reckless act; (k) occurs and you fail to summon the police to any Vehicle accident involving personal injury or property damage.

6. Insurance. You are responsible for all damage or loss you cause to others. You agree to provide liability, collision and comprehensive insurance covering you, us, and the Vehicle. Your insurance is primary to any insurance that we may provide. if we are required by law to provide liability insurance, we will provide a liability insurance policy (the "Policy") that is excess to any other available and collectible insurance whether primary, excess or contingent. The Policy will provide liability coverage with limits no higher than the minimum financial amounts required the law of the state whose laws apply to the loss. You and we reject PIP, medical payments, no-fault and uninsured and under-insured motorist coverage, where permitted by law.

7. Charges. You will pay us, or the appropriate government authorities, on demand all charges due us under this Agreement, including: (a) time and mileage for the period during that you keep the Vehicle, or a mileage charged based on our experience if the odometer is tampered with or disconnected; (b) charges for additional drivers; (c) optional products and services you purchased; (d) fuel, if you return the Vehicle with less fuel than when rented; (e) applicable taxes; (f) all parking, traffic and toll fines, penalties, forfeitures, court costs, towing, storage and impound charges and other expenses involving the Vehicle assessed against us or the Vehicle; if you fail to pay the charging authority for parking or toll violations, you agree to pay us for those charges, plus our administrative fee of $50 for each such violation; (g) all expenses we incur in locating and recovering the Vehicle if you fail to return it or if we elect to repossess the Vehicle under the terms of this Agreement; (h) all costs, including pre- and post-judgment attorney fees, we incur collecting payment from you or otherwise enforcing our rights under this Agreement; (i) a 2% per month late payment fee, or the maximum amount allowed by law (if less than 2%), on all amounts past due; (j) $50 or the maximum amount permitted by law, whichever is greater, if you pay us with a check returned unpaid for any reason; and (k) a reasonable fee not to exceed $150 to clean the Vehicle if returned substantially less clean than when rented.

8. Deposit. We may use your deposit to pay any amounts owed to us under this Agreement.

9. Your Property. You release us, our agents and employees from all claims for loss of, or damage to, your personal property or that of any other person, that we received, handled or stored, or that was left or carried in or on the Vehicle or in our offices, whether or not the loss or damage was caused by our negligence or was otherwise our responsibility.

10. Breach of Agreement. The acts listed in paragraph 5, above, are prohibited uses of the Vehicle and breaches of this Agreement. You waive all recourse against us for any criminal reports or prosecutions that we take against you that arise out of your breach of this Agreement.

11. Modifications. No term of this Agreement can be waived or modified except by a writing that we have signed. If you wish to extend the rental period, you must return the Vehicle to our rental office for inspection and written amendment by us of the due-in date. This Agreement constitutes the entire agreement between you and us. All prior representations and agreements between you and us regarding this rental are void.

12. Miscellaneous. A waiver by us of any breath of this Agreement is not a waiver of any additional breach or waiver of the performance of your obligations under this Agreement. Our acceptance of payment from you or our failure, refusal or neglect to exercise any of our rights under this Agreement does not constitute a waiver of any other provision of this Agreement. Unless prohibited by law, you release us from any liability for consequential, special or punitive damages in connection with this rental or the reservation of a vehicle. If any provision of this Agreement is deemed void or unenforceable. the remaining provisions are valid and enforceable.


Rules of the Road

∙ Low-Speed Vehicles (LSV’s) can be driven on any road with a posted speed limit of 25miles per hour (mph) or less.

∙ While on a public roadway, the operator can cross over a road with a posted speed limit of more than 25mph but must only travel on roadways with posted limits of 25mph or less on Major Streets that are not allowed to be driven on in Holmes Beach are:

  • Manatee Ave (SR64) & East Bay Drive 

​∙ LSV’s cannot be driven faster than 25mph.

∙ Each driver/operator must be 25 years of age.

∙ Each driver must carry a valid driver’s license and auto insurance coverage while operating the vehicle.

∙ No more than four passengers may ride on a 4-Passenger LSV and no more than six passengers may ride on a 6-passenger LSV.

∙ LSV’s must follow the same traffic laws as any motor vehicle (cars, trucks, motorcycles, etc). These laws include, but are not limited to:

  • All passengers must be seated and belted in at all times while operating the vehicle No standing or hanging from the vehicle is permitted.
  • Please keep arms and legs inside the vehicle at all times.
  • Car seats for children 5 & younger MUST be used while operating the vehicle
  • ​Drivers must use directional or hand signals when making turns.
  • Drivers must follow all regulatory signs o LSV’s are not permitted to travel on sidewalks or bicycle lanes
  • Headlights should be used 30 minutes before sunset and 30 minutes after sunrise and should always be used in inclement weather.

​∙ The operator of these vehicles can be issued a traffic citation for any violation of traffic laws. These citations carry fines and points on your license.

∙ Any parking citation and/or fine issued will be up to the renter to pay. This will be added to any credit card placed on file for the rental of the vehicle.

∙ Renter assumes responsibility for vehicles and drivers while in their possession.

Fun and More Rentals Refund Policies for LSV’s

If reservation is cancelled within 24 hours of the reservation date we will provide a full refund. If you cancel your reservation and your golf cart has already been delivered we will keep a $50 plus tax cancellation fee.

∙ No refunds will be issued due to inclement weather, change of weather, or preference.

PARKING RULES ON ANNA MARIA ISLAND

Parking violations include, but are not limited to:

1. Signs Prohibit Parking

2. Parking on sidewalk

3. Parking on street (all tires must be off of the pavement)

4. Parked facing the wrong direction

5. Angle Parking

6. Parked within 30' of stop sign

7. Parked within 20' of intersection

8. Double Parked

9. Blocking Driveway

10. Parked between 10 p.m. - 6 a.m.

11. Other parking violations not specifically listed above

12. Handicapped parking only

*All state laws for driving apply to driving the LSV (Low-Speed Vehicle)

*Driving on the beaches, bicycle lanes, and sidewalks are Prohibited.

If a parking ticket is not paid, an invoice is sent to us here, at Fun and More Rentals. You are still responsible for paying the parking ticket. The amount of what is present on the invoice we receive will be charged to your credit card we have on file for you and a copy of the ticket will be sent to you via email as proof of payment.
