Firing Range Waiver of Liability 

In consideration of the privilege of being present at and shooting firearms on the Midwest Shooting Center Firing Range, I hereby release and discharge Midwest Shooting Center, LLC., its affiliated companies, and its directors, shareholders, officers, employees, agents, and other representatives (collectively, the “Released Parties”) from all liability and any other obligation that may result from any property damage or bodily injury, including death, that I may suffer as a result of my presence at or activities on the Firing Range. I intend the foregoing release to be a complete and comprehensive waiver of liability for any damage or injury that I may suffer while present in the Midwest Shooting Center Facility, whether caused by any of the Released Parties or by bystanders or other participants in activities at the Midwest Shooting Center Firing Range. The foregoing release (a) applies to any property loss or damage or bodily injury that results from my presence in the Midwest Shooting Center Facility, the use of a rental firearm or any safety equipment that I rent or borrow from Midwest Shooting Center; and (b) does not apply to property damage or injuries sustained by me as a result of the gross negligence or intentional misconduct of any of the Released Parties.

   I am aware of the danger associated with use of firearms on a firing range, including the risk of injury that may result from my presence at and use of firearms on the firing range. I am aware of the presence of lead inside of the firing range and the risks associated with lead and the handling of lead based ammunition. I hereby assume all of those risks and agree not to hold any of the Released Parties responsible for any property damage or bodily injury that may result from my assumption of those risks.

   I confirm that I am legally permitted to possess and use firearms in the Midwest Shooting Center Firing Range and elsewhere. I acknowledge that I have been trained in the safe use of each firearm that I will use in the Midwest Shooting Center Firing Range. I will seek additional training or assistance from Midwest Shooting Center Personnel should I become unsure about how to handle or use any firearm in a safe manner.

   I will indemnify, defend and hold Midwest Shooting Center harmless from liability for any claims for property damage or bodily injury that allegedly result from my acts or omissions while present in the Midwest Shooting Center Facility. Additionally, I acknowledge there is an inherent risk associated with discharging firearms at an indoor range and an inherent risk of simply being present within an indoor range area where the discharge of firearms is taking place. As a result, I hold Midwest Shooting Center harmless from any personal injury I may receive or inadvertently inflict from ricochet or by any other means of injury during my voluntary participation of indoor shooting range activity. 

   I acknowledge that I have read the Range Rules for the Midwest Shooting Center Firing Range, that I understand those rules and that I agree to comply with them as a condition to my presence at and participation in activities on the Midwest Shooting Center Firing Range. I understand that the Firing Range rules may change from time to time. I agree to comply with all revisions to those Rules.

   I also acknowledge that any firearm and all ammunition that I have in my possession or under my control while present in any Midwest Shooting Center Facility, including the Firing Range and the retail area, is subject to inspection at any time. At no time will I shoot steel core, tracer, or bi-metal ammunition on the Midwest Shooting Center Range. Shooting prohibited ammunition will result in a $150 fine. Midwest Shooting Center reserves the right to pursue all available remedies for property damage occurring from use of these banned ammunition types. Additionally, I wholly acknowledge that in the event I use reloaded ammunition, I assume complete responsibility of the potential consequences from using ammunition that has not been produced by a known, reputable, and tested manufacturer. I understand that there is a clear difference between ammunition produced by a manufacturer, and that the level of extended testing and quality inspection required for factory new ammunition starkly differentiates it from the unknown quality of materials or quality of manufacturing in reloaded ammunition. Examples of potential outcomes from using such ammunition include; catastrophic failure of firearm from over-pressured rounds, squibs from under-pressured rounds, failures and malfunctions from blown primers, or any other ammunition failure that could result in damage to personal property, MSC property, or personal injury. I acknowledge these hazards associated with reloaded ammunition and absolve Midwest Shooting Center of any liability that may result from its use and I take full and complete ownership of any negative outcomes that may potentially arise from using reloaded ammunition in the face of these acknowledged risks..

   This Release will be effective indefinitely. It will apply each time I am present at any Midwest Shooting Center Facility, including the Firing Range. I acknowledge that I will not be permitted to be present on the Midwest Shooting Center Firing Range at any time that this Release is not in effect.

   If I am a minor, my parent or legal guardian has signed this Release in the space next to my signature line below. My parent or legal guardian must be present with me any time that I am present on the Midwest Shooting Center Firing Range. I acknowledge that I will not be permitted to use the Midwest Shooting Center Firing Range unless I am accompanied by my parent or legal guardian.
