WATERCRAFT RENTAL AGREEMENT

This Watercraft Rental Agreement (“Agreement”) is entered into by and between Havasu Fun Rentals (“Owner”) and the

undersigned renter (“Renter”). By signing below and initialing where indicated, Renter agrees to the following terms and

conditions:

REQUIREMENTS

1. RENTER REQUIREMENTS

Minimum Age & ID: Renter must be at least 21 years old and present a valid U.S. driver's license or government-issued ID at the time of rental.

Security Deposit: A refundable $500 security deposit is required for all rentals and may be held via credit/debit card, Zelle, or Venmo.

  • Zelle/Venmo: The Remaining balance will be released within 24 hours of inspection.
  • Credit/Debit Card: A $500 pre-authorization hold will be placed and released within 1–5 business days. Cardholder ID must match the name on the card.

Deductions may be made from the deposit for damages, fuel charges, or sales tax (if booked via GetMyBoat).


2. FUEL POLICY

All watercrafts are provided with a full tank of fuel at the start of the rental period. Upon return, the watercraft will be refueled by Havasu Fun Rentals, and the cost of the fuel (plus $5 refill fee)  will be deducted from the Renter’s security deposit based on the amount required to return the tank to full.


3. Damage & Loss Agreement

By renting this watercraft, you agree to operate it responsibly and return it in the same condition it was provided. Please review the terms below:

Renter Responsibility:

You are financially responsible for any damage, loss, or theft that occurs to the watercraft, its equipment, or accessories during your rental period. This includes, but is not limited to, seats, propellers, anchors, keys, and safety equipment.

Pre-Rental Inspection:

Prior to departure, a visual inspection will be conducted with you. Any existing damage will be documented. You are encouraged to take your own photos for your records.

Post-Rental Inspection:

Upon return, the watercraft will be re-inspected. Any new damage, missing items, or excessive wear will be assessed, and the associated repair or replacement costs will be your responsibility.

Deposits & Charges:

A $500 damage deposit is required per rental unit. This deposit will be held prior to the rental period. Any damage-related charges will be deducted from this deposit. If costs exceed the deposit amount, your card on file may be charged the remaining balance.

Safe Operation Required:

You are expected to operate the watercraft safely and in accordance with all applicable laws and regulations. Reckless behavior, negligent operation, or allowing unauthorized individuals to operate the watercraft will result in full liability for any resulting damage.

We aim to provide a fun, safe, and smooth experience. Taking care of the watercraft ensures the same for you and the next renter.


4. TIME POLICY & FEES

Arrival Time:

Renter must arrive 15 minutes prior to the scheduled departure time for check-in and orientation. Due to our scheduling—watercrafts depart every hour—timing is critical. If the Renter has not arrived within 10 minutes after the scheduled departure time and the delivery truck must leave to deliver another watercraft, a $50 fee will be assessed to cover the cost of making an additional trip.

Late Returns:

A fee of $50 will be charged for every 30-minute increment past the scheduled return time. This fee will be deducted from the security deposit or charged to the payment method on file.

Service Call Fee:

If Havasu Fun Rentals is required to assist due to operator error (e.g., improper use, grounding, or other avoidable issues), a $100 service call fee will be assessed.



WATERCRAFT CANCELLATION POLICY

Cancellations made 72 hours or more prior to the scheduled rental time are eligible for a full refund.

Cancellations made within 72 hours of the scheduled rental are non-refundable.



RULES FOR THE USE OF WATERCRAFT AND EQUIPMENT

Renter agrees to use the Watercraft, including all its equipment, safety (life) vests, motor, gas tank, and sounding device (from now on collectively referred to as “the Watercraft”) only for personal boating on Lake Havasu with safety always in mind and by the following rules:

A. Intoxicants: The Renter shall not consume, nor be under the influence of, any intoxicant (including but not limited to alcohol) while operating the Watercraft.

B. Smoking/Vaping Policy: The smoking of any substance, including but not limited to tobacco, marijuana, or other controlled substances, is strictly prohibited on the watercraft. Smoking is only permitted on land and must occur off the watercraft. The Renter acknowledges that any violation of this policy may result in immediate termination of the rental agreement without refund and may incur additional cleaning or damage fees. The use of electronic cigarettes or vaping devices is permitted, provided it does not cause damage to the watercraft or disturb other passengers.

B. Navigation and Safety: The Renter shall follow all posted speed limits and rules of navigation while on the water and remain clear of all other boats. The Renter shall not attempt to board another vessel from the Watercraft or tie off to another boat. The Renter shall not allow the Watercraft to collide with or damage other vessels or docks.

C. Authorized Operators: The Renter shall not allow anyone other than the Renter to use or operate the Watercraft unless they have signed the Participant Checkout Acknowledgement. If the Renter fails to disclose other operators, passengers, or users of said equipment, he/she will be personally liable for any damages caused by the undisclosed individuals, even if such damages arise out of the negligence or fault of Havasu Fun Rentals LLC.

D. Towing: The Renter shall not tow anything with the Watercraft. Additionally, the Renter shall not tie, attach, or secure any items, equipment, or objects to the bimini top of the Watercraft.

E. Prohibition of Rock and Cliff Jumping: The Renter and all passengers are strictly prohibited from engaging in any activities involving jumping off rocks, cliffs, or any elevated structures into the water while using any watercraft or equipment provided by Havasu Fun Rentals LLC.

F. Assumption of Risk and Waiver of Liability

The Renter acknowledges and agrees that engaging in such prohibited activities, despite this prohibition, is inherently dangerous and poses significant risks, including but not limited to serious injury, permanent disability, or death. Havasu Fun Rentals LLC is not liable for any injuries, damages, or losses, whether to persons or property, resulting from any such prohibited activities. The Renter assumes full responsibility and liability for any consequences arising from the violation of this prohibition, including any claims, demands, or legal actions brought against Havasu Fun Rentals LLC.


RESPONSIBILITY/DAMAGES

The Renter shall return the Watercraft in good working order and condition at the end of the rental. If any equipment is lost or damaged, the Renter shall inform Havasu Fun Rentals upon return. The Renter shall be financially responsible for all lost or damaged equipment or damage to the Watercraft. Havasu Fun Rentals will charge the Renter for lost or damaged equipment to the credit card on file or use the Zelle/Venmo hold according to the schedule of charges provided. Any new fiberglass damage to the personal watercraft will result in the automatic forfeiture of the $500 damage deposit.

This list of charges is not exhaustive and does not waive responsibility for other damage to the Watercraft. The Renter shall be fully financially responsible to Havasu Fun Rentals LLC for damages incurred if the Watercraft is returned in an unrentable condition. The Renter agrees to pay Havasu Fun Rentals LLC additional rent of $200/day until the Watercraft can be repaired to a rentable condition, with a maximum rental charge of $6,000.
