The Bounce House People Release of Liability

Waiver of Claims, Assumption of Risk.

Please read and be certain you understand the implications of signing


I do hereby affirm and acknowledge that I have been fully informed of the inherent risks and hazards associated with the games and activities to which I am about to engage, including but not limited to:

  1. Any bouncing, jumping or climbing movement in the games and rides that may cause to fall or collide with others.
  2. Any sliding movement in the games and rides That might cause me to descend in an uncontrollable manner.
  3. Any sports related games, where riders compete to knock one person off a platform and the risk of falling or collision.
  4. Any ride where I will be ascending thru air, and any inherent risks with that speed, movement, spins that are uncontrollable.
  5. Inclement weather, lightening, variances and extremes of wind weather and temperature.
  6. My sense of balance, physical condition, ability to ride and fold onto and follow directions.
  7. The presence of insects and flying life forms.
  8. Equipment failure or operator error.
  9. Heat or sun related injuries or illness, including sunburn, dehydration and sun stroke.
  10. Fatigue, chill and or reaction time and increased risk on an accident.

**VERY IMPORTANT - Customer (RENTER) is responsible for all damages to unit and any cleaning charges ($25 -$150) due to misuse (NO Gel Blasters, Orbeez, Fireworks, Food, Gum, Candy, Drinks, Confetti, Mud, Glitter, Balloons inside the inflatable, No Dog Poop around or near the unit etc.). PLEASE KEEP DOGS, CATS any Kind of animal AWAY FROM THE RENTAL UNIT. If damages occur due to a dog or cat, Customer (Renter) is responsible for any damages caused by it and will have to pay for repairs. Someone should be with the unit at ALL TIMES until time of pick-up to avoid any problems. A flat rate of $500 is applied if any SILLY STRING is found on the unit. Silly string causes irreversible damage to any inflatable. SO PLEASE NO SILLY STRING OR ANY KIND OF DYE PRODUCTS NEAR THE INFLATABLE. YOU WILL BE RESPONSIBLE FOR THE DAMAGES AND REPAIRS. **

I understand the above-described risks simply can not be eliminated without jeopardizing the essential qualities of the activities. Furthermore, The Bounce House People seek to provide a safe environment for all but are not infallible. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions and the equipment being used might malfunction.

I specifically acknowledge that I meet the ride height, age and weight requirements. I do not have any health ailments including but not limited to, back, neck, heart, motion sickness, seizures, pregnancy, dizziness or other ailments which may be aggravated by this activity. I am physically/mentally able to participate in the activities to which I am about to engage. I certify that I have adequate Insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical, mental or physical condition that I may cause to myself.

I specifically waive any defense insofar as this contract is concerned that may arise as a result of any law and/or regulation or policy that may impact its enforceability. In consideration of being allowed to participate in the above-described activities, as well as the use of any of the facilities and the use of the equipment of the below listed releases, I hereby agree as follows:

  1. To waive and release any and all claims based upon negligence active or passive that I may have in the future against all of the following named persons or entities herein referred to as releases: The Bounce House People LLC.
  2. To release the releases, their officers, directors, owners, employees, sub-contractors and volunteers from liability and responsibility whatsoever and to any claims or causes of action that I, my estate, heirs, executors or assigns may have for personal injury, property damage or wrongful death arising from the above-mentioned activities whether caused by or active or passive negligence of the releasees or otherwise. By executing this document, I agree to hold the releasees harmless and indemnify them in conjunction with any injury, property damage or loss of life that may occur as a result of engaging in the above listed activities.
  3. By entering in to this agreement, I am not relying on any oral or written representation or statements made by the releasees, other than what is set forth in this agreement.

I hereby declare that I am of legal age and am competent to sign this agreement or, if not that my parent or Legal guardian shall sign on my behalf and that my parent or legal guardian is in complete understanding and concurrence with his agreement.

I have read this agreement, understand it, and I agree to be bound by it.

The Bounce House People LLC rental agreement

This is a rental agreement, referred to herein as “contract”, and your signature on this contract and/or payment of money and/or taking possession of any The Bounce House People LLC accessories, equipment’s or products, referred to herein solely as “products”, is evidence of your acceptance of the Contract and your intent to use the Products received in the manner they are intended to be used along with following all the safety rules. This contract is made and entered by and between The Bounce House People LLC, referred from herein solely as “TBHP”, and the undersigned “Renter”.

1. OWNERSHIP: Renter agrees to keep all products in his/her custody and not sublease, rent, sell or remove from the delivery location. Renter agrees not to remove, disassemble, or uninstall products from its set up location or to install and products. Renters assumes responsibility for all products rented from the time of delivery to when TBHP representatives arrive for pick up. Renter agrees to maintain any and all products rented in its original condition from time of delivery, and alterations or attachments will result in additional fees subject to TBHP discretion. Items forbidden in products include but are not limited to all liquids, sprays, foods, breakable objects, and any sharp objects. If any such objects are found and cleaning or repair is required, a minimum of a one-hundred-dollar fee shall be imposed.

2. RENTAL PERIOD AND PAYMENT: in the event the products are not returned at the said date and time, the appropriate daily rate shall apply for each day that the renter maintains possession of the product. Renter authorizes TBHP to submit for payment on any credit card, payment app, or debit card provided by Renter as form of payment on all amounts owed. The property is being rented in substantially the same form as required by TBHP through a transaction that was a retail sale with respect to the retailer sales tax will be calculated to be paid by Renter.

