This Privacy Policy describes how we handle your personal information for our services on the Outer Reef Scuba website. It applies generally to the orscuba.com website and other related websites where this policy appears in the footer of the page (“the Sites”). Some websites we operate may be governed by separate privacy policies. The policy that applies on any of our domains or subdomains is always the policy that appears in the footer of each website.

By accepting the Privacy Policy and the User Agreement in registration, you expressly consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for new users and is otherwise effective on February 8, 2020

Collection

You can browse the Sites without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. If you choose to provide us with personal information, you consent to the transfer and storage of that information to our servers located in the United States.

This Privacy Statement sets forth our current privacy practices with regard to the information we collect when you or your computer interact with our website.   By accessing www.orscuba.com, you acknowledge and fully understand Outer Reef Scuba, LLC’s Privacy Statement and freely consent to the information collection and use practices described in this Website Privacy Statement.

Related services and offerings with links from this website, including vendor sites, have their own privacy statements that can be viewed by clicking on the corresponding links within each respective website. Online merchants and others who participate in Outer Reef Scuba, LLC services are encouraged to participate in industry privacy initiatives and to take a responsible attitude towards consumer privacy.  However, since we do not have direct control over the policies or practices of participating merchants and other third parties, we are not responsible for the privacy practices or contents of those sites.  We recommend and encourage that you always review the privacy policies of merchants and other third parties before you provide any personal information or complete any transaction with such parties.

Our Disclosure of Your Information

We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims, or protect anyone's rights, property, or safety. 

We may also share your personal information with:

members of our corporate family to help detect and prevent potentially illegal acts and provide joint services; (Our corporate affiliates will market only to users who request these services.)

Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from bad actors, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

Security

Your information is stored on our servers located in the United States. We treat data as an asset that must be protected. However, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the Site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications would always remain private.

Use of Web Beacons or GIF files

Outer Reef Scuba, LLC web pages may contain electronic images known as Web beacons – sometimes also called single-pixel gifs – that allow Outer Reef Scuba, LLC to count users who have visited those pages and to deliver co-branded services.  Outer Reef Scuba, LLC may include Web beacons in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon.

Outer Reef Scuba, LLC has the discretion to occasionally update this privacy statement.  When we do, we will also revise the “updated” date at the top of this Privacy page.  We encourage you to periodically review this privacy statement to stay informed about how we are helping to protect the personal information we collect.  Your continued use of the service constitutes your agreement to this privacy statement and any updates.

I UNDERSTAND THE PURPOSE OF SIGNING THIS DOCUMENT IS TO EXEMPT AND RELEASE OUTER REEF SCUBA LLC, THEIR OWNERS, EMPLOYEES, SPONSORS, VOLUNTEERS AND ADVERTISERS, AS WELL AS ALL INVOLVED DIVE BOATS, WHETHER OWNED, OPERATED, LEASED OR CHARTERED AND TO HOLD THESE ENTITIES AND INDIVIDUALS (THE “RELEASED PARTIES”) HARMLESS FROM ANY AND ALL LIABILITIES ARISING AS A RESULT OF ANY ACTS OR OMISSIONS ON THEIR PART, INCLUDING, BUT NOT LIMITED TO, ACTIVE OR PASSIVE NEGLIGENCE OR NEGLIGENCE OF ANY TYPE. 


I understand that scuba diving. swimming, snorkeling, and skin diving is a hazardous activity with inherent risks and dangers associated therewith including, but not limited to, risks associated with equipment failure, perils of the sea, as well as acts of fellow divers which could result in my serious injury or death. 


I expressly assume all risks of scuba diving, snorkeling, skin diving, or skin diving and all associated risks, whether these risks are specifically set forth or not. It is my intention to release the released parties for anything that might happen to me while I am a participant in this program including but not limited to academics, confined water and or open water activities, that could result in personal injury or death.


I assert that I am physically fit to participate in the activity of swimming, scuba diving and snorkeling and I agree by way of my signature that I will not hold any of the released parties or above named individuals, persons, or entities responsible if I am injured as a result of any medical conditions while swimming, Scuba diving, snorkeling or skin diving. 


I do not have in my possession any illegal drugs, nor am I taking, nor have I recently taken any drugs or medications which could cause an adverse reaction as a result of combining such drugs and/or medication with scuba diving, swimming, snorkeling, and/or skin diving. 


Prior to diving, I will inspect all equipment to be used to make sure that it is in good operating condition. I will not hold the released parties or anyone else responsible for my failure to inspect my equipment prior to diving or for any equipment failure which may occur. 


I understand that I have an affirmative duty to plan and carry out my own dive and to be responsible for my own safety. By way of my signature I expressly agree that I will plan all my dives as no decompression dives and within safe limits of recreational scuba diving. I am fully aware and have been trained in the dangers, risks and hazards of holding my breath while diving on compressed air. 


I fully agree not to hold the released parties responsible for any such injuries sustained by me. I understand that this diving activity may be conducted in a remote site by time and distance from a medical facility and a recompression chamber. Nevertheless, I expressly wish to proceed with this diving activity and assume all related risks. I understand there is no obligation on the part of the released parties to provide medical assistance or first aid. 



   

BY WAY OF MY SIGNATURE ON THIS DOCUMENT IT IS MY EXPRESS INTENTION TO GIVE UP MY RIGHT TO SUE ALL INDIVIDUALS, OR ENTITIES OR VESSELS REFERRED TO HEREIN, (THE “RELEASED PARTIES”) WHETHER SPECIFICALLY NAMED OR NOT, FROM ALL LIABILITY ARISING AS A CONSEQUENCE OF ANY ACT OR OMISSION INCLUDING, BUT NOT LIMITED TO, ACTIVE OR PASSIVE NEGLIGENCE, INCLUDING GROSS NEGLIGENCE. I FULLY AGREE TO INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY OF ANY SORT, INCLUDING WRONGFUL DEATH ON BEHALF OF MYSELF, MY HEIRS AND ASSIGNS, AND I EXPRESSLY ASSUME ALL RISKS IN CONNECTION WITH SWIMMING, SNORKELING AND SCUBA DIVING ACTIVITIES.
