WAIVER OF LIABILITY, ACKNOWLEDGEMENT OF AWARENESS
AND INDEMNIFICATION AGREEMENT
FOR USE OF THE ULTIMATE DEFENSE TRAINING FACILITY

WHEREAS, Ultimate Defense Firing Range and Training Center, LLC and AIM Investment Group, LLC, Missouri limited liability companies (the First Party) agrees to provide access to property that AIM Investment Group, LLC owns, and Ultimate Defense Firing Range and Training Center, LLC operates, in order that certain members of the general public may conduct handgun training that involves the Ultimate Defense Training Facility; and

The undersigned (the Second Party) will be allowed access to the property for the purpose of engaging in training activities in which the Second Party may be firing projectiles including Simunitionä marking cartridge projectiles and the Second Party agrees to waive any and all liability that may be caused as a result of any action by the Second Party or any officer, agent, servant or employee of the First Party; therefore:

1. The undersigned hereby releases and forever discharges the First Party, their officers, agents, servants and employees, who it might be claimed to be liable, none of whom admit any liability from any and all claims, demands, actions, causes of action or suits of any kind or nature whatsoever and particularly on account of all injuries known and unknown, both to person and property, which have resulted or may in the future develop from any accident which might occur as a result of any training activity sponsored by Ultimate Defense Firing Range and Training Center, LLC.

2. The undersigned hereby declares that the terms of this agreement have been completely read and are fully understood and voluntarily accepted for the purpose of making a full and final compromise adjustment and settlement of any and all claims, stipulated or otherwise, on account of the injuries and damages above mentioned, and for the express purposes of precluding forever any further or additional claims arising out of any possibility accident by the undersigned.

3. It is further agreed that the release expresses a full and complete settlement of liability, regardless of the adequacy of the aforesaid and that the acceptance of this release shall not operate as an admission of the liability on the part of anyone, nor as estoppel, waiver, or bar with respect to any claim the part or parties release may have against the undersigned.

4. This release is binding on my heirs, executors, assigns and administrators. This is a voluntary release for any and all future injuries or accidents. The undersigned is aware of the risks of attending, traveling to and participating in any events at the Ultimate Defense Training Facility and hereby assumes all risks. The risks include those foreseen and unforeseen, known and unknown.

Firing Range Rules

Cardinal Rules of Firearms Safety

  1. Treat all firearms as if they were loaded at all times.

Ultimate Defense Firing Range Rules

Patrons under the age of twenty-one (21), but at least thirteen (13) years of age, may shoot if accompanied by a person at least twenty-one (21) years of age or older. Members under the age of twenty-one (21) with an active military identification shall be exempt from the minimum age requirement of twenty-one (21).

Only one loaded firearm per stall is allowed at any time. Multiple weapons are allowed, but weapons not currently in use must be unloaded and positioned on the shooting stall bench pointed downrange.

Eye and Ear protection must be worn at all times in the firing range.

All Range Staff commands must be followed immediately. When hearing the command, “Cease FIre”, immediately stop shooting, remove your finger from the trigger and place it on the frame. Keep the firearm pointed downrange and wait for further instruction.

Only ammunition purchased from Ultimate Defense will be allowed for use in rental weapons.

All firearms must be kept pointed downrange when unholstered or uncased. FAILURE TO CONTROL MUZZLE DIRECTION WILL RESULT IN DISMISSAL FROM THE FIRING RANGE.

If you need assistance, place the firearm on the bench with the muzzle pointed downrange and notify Range Staff. DO NOT REMOVE THE FIREARM FROM THE SHOOTING STALL UNTIL RANGE STAFF HAS CLEARED THE WEAPON.

Customers are prohibited from removing a firearm from a holster or a case anywhere on Ultimate Defense property, with the exception of the shooting stalls. CUSTOMERS HANDLING THEIR WEAPONS INAPROPRIATELY OR WHERE PROHIBITED WILL BE ASKED TO LEAVE THE PROPERTY IMMEDIATELY.

No food or drink permitted in the firing range bays. Smoking is strictly prohibited anywhere inside the Ultimate Defense Firing Range and Training Center.

No one under the influence of drugs or alcohol is allowed on Ultimate Defense property.

Due to health concerns, pregnant women and nursing mothers are not allowed on the firing range.

No one is permitted forward of the firing line for any reason unless under direct authorization from Range Staff. Recovery of brass falling forward of the firing line is not allowed. Other items, (magazines, ammunition, etc.) that fall forward of the firing line will remain where they fell until Range Staff is able to create a safe condition to retrieve the item(s).

If you wish to exit the shooting stall but leave your firearm, the firearm must be left unloaded, pointed downrange.

Do not hand a loaded firearm to another person. Place the firearm on the shooting bench and allow the other person to pick up the firearm from the bench.

FIRING AT ANYTHING OTHER THAN YOUR OWN TARGET IS PROHIBITED. Firing a shot that results in damage to the range or range equipment may result in a repair fee and/or dismissal from the range.

Drawing from a holster is prohibited unless with permission from Range Staff.

TRACER, ARMOR-PIERCING, STEEL CORE AND MILITARY SURPLUS AMMUNITION IS NOT ALLOWED ON THE RANGE. Verify that the ammunition you have is the correct ammunition for your firearm. Shooters assume all liability for hand-loaded and remanufactured ammunition. Range Staff has the right to inspect and prohibit any ammunition they deem as inappropriate for the firing range.

Use appropriately sized targets, placed at eye level, to ensure that your shots strike the backstop and not the floor, ceiling or target carrier. Range Staff has the right to prohibit any targets they deem unsafe or offensive.

Firearms approved for range usage are handguns up to .50 caliber, rifles up to .300 Blackout, shotguns with slugs, and .30 caliber firearms WHEN USED WITH SUPPRESSORS. No pistol grip-only shotguns or firing from the hip will be permitted.
