We require each participant to enter into an agreement acknowledging the potential risks of any activity, release any liability, assume the risk, and confirm our legal relationship. Please read this document in its entirety. This is a legal document. Do not hesitate to reach out along the way with any questions or concerns.
Binding Agreement and Release of Liability
The undersigned individual named above (referred to below as “I” or “me”) desires to participate in certain travel activities and adventures, including the trip/activity identified above (collectively, the “Activity”), which Activity is sponsored by Illuminate Youth Trips, a Utah corporation (also referred to below as “Illuminate” or “we”).
In consideration of being permitted to participate in the Activity and the intangible value that I will gain by participating in the Activity, and in recognition of Illuminate’s and its owners’ and managements’ reliance on the terms below, I am executing this Illuminate Contract (this “Agreement”) with the understanding that on execution by me this becomes a legally binding contract, enforceable according to its terms and conditions.
I UNDERSTAND THAT ALL PARTICIPANTS IN ILLUMINATE YOUTH TRIPS ARE REQUIRED TO ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATING IN ANY ACTIVITY. BY EXECUTING THIS AGREEMENT, I AM AFFIRMING THAT I HAVE READ AND UNDERSTAND THIS AGREEMENT AND THAT I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. I ACKNOWLEDGE THAT I AM SIGNING THE AGREEMENT FREELY AND VOLUNTARILY.
BY SIGNING THIS AGREEMENT, I REPRESENT AND WARRANT TO ILLUMINATE YOUTH TRIPS THAT I HAVE FULL LEGAL AUTHORITY TO COMPLETE THE EVENT REGISTRATION ON BEHALF OF MYSELF AND ANY MINOR THAT I AM REGISTERING (THE "REGISTERED PARTIES"), INCLUDING FULL AUTHORITY TO CHARGE THE CREDIT OR DEBIT CARD TO WHICH REGISTRATION FEES WILL BE CHARGED.
I UNDERSTAND THAT ALL CANCELLATION REQUESTS MUST BE SUBMITTED IN WRITING VIA EMAIL STATING THAT I WILL NO LONGER BE PARTICIPATING IN THE ACTIVITY AND WILL NOT BE REFUNDED.
General
I understand that my registration is not complete until: 1) I have signed this Agreement. 2) I have paid my $500 non-refundable deposit. 3) I have sent a picture of my passport via email to hello@illuminatetrips.com. (International trips only)
Payment Terms:
I understand that the following are the applicable payment terms: 1) $500 deposit to secure my spot (non-refundable at time of deposit) 2) Half of Trip Fees due on February 1, 2025 3) $1500 towards international group airfare (if chosen and applicable) due on March 1, 2025 4) Remaining balance of Trip Fees due on April 1, 2025
I understand that if my deposit is not received by Illuminate Youth Trips within 72 hours of the submission of my registration form, my registration and reserved space for the Activity will be discarded and I will have to resubmit the registration. I will contact Illuminate Youth Trips if I need more time by emailing hello@illuminatetrips.com.
I understand that my deposit is non-refundable and when paid in full will secure my place on my designated Activity. I further understand that if any cancellation occurs after the payment dates, additional payments are non-refundable/transferable as well.
General Medical Acknowledgement and Release; Acknowledgement of Risk and Informed Consent for Participation in the Activity
I hereby consent to participating in Illuminate Youth Trips and the Activity. This consent applies to all travel, excursions, activities, and other events related to the Activity. By signing this Agreement, I hereby acknowledge that I am aware of the risk of illnesses (including, but not limited to COVID-19) and any other injuries that may occur while traveling and participating in the Activity, including but not limited to as outlined in Illuminate Youth Trips’s materials and in this Agreement. It is my desire to participate in Illuminate Youth Trips and the Activity, and I do so with full knowledge and understanding of all risks involved, including possible risks not disclosed.
I hereby expressly release Illuminate Youth Trips of any liability inherent to traveling at this time and hereby wave any claims against Illuminate Youth Trips. I understand that once Illuminate Youth Trips departs for my scheduled trip, I forfeit any refunds and/or credits even if activities are missed due to any sickness or injury.
I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby grant to Illuminate Youth Trips and its agents access to all medical records and physicians as needed and authorizes medical treatment as needed.
Disease or Illness
I confirm that I am in good health and proper physical condition to participate in the Activity and warrant that I do not have any medical or other conditions that would impair my ability to participate in the Activity. During the Activity, I agree that if I begin experiencing symptoms of disease, such as cough, shortness of breath, sore throat, congestion, headache, muscle or body aches, chills or fever, I will inform the Activity administrators and will take proper precautions to isolate myself from other participants.
I acknowledge and understand that traveling in a foreign country may increase my risk of illness or disease and I agree to assume the risk. I agree to consult with my own physician to ensure proper health screening before attending, including verifying that my vaccines and other preventative measures are up to date.
Injury
I understand that I may engage in various activities and events while participating in the Activity. I understand that participation is voluntary and that I choose to participate at my own risk. I will not hold Illuminate Youth Trips accountable for any injuries incurred during the trip or while participating in the Activity.
Photography Release
I understand that participating in a trip with Illuminate Youth Trips may result in photography, video, or other media featuring me or my attending family members. This media may be used by Illuminate Youth Trips for promotional purposes, including use on Illuminate Youth Trips’s social media, website, and marketing materials. I hereby give and grant Illuminate Youth Trips the right and consent to use, publish and copyright my likeness, performance, voice and identity, in still and/or motion picture photography taken on the Activity, for any and all purposes, including, without limitation, trade, commercial and editorial usage in any medium now known or later developed anywhere in the world without compensation. I agree that if I have special circumstances regarding this use I will contact Illuminate Youth Trips at hello@illuminatetrips.com.
