Please read and understand this document before signing. You are giving up specific legal rights for you, your family and your heirs by signing this contract. We wish to inform our guests that participation in activities in the Arctic wilderness including organised sightseeing tours and other outdoor activities are not risk free. The same elements that contribute to the unique character and fun of guided tours, such as the physical exertion or the settings, can cause loss or damage to equipment, injury, illness, or in extreme cases, permanent trauma, or death. We do not want to heighten or reduce your enthusiasm for the experience, but we do want you to know in advance what to expect, and to be informed of the possible risks. PANDEMIC AND GLOBAL OUTBREAKS I am fully aware of the possibility of a virus outbreak, the current travel restrictions, and inherent risks involved when choosing to travel. I am aware of my personal decision to travel and am doing so with full knowledge of travel recommendations, restrictions, regulations, and risks with regards to a pandemic such as Covid-19, as well as the possibility of future travel restrictions. I take full responsibility for actions with regards to traveling and, I accept ultimate responsibility for myself. Moreover, I understand that I am responsible to purchase travel insurance, that covers Covid-19 related claims. I acknowledge the contagious nature of a worldwide pandemic such as Covid-19 and voluntarily assume the risk that I may be exposed to or infected by a variant of Covid-19 while traveling. Such exposure or infection may result in personal injury, illness, permanent disability, and possible death. I voluntarily agree to assume all the foregoing risks and accept sole responsibility for any injury to myself illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or could incur in connection with Northern Norway Travel AS. As the worldwide Covid-19 corona-virus pandemic remains ongoing at this time, I acknowledge that for this reason, booked tours with Northern Norway Travel AS may be interrupted or cancelled by Northern Norway Travel AS, a government entity, or other third party over which Northern Norway Travel AS has no control. SAFETY ON TOUR I acknowledge my obligation to always comply with Norwegian laws and regulations during the tour, and to apply due diligence and care in order to maintain and promote or, at a minimum, not jeopardize, my own safety and the safety of the other customers on the tour. Verbal or otherwise any type of assault against Northern Norway Travel AS employees or other customers will grant immediate withdrawal of the admission to the tour and any costs related to the safe return of the assaulter will be arranged by the company at the assaulter’s expense. Northern Norway Travel AS organises the tour to ensure that the company’s employees who participate in the tour perform their work in a manner that protects the company and its customers from environmental, health, and safety risks, minimizing our impact on the environment. The weather often changes quickly in Northern Norway and with it, conditions change. Our guides are specially trained to deal with changing conditions and their number one priority is to make decisions with your safety in mind. Please be aware of this and respect your guide’s authority to do so. All adventure trips and outdoor activities are dependent on weather and general conditions. Northern Norway Travel AS reserves the right to alter routes, itineraries, departure times and or cancel your trip without prior notice with your safety in mind, should the necessity arise. Exposure to outdoor elements, including but not limited to inclement weather, snowstorms, ice, wind, cold temperature, or weather conditions. Customers are to assume the conditions may be cold and the walking surfaces slippery, uneven, unstable, or otherwise. Northern Norway Travel AS cannot be held responsible for any loss, damage, accident, injury, sickness, schedule change or other factors due to weather, natural disasters, or any other cause beyond Northern Norway Travel AS control. By accepting these terms of service, you understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. I acknowledge that I may have to exercise extra care for my own person and for others around me in the face of such hazards. HEALTH The Customers acknowledges his or her obligation to notify Northern Norway Travel AS about any health issues, including current medication, if any, which may affect the personal safety of The Customers or the safety of other customer s in the tour. The client acknowledges their ability to cope with the physical challenges that the tour may pose, especially in the light of their own personal fitness level and medical history. I acknowledge the current Covid-19 rule, and fully understand that I must cancel my booking and stay at my accommodation if I am felling unwell/ have newly-arisen respiratory tract symptoms (fever, cough, difficulties in breathing, headache, lethargy, loss of sense of smell and taste, muscle aches, sore throat, etc.). Furthermore, I fully understand that I should be tested for coronavirus and quarantine until I receive negative results. EQUIPMENT Any loss or damage to our equipment (thermal suit, tripod, camera equipment etc.) as a result of The Customers’s wilful or negligent actions will be charged to The Customers’s credit card used in the booking. Northern Norway Travel AS provides transport in most instances for a tour, and damages to the