3. DELIVER/PICK UP: Renter grants TBHP representatives the right to enter the property at the specified delivery address for the delivery and subsequent pick up or removal of the product for 24 hours on the date specified. The same TBHP representative will arrive to pick up any and all products at any time after the fulfillment of this contract. If a different person arrives for pick up, Renter must first obtain authorization from TBHP IMMEDIATELY prior to allowing the person to enter the property and remove the rented products. TBHP will strive to accommodate Renter’s delivery and pick up time requests as stated on the invoice. In the event that there should be any changes to the delivery or pick up times specified, a TBHP representative will notify the Renter as soon as possible. Renter assumes responsibility of providing easy level access to the set-up location with out any obstacle or barriers, which include but are not limited to stairs, incline, decline, sand, or gravel that will create passage difficult. Presence of any such obstacles or barriers will result in delivery fees subject to TBHPs discretion or cancellation of order. Renter assumes responsibility of informing TBHP representatives of any underground utilities or water sprinklers that may interfere with staking or anchoring of TBHP units. Renter agrees not to hold TBHP representatives or TBHP associates responsible for any damage to customers property, during the course of set up set up and pick up. All table and chair rentals are curbside, meaning they are delivered to the front of the delivery location near the curbside and must be picked up in the same location during pick up time. Renter agrees to have and all tables and chairs restacked and organized for pick up in the same manner as they were delivered or a handling fee will be accessed per TBHPs discretion.

4. WARRANTY:TBHP warrants and Renter agrees that the product rented is/are in good working condition upon delivery and Renter further warrants that it will be returned in the same condition, notwithstanding ordinary wear and tear. The product is/are supplied and maintained subject to this warranty. TBHPs obligation under this contract is limited to repair and replacement of products when TBHP determines that it does not conform to this warranty. This warranty is in lieu of any and all other warranties expressed or implied, and all obligations and liabilities on the part of TBHP for damages including, but not limited to, consequential damages arising out of or in connection with the use of or in connection with the use of performance of the product. If any problems or malfunctions occur with any of the products you rented during the course of your rental [period, you must contact TBHP IMMEDIATELY so we can address the issue.

5. RELEASE OF LIABILITY: Renter agrees to hold FULL and SOLE responsibility in ensuring the safe operation of TBHP equipment, to follow any safety rules posted on products and or and verbally given, and to supervise the product rented and any and all participants. Renter understands and acknowledges that any activity in connection to products brings both known and unanticipated risks that could result in property damage, physical or emotional injury, paralysis, death or other damage or injury to participants. Those risks include but are not limited to falling, slipping, crashing, and colliding. Renter understands such risks cannot be eliminated without jeopardizing the essential qualities of the activity. Renter agrees to release, forever discharge and hold harmless TBHP, including its officers, employees, subcontractors and or agents from any injury, damages or claims that result from renter negligence including and injuries, claims or damages asserted by Renters guests, invitees or third parties. Renter agrees to report any damages, injury or claim to TBHP with in five (5) days of the reservation date; failure to do so will result in negligence from Renter and release of any liability or responsibility from TBHP. Further, renter agrees not to hold TBHP, including its officers, employees, subcontractors, and or agents liable or accountable for any costs arising out of or in connections to attorneys’ fees and/or claims brought up in court involving the use of any product. Renter shall indemnify and hold harmless TBHP, its employees, executives and agents from and against any and all damages, liabilities, claims, costs, expenses, attorneys’ fees etc. incurred by Renter directly or indirectly, in connection with the rental of products due to negligence of TBHP

6.WEATHER POLICY: During periods of severe weather conditions arising out of but not limited to rain, hail, lightening, high winds (over 20 miles per hour) intense heat, and fire, the products must be evacuated immediately and electricity must be turned off. TBHP reserves the right to cancel the reservation or end the rental term at any time during severe weather conditions. In instances where severe weather conditions arise after delivery or set up has taken place TBHP has the right to end the reservation/ rental term and NO refund will be given. Renter agrees to release, forever discharge and hold harmless TBHP, its officers, employees, subcontractors and or agents from injury, damages or claims resulting out of or in connection to severe weather conditions and or renter’s negligence to follow rules regarding weather policy.

7.CANCELLATION POLICY: Renter agrees to notify TBHP with in 10 days of the delivery date of any cancellation or postponements. If Renter cancels any reservation with in 5 days of rental date, in whole or deposit, TBHP has the right to apply to any cancellation fee.

8. DAMAGE WAIVER: The damage waiver in not intended as insurance and only applies to Renter if he/she has purchased it. Renter acknowledges that damage waiver relieves the Renter of liability for physical damage of products from any external cause such as fore, collision, windstorm, or any acts of GOD.

9. ACKNOWLEDGEMENT: Renter acknowledges that sufficient time and opportunity were given to read this entire contract, and understands its contents and is executing it freely, intelligently and without duress of any kind and agrees to be bound by its terms. Renter acknowledges that he/she has had sufficient time to understand all safety and operating instructions and has also taken the time to instruct all users and their parent/guardians of such safety issues. Renter agrees that if any portion of this contract is found to be void or unenforceable, the remaining portion shall remain in full force and effect. Renter acknowledges that by providing his/her signature, he/she is agreeing to the terms and conditions of this contract.
