Waiver

A completed waiver by a parent/guardian is required for all minors ("Child") to enter and/or participate at The Kids Social Club, LLC ("The Kids Social Club").

As parent or legal guardian of the child whose name is set forth below (who is referred to herein as the "Child") and in consideration of the Child being permitted to participate in the Activities (as defined below) conducted by The Kids Social Club, LLC ("The Kids Social Club"), the Child and I agree as follows:

In consideration of being allowed to enter and/or participate in any "Activities" at The Kids Social Club ("Premises"), the undersigned acknowledges, understands and agrees to the following:

COVID 19 Warning

I acknowledge the contagious nature of the Corona Virus/Covid 19 virus and that the CDC and other public health authorities still recommend practicing social distancing. 

I further acknowledge that The Kids Social Club, LLC. Has put in place preventatives measures to reduce the the spread of the Corona Virus/COVID 19. 

I further acknowledge that The Kids Social Club cannot guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, playground staff, and clients and their families.

I voluntarily seek services provided by The Kids Social Club LLC and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending the facility. 

I attest that:

  • I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
  • I have not traveled internationally within the last 14 days.
  • I have not traveled to a highly impacted area within the United States of America in the last 14 days.
  • I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
  • I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by state or local public health authorities.
  • I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.

SECURITY CAMERAS.

I understand that security cameras installed around and within The Kids Social Club LLC facility are for the safety of all participants and may be referenced should any incidents or injury occur.

I hereby grant permission to The Kids Social Club LLC to use photos/videos of me and my child in social media publications. 

I am the custodial parent or legal guardian of the Child or have obtained parental authorization to act on their behalf with respect to the Child for the purpose of executing this agreement.

I acknowledge that all applicable rules for participation must be followed and I assume sole responsibility for the supervision and personal safety of the Child.

I understand that The Kids Social Club management may refuse the Child's participation in Activities for any reason, including, but not limited to:

  • Failure by me or the Child to follow the The Kids Social Club rules
  • My failure to remain on the Premises during the Child's participation in the Activities
  • My failure to adequately supervise the Child or to ensure that the Child is adequately prepared for safe participation in the Activities
  • The Child's suffering from an illness or ailment of any kind that may impair his or her continued participation in the Activities or that may be contagious or potentially harmful to others on the Premises. 

I hereby grant The Kids Social Club permission to take photographs of myself and/or the Child while on the premises both indoor and outdoor and allow lawful use of these photographs and/or video including but not limited to: media, marketing, publicity, copyright purposes, illustration, advertising, social media and web content.

ACTIVITIES: The Child will participate in various activities offered by The Kids Social Club, LLC including but not limited to, the following: The all-inclusive use of the entire The Kids Social Club facility including the fully equipped play center and/or the participation in any party, event or program activity at The Kids Social Club.

MEDICAL PERMISSION AUTHORIZATION - If the Child is of minority age, the undersigned parent or guardian hereby gives permission for The Kids Social Club, LLC staff to authorize emergency medical treatment as may be deemed necessary for the Minor named below while participating at The Kids Social Club Activities, and hereby relieve The Kids Social Club from all liability arising as a result of this medical authorization.

ASSUMPTION OF RISK - Participation in the Activities carries with it certain inherent risks which cannot be eliminated regardless of the care taken to avoid injuries. The specific risks may range from minor scratches, bruises and sprains to more serious injuries including disability and death. Notwithstanding these risks and other hazards that may be foreseeable but not specifically identified herein, I, for myself and the Child and our respective heirs, personal representatives and assigns, understand, acknowledge, and expressly and voluntarily assume all risks and full responsibility for any injury to Child or myself, and expressly and arising out of or related to the Activities. I hereby irrevocably waive, release and fully discharge The Kids Social Club from any and all liability for loss, damage, personal injury, including death and disability, and costs of any kind and nature whatsoever which I or the Child may suffer now or in the future by reason of or existing out of any causes whatsoever related to or arising out of or from the participation of the Child in the Activities or presence of the Child on the Premises.

INDEMNIFICATION and HOLD HARMLESS - I agree to indemnify and hold The Kids Social Club, LLC harmless from, without limitation, any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney's fees and costs, incurred due to claims brought by any third party as a result of or arising out of the Child's and/or my own involvement in the Activities and to reimburse The Kids Social Club for any such costs, expenses and fees as they are incurred.

RELEASE, DISCHARGE, AND AGREEMENT NOT TO SUE - I, for myself and the Child and our respective heirs, personal representatives and assigns, do hereby release, discharge and agree not to sue The Kids Social Club and its managers, members, employees and/or other agents, for any injury to or death of the Child or myself arising, directly or indirectly, from participation in the Activities. This release, discharge and covenant not to sue shall relate to any and all claims or legal rights now existing or arising in the future, including claims and legal rights arising out of any negligence of The Kids Social Club and/or its managers, members, employees and/or other agents and any other breach of a legal duty arising out of common law, statute, contract or otherwise.

SEVER-ABILITY - This document is intended to be as broad and inclusive as is permitted by the laws of the State of Florida and if any provision (or a part of any provision) contained herein is deemed to be invalid, the balance of the provisions shall continue in full legal force and effect, notwithstanding such invalidity.

I HAVE READ THIS AGREEMENT THOROUGHLY. I UNDERSTAND THAT, BY SIGNING THIS AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I, THE CHILD, AND OUR RESPECTIVE HEIRS, ASSIGNS, EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN MAY HAVE AGAINST THE RELEASEES, INCLUDING THE RIGHT TO SUE. I SIGN THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT.