company’s vehicles arising out of or in connection with The Customers ’s wilful or negligent actions will be billed to The Customers. PRODUCTION OF PHOTOGRAPHIC MATERIAL DURING THE TOUR The Customers provides free, global and irrevocable consent to the use of the images taken during the tour, including their use for advertising and promotional purposes in any media chosen by Northern Norway Travel AS. All the photos provided to The Customers by Northern Norway Travel AS will remain the company’s intellectual property exclusively. The Customers is allowed to use and print them for private use only, strictly excluding commercial use, and to share them on social media and photo sharing platforms. PERSONAL DATA The purpose of handling The Customers’s personal data is for Northern Norway Travel AS to be able communicate with The Customers before and after the tours and access needed information relevant for the tour The Customers has booked. In addition, the use of existing customers’ personal data is aimed at direct marketing of services and products of Northern Norway Travel AS. Personal data to be processed using its Customer Register, the Company processes the following Personal Customer Information: - customer’s name
- customer’s contact information (e-mail address, address and telephone number)
- credit card information related to the payments made
- customer’s health related information (if provided by The Customers, non-obligatory for booking)
- country of origin/residence
CANCELLATION POLICY Private and tailormade tours / packages The Customers will receive full (100%) refund for all cancellations of inhouse services made 14 days prior to the tour date. No refund for cancellations will be made less than 14 days prior to the tour date. Modifications can be requested up to 48 hours before a trip, however, the possibility to modify the tour depends on availability of resources. A minimum deposit of 30% is required and needs to be paid 14 days after confirmation. For tours including partners’ services, a free cancellation is possible up to 30 days prior to arrival. If partners’ services are cancelled 30 days prior to arrival The Customers will receive the corresponding refund minus 12%. Changes of private and tailormade tours must be confirmed and agreed in written from the Supplier. Guaranteed departures The Customers will receive a full (100%) refund for all cancellations made 48 hours prior to activity start. No refund for cancellations will be made less than 48 hours prior to the start of the activity. No Show or missed tours Please note The Supplier is not offering any refunds or any type of reimbursement for extra costs due to “no-shows”. Not showing up and/or coming too late (after the tour departure time) is not considered a reason for refund and is paid full price. In case Guests miss the departure time, they are responsible for any costs occurred for acquiring transportation to the activity. Transportation The Customers will receive a full refund for all cancellations made 48 hours prior to departure. No refund for cancellations will be made less than 48 hours prior to departure. Right to cancel trips The Supplier may cancel trips for the following reasons: - If the minimum amount of 4 participants is not met Suppliers’ guaranteed departures
- If there are events of Force Majeure
- If weather conditions make it unsafe to run the tour
The Supplier shall notify The Customers of the cancellation as soon as possible. If a trip is cancelled, The Customers is entitled to a full refund of the ticket price (if the ticket was paid for in advance). The Customers cannot claim any form of compensation over and above this unless The Customers has incurred losses as a result of gross mistakes on the part of the Supplier. GENERAL PROVISIONS Each activity sold by the Northern Norway Travel AS and operated by a partner provider may be regulated by their own terms and conditions and will bind The Customers and the partner provider. For the avoidance of doubt Northern Norway Travel AS acts strictly on an agency basis only when selling activities operated by the partner provider and will not be a legal party in those terms and conditions. By accepting these terms of service you agree that to the fullest extent allowed by law, you will not institute any lawsuit or other legal action against Northern Norway Travel AS, its officers, directors, delegates, employees, staff, instructors, agents, representatives, servants, or assigns and all organizations and individuals assisting in promoting, conducting or otherwise affiliated with the activity as a result of my participation. By accepting these terms of service you hereby release and hold harmless with respect to any and all injury, disability, death, or loss or damage to person or property, whether caused by negligence or otherwise, the following named persons or entities, herein referred to as releases: Northern Norway Travel AS. To release their officers, directors, employees, representatives, agents, and volunteers, and vessels form liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releases or otherwise. By signing this document, I agree to hold the releases harmless and indemnify them in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities. By signing below, I hereby agree to hold Northern Norway Travel AS harmless and release the agency from any liability for any damages, including but not limited to monetary losses, I may incur as a result of such interruption or cancellation of these travel plans.
