Tour and Rental Agreement and Liability Waiver

The undersigned renter/ customer agrees to join a guided tour or rent equipment for personal/ recreational use from Blue Planet Adventure LLC (BPA) under the following terms:

I am in good physical condition and have disclosed any injuries, medical conditions, or handicaps.  I am able to swim for an extended period of time without supportive equipment or other support, in the event that I am separated from my equipment.  I agree to use the supplied leash at all times.  I understand that using equipment provided by BPA is at my own risk, and that BPA, its owners and employees are not liable for any damages, injury, or death resulting from the use of said equipment or the environment.  I hereby waive any responsibility from BPA and its staff and accept full responsibility for resulting injuries or damages to myself or others. 

I agree to stay within the BPA designated paddling area which includes the Anahulu River to the left of the launch area, up to the second bridge, or in the protected bay to the right of the launch area.  I agree not to paddle past the harbor jetty.  I have seen the map and understand where the desingated paddle area ends.   Once any equipment leaves the premises, I am fully responsible for said equipment, including all damages, loss, or theft. 

If the equipment is not returned, or is lost, or stolen, I understand that I will be charged for the cost of repair or replacement value. Repairs will be charged at regular BPA repair rates (available from BPA staff on request).  I will inspect the equipment before using it, and will notify an employee of any un-repaired damages that have not been marked or repaired.

I agree to handle the equipment with care, will avoid exposing the equipment to excessive heat by turning board upside down if left in the sun for more than 10 minutes, and report damages incurred during use to BPA staff upon returning the equipment.  If I decide to keep the equipment longer than agreed, I will notify BPA to extend the rental agreement.