Personal Information
I understand that my name, email, and phone number will be shared with other members of the group in order for Illuminate Youth Trips to organize the group in preparation for the trip and to contact the group while traveling. I hereby consent to Illuminate Youth Trips gathering, storing and using my information on such a basis. I hereby consent to be contacted via text and cell phone, including by other Activity participants. If I become concerned in any way about this, I will immediately contact Illuminate Youth Trips.
Safety; Misconduct
While participating in the activity, I will not go anywhere alone away from the Illuminate Youth Trips. I will stay in a group of at least three or more. I will make sure my travel leader knows where I am at all times.
I understand that while traveling in another country many rules, laws, and customs are different than in the United States. I understand that possession of, or involvement with, any illegal drugs is prohibited. I understand that if I am arrested or detained by foreign authorities while participating in the Activity, I should not expect assistance from the U.S. government or Illuminate Youth Trips.
I acknowledge that in the event of misconduct while participating in the Activity, I or any of my Registered Parties will be immediately dismissed from the activity. Should I be sent home early, I understand that I would be responsible for bearing travel costs to return home, in addition to forfeiting trip fees paid to Illuminate Youth Trips.
Waiver and Release of Liability
PLEASE READ THE FOLLOWING PROVISIONS CAREFULLY AS THEY INCLUDE A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVE YOU AND YOUR REGISTERED PARTIES OF THE ABILITY TO SUE CERTAIN PARTIES. YOU SHOULD NOT EXECUTE THIS AGREEMENT UNLESS YOU HAVE READ AND UNDERSTOOD IT IN ITS ENTIRETY.
Acknowledgement
I acknowledge and agree that the Activity carries certain inherent dangers and risks which may or may not be readily foreseeable, including without limitation personal injury, property damage or death. I acknowledge and agree that my ability to participate with Illuminate Youth Trips and in the Activity is subject to my agreement to the waiver and release of liability in this Agreement. I understand that Illuminate Youth Trips cannot guarantee that I or any of the other Registered Parties will not be injured or be exposed to risk or any disease while participating in any Activity. I AND MY REGISTERED PARTIES ARE VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF SUCH RISK.
On behalf of myself and registered Minors, assigns, heirs, and executors (collectively, the “Releasors”), I hereby expressly release, waive, discharge, and covenant not to sue Illuminate Youth Trips or any affiliate thereof, any sponsor or co-sponsor, including their officers, directors, and employees, their subsidiaries and/or related companies or individuals related to the Activity (collectively, the “Illuminate Youth Trips Parties”) for any losses or damages on account of injury to any Releasor, any property damage, or the death of any such Releasor, whether caused by the active or passive negligence of all or any of the Releasors or otherwise, in connection with any Releasor’s participation in the Activity.
The Releasors hereby assume all risks of losses, damages, or injuries that may be sustained while participating in the Activity.
Force Majeure
If the Activity is delayed or prevented by reason of fire, threatened or actual strike, labor difficulty, work stoppage, insurrection, war, public disaster, flood, unavoidable casualty, bus failure, disease, health conditions, pandemics, governmental actions, acts of god or the elements (including but not limited to hurricanes, tornadoes, earthquakes), or other causes beyond the control of Illuminate Youth Trips, there shall be no refund of the deposit fee, trip fee, or any other costs paid by the participants in connection with the Activity.
Waiver
I understand that portions of the Activity may be held in places where hazards are to be expected. Participation carries with it certain inherent risks that cannot be eliminated completely, ranging from minor injuries to catastrophic injuries including death. I understand and agree that in consideration of being permitted to participate in the Activity, I and any Registered Party, and our respective heirs, personal representatives or assigns, do hereby release, waive, discharge and covenant not to sue Illuminate Youth Trips for any and all liability from any and all claims arising from participation in the Activity.
Indemnification.
I agree to indemnify and hold harmless Illuminate Youth Trips and the Illuminate Youth Trips Parties from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorneys' fees, fees, the costs of enforcing any right to indemnification under this Agreement, and the cost of pursuing any insurance providers, incurred by Illuminate Youth Trips and the Illuminate Youth Trips Parties arising out of or resulting from any claim of a third party related to my participation in the Activity, including any claim related to my own negligence or the ordinary negligence of the Company.
Applicable Law; Consent to Jurisdiction.
Illuminate Youth Trips is formed in Utah and operates from its offices within the state of Utah, United States of America. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the state of Utah without giving effect to any choice or conflict of law provision or rule (whether of the state of Utah or any other jurisdiction). Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Salt Lake County, State of Utah. Each party hereby consents to the exclusive jurisdiction of such courts.
Severability
If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.
Entire Agreement
This Agreement constitutes the sole and entire agreement of Illuminate Youth Trips and the undersigned participant with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.
Electronic Signatures
This Agreement may be executed by the manual or electronic signature of a party. Each party agrees that the electronic signatures of the parties included in this Agreement are intended to authenticate this writing and to have the same force and effect as manual signatures, to the extent and as provided for under applicable law, including the Electronic Signatures in Global and National Commerce Act of 2000 (15 U.S.C. §§ 7001 to 7031) and the applicable Uniform Electronic Transactions Act, as amended or substituted.
