Welcome to Serenity Farm Gypsy Horses 

This documentation is required prior to your first visit to the farm.  Please go through the document very carefully and ask questions if needed.    When this document states "Farm" it includes any address that our horses and team are doing business at such as and not limited to 5162 Lewis Ave Ida Mi 48140, Horse shows, Monroe County Fair Grounds, Lenawee County Fair Grounds and/or Simms Sanctuary.    By signing this document, you are signing that you are aware that horse are dangerous and you could be hurt, injured or killed by horse activity as a Rider, Participate or even someone who is just watching Horse activities.     Ride, Participate and Observe at your own risk. 

CHANGES 12.1.24

All lessons are prepaid.   Booked and paid for online prior to the lesson.   We will now follow Semesters instead of monthly.     

Semesters include

Winter--Dec, Jan and Feb

Spring--March, April and May

Summer--June, July and Aug

Fall--Sept, October and November


Horse Leases

  •  Leases are available on a case by case basis but will be Spring and Summer Semester at a minimum. (6 month commitment)

Show Coaching:

  • $50 per day for show coaching when multiple Students Show
  • $100 per day for show coaching if you are the only one showing.

Horse Hauling:

  • $25 per hauling of our horses or $2.00 a loaded mile. 

Horse Training Fees

  • $1200 per month--this includes board--TRAINING OF OUTSIDE HORSES IS EXTREMELY LIMITED

Consignment Services & Horse FInder Services

  • 10% of Selling Price

 

 

SFGH LIABILITY RELEASE & EXPRESSED ASSUMPTION OF RISK

  

WARNING: UNDER THE MICHIGAN EQUINE ACTIVITY LIABILITY ACT, AN EQUINE PROFESSIONAL IS NOT LIABLE FOR INJURY TO OR THE DEATH OF A PARTICIPANT IN AN EQUINE ACTIVITY RESULTING FROM AN INHERENT RISK OF THE EQUINE ACTIVITY.

This contract must be read and signed prior to participation in any equine related activity at Serenity Farm Gypsy Horses or at a location that SFGH provides service at such as locations SFGH hauls horse to such as the rented Indoor arena, Simms Sanctuary and any Show arenas we travel to. This contract will be signed for the use today, but will cover any and all equine activities on all future days at these properties.   Equine Related Activity is defined as Riding, Leading, Lessons, Leasing, Driving, Bathing, Grooming, Observing, Visiting, Volunteering, Walking through Equine Areas such as the Barns, trailers, pastures or Property.

This LIABILITY RELEASE and EXPRESS ASSUMPTION OF RISK is made between Serenity Farm Gypsy Horses (and Christina Riggs-Owner), hereinafter designated as Equine Facility Owner and Parties names listed below hereinafter designated as Participant.

 IF PARTICIPANT IS A MINOR THEN THE SIGNATURE OF AT LEAST ONE (1) PARENT OR LEGAL GUARDIAN IS REQUIRED. THE SIGNING OF THIS CONTRACT BY ONE (1) PARENT OR LEGAL GUARDIAN CONSTITUTES FOR PURPOSES OF THIS CONTRACT TO BE VIEWED AS AGREEMENT AND A WAIVER OF ALL RIGHTS BY THE OTHER NON-SIGNING PARENT OR LEGAL GUARDIAN, AS WELL AS A WAIVER OF ALL RIGHTS BY THE MINOR PARTICIPANT. The Participant, their spouses/relatives/heirs, and legal representatives hereby express agrees to the following by placing their initials next to each item, filling out information and signing below.

Participant is responsible for full and complete health/liability insurance on their horse, personal property and participant. Participant agrees to hold Equine Facility Owner harmless from any and all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees, which in any way arise from Participants use of or presence upon the property and facilities.  

Participant agrees to hold Equine Facility Owner and all successors, subsidiaries, partners, affiliates, officers, employees, agents, and descendants completely harmless and not liable and releases them from all liability whatsoever and AGREES NOT TO SUE them on account of or in connection with any claims, causes of action, injuries, damages, costs or expenses arising out of Participants use of or presence upon Equine Facility Owner’s property and facilities, including without limitation, those based on death, bodily injury and damages.  

PARTICIPANT EXPRESSLY ASSUMES RESPONSIBILITY FOR ALL RISKS INVOLVED IN OR ARISING FROM PARTICIPANT’S USE OR PRESENCE UPON EQUINE FACILITY OWNER’S PROPERTY AND FACILITIES including but not limited to: the risks of death, bodily injury, property damage, falls, kicks, bites, collisions with vehicles, horses or stationary objects, fire or explosion, the unavailability of emergency medical care, and/or the negligence and/or deliberate act of another person.  

Participant agrees to abide by all of Equine Facility Owner’s rules and regulations, and Participant is responsible for using protective gear at all times. (approved riding helmet and boots).  

If Participant is using Participant’s own horse, or other non-resident horse, SFGH is not responsible in any way for outside horses, Also Participate agrees the horse shall be free from infectious, contagious, or transmissible diseases. Equine Facility Owner, their employees, or representatives reserve the right to refuse access or use of any horse upon the premises that does not appear to be in good health, or is deemed dangerous or undesirable.  

Participant understands that there are inherent risks in and around equine activities. Risks inherent in equine activities means dangers or conditions that are an integral part of equine activities, including but not limited to: the propensity of an equine to behave in ways that may result in the injury, harm, or death of persons around the equine (including bucking, kicking, rearing, biting, shying, falling, tripping, stepping on; the unpredictability of an equine’s response to sound, movement, objects, persons, animals, excitement, weather conditions, all types of creatures, and the effects of such reactions; the hazards of surface or subsurface conditions including objects, debris, obstacles, or conditions on, or under, or protruding from the surface, whether apparent or not; the dangers and risks of tack or equipment or harness slipping or breaking, as well as the dangers and risks of becoming entangled in tack, equipment or harness or any vehicle used in any equine activity for any reason whatsoever; a collision with another equine, another animal, a person, or an object; the potential of an equine activity participant to act in a negligent manner that may contribute to injury, death, or loss to the person of the participant or to other persons, including, but not limited to failing to maintain control over an equine or failing to act within the ability of the participant.  

Participant agrees they were given time to read and ask question regarding this contract.  Participate also can consult with an attorney prior to signing this contract.  Participant agrees they understand all aspects of this document, they were not forced into signing and they are signing with their free will.  

This contract is non-assignable and non-transferable and is made and entered in the State of Michigan, and shall be enforced and interpreted under the laws of this state. Participant agrees to waive the protection of any applicable statutes in this jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspect to exist at the time of executing said release.

Any action brought under this agreement shall be brought within one (1) year of the incident or accident giving rise to said claim.  All incidents must be reported to the Owner immediately 

Participant agrees that damages shall be limited to Five hundred dollars ($500.00) for property damage, medical or other actual expenses incurred, and a maximum of One thousand dollars ($1000.00) for damages such as pain and suffering. 

Participant agrees any incident or accident with or without injury is reported to Owner or Instructor immediately and Participant will complete an incident report at that time.  

I HAVE READ AND UNDERSTOOD THIS LIABILITY RELEASE. I WAS GIVEN TIME TO ASK QUESTIONS AND I FULLY UNDERSTAND THIS RELEASE AND SIGNED AT MY OWN WILL, WITHOUT FORCE.   UPON SIGNING THIS CONTRACT IT IS LEGAL AND BINDING.

This Liability release is for the Participate and those family members that come to watch lessons. (Those who come to watch must complete the Visitor wavier--All parties on the property must have a signed Liability release as Horses can be dangerous.)

LESSON PROGRAM POLICY AND AGREEMENT


All students/parents are required to complete this document and our release in liability wavier prior to their first lesson. 


Please read carefully, and if you agree to our policies, sign and date below.


1. All new students must follow code of conduct that is attached.  Instructors reserve the right to end the lesson if needed due to violations in Riders code of Conduct. 

2. All students, parents and guardians are expected to abide by barn rules and signage posted throughout the farm.

3. We teach horsemanship, not just Riding a horse.  We include mounted, unmounted and class time lessons. THERE WILL BE CLASSROOM LEARNING LESSONS.

4. Students need to be mature enough to understand and follow directions.

5. Riding lessons are scheduled for the same day and time each week with lessons continuing for the full semester.

6. Some class time may not involve mounting and riding a horse, but will be instructional and educational.


7. No student will be asked to perform a task that makes the student uncomfortable or afraid.

8. All lessons are PREPAID.  We do have a Clover Machine to accept credit cards in person if needed.

9. Checks are not preferred but accepted. There is a $50 charge for a bank-returned check. 


10. All Makeup lessons will be in hand or classroom lesson, made up within one week of the cancelled lesson.    

11. We require 24-hour cancellation notice

12. Riding attire for lessons include:

• Long pants, breeches or chaps

• Boots or hard sole shoes with a heel 

• An approved ASTM/SEI riding helmet. All students must have their own helmet and it is assumed a parent has assessed the helmet for damage prior to every lesson. 

NOTE: If students arrive in attire that the instructor deems unfit for the activity, the instructor reserves the right to limit the student based on the attire.   No helmet means classroom lesson only

13. Riding lessons begin and end on time. Please be on time and come a few minutes early to prepare for your lesson. Please remain in your car until 5 mins prior to your lesson time so the horses receive a break between lessons.   Tardiness will result in a shorter lesson or, if in the case of a group lesson, may result in inability to ride as to not impede the other student’s ride time. Riders 15 mins late for a lesson forfeit the lesson


14. SFGH instructors reserve the right to dismiss or refuse to provide lessons to anyone if we determine that the student is uncooperative or incapable of safely meeting the requirements of the program.


15. Children must be supervised at all times on the property and must be in visitor areas. Participants or families with unsupervised children may be required to end their lesson early..  All fences are electric, Do not feed, pet, touch horses in their pastures.  Visitor areas do not include the homes on the property or the barns.  

16. Dogs are not permitted on SFGH farm property, horse shows or Simms Sanctuary.  Medical Service dogs need approval prior to visiting the farm.   NO EMOTIONAL SUPPORT DOGS!  SFGH Owner has a Medical Service dog that travels with owner and Simms Sanctuary has a dog that lives on their property. (Both dogs are friendly but not to be handled by guest to the farms)

17. ALL CALLS TO THE FARM NEED TO BE CALLED TO 888-247-1233    NO CALLS, TEXT or SOCIAL MEDIA MESSAGES TO SFGH STAFF, INSTRUCTORS, TEAM MEMBERS OR PARTNERS

 

 

Students Code of Conduct:

  1. We never take our frustrations out on the Horse, the Instructors, or other Students.
  2. Good Sportsmanship at all times and Cheering each other on is strongly encouraged.  The barn is not a place for bullies.
  3. If the horse is not doing what we want it to do, First we must ask ourselves "Are we asking correctly"
  4. Come to lessons with an open mind and a smile on your face.  Leave your troubles in the car.
  5. Kicking and pulling in the horses mouth out of frustration will result in losing the rest of the lesson and the next lesson will be Non mounted to work on your connection with the horse.
  6. Understand If riding horses was easy, everyone would do it.
  7. Practice, Practice, Practice--Just like any other sport.
  8. UNDER NO CIRCUMSTANCES Should a student enter a Stall, Pen, Pasture or Fence with a Stallion.  
  9. Only Feed horses that Instructor gives you permission to do so-Understand horses can die from feeding them things they are not used to.
  10. Always remove horses' halter in Pens, Pastures and Stalls.  Halters only stay on when we are physically with the horse
  11. DO NOT BE A MEAN GIRL....Build each other up not tear each other down.    SFGH retains the ability to cancel the remainder lessons of the semester due to bullying.   No refunds will be given.

 

Photo Release and Social Media Consent Form

 

I hereby grant Serenity Farm Gypsy Horses, its representatives and employees, permission to use and/or publish photographs or videos of myself or my family members in print and/or electronically. I understand and agree that these materials will become the property of Serenity Farm Gypsy Horses and will not be returned. I hereby authorize Serenity Farm Gypsy Horses to edit, alter, copy, exhibit, publish, or distribute the photograph or video for purposes of publicizing their programs or for any other lawful purpose. In addition, I waive my rights to any compensation arising or related to the use of the photographs or videos. I release and discharge Serenity Farm Gypsy Horses from any and all claims arising out of use of the photos or videos for any lawful purpose such as for publicity, illustration, advertising, and Web content.

I hereby release and agree to hold SFGH harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of SFGH, or that may otherwise arise in any way in connection with any services received from SFGH.

I understand that this release discharges SFGH from any liability or claim that I, my heirs, or any personal representatives may have against SFGH with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from SFGH. This liability waiver and release extends to SFGH together with all owners, partners, and employees.
