Umpire Agreement/Contract

This agreement/contract is between the umpire NAMED BELOW and SandS Cricket Association.  I the undersigned umpire, acknowledge, agree, understand and certify that: 1) I have voluntarily, and of my own free will, elected to participate as an umpire. 2) My participation as an umpire does not create any kind of employer/employee relationship between SandS Cricket Association and me (below named umpire). My participation as an umpire is solely as an independent contractor. 3) I will abide by and enforce the SandS Cricket Association (SCA) bylaws.

INDEPENDENT CONTRACTORS
I understand that as an Umpire I am not an employee of SCA.  I am working as an independent contractor.

ASSIGNMENTS
He/she will be compensated for the umpired games.   Umpire agrees to abide by all rules, regulations. laws, policies and ordinances set forth and made known to the umpire whether verbally or written.  SCA will not be withholding taxes or deducting for social security, unemployment, disability insurance, health insurance or any other employee benefits from the Umpire compensation.  Umpire is responsible for paying all applicable taxes, fees and contributions.

INSURANCE
Umpire understands that he/she is not an employee of SCA and he/she is responsible for carrying his/her own health, workers compensation, disability and liability insurance.

EQUIPMENT
Umpire agrees to appear for each and every assignment accepted under the terms of this agreement/contract with his/her own agreed uniform. The umpire hereby agrees that as an independent contractor he/she shall maintain his/her own uniform.

TERMS OF CONTRACT
This agreement/contract must be signed and registered with SCA prior to accepting any assignment being offered.

The umpire agrees to be present and available 30 minutes prior to the start of any game.  The Umpire also agrees that before or during the day of the assignment he/she is not to consume any alcoholic beverage or take any narcotics.  Any violation of this clause shall result in an immediate termination of this contract and no fee/compensation will be due to Umpire.

LIMITATION OF LIABILITY
In case of a dispute SCA liability is limited under this contract and will not exceed $50 including all costs and expenses.

INDEMNIFY
In an event a claim is filed by a third party, the umpire agrees to hold SCA harmless and agrees to pay any third party claim, costs and expenses.

ENTIRE AGREEMENT/CONTRACT
I voluntary accept and solely assume all damages, all injuries  including death incurred or suffered by me while participating as an umpire and I therefore release, discharge and agree not to sue SCA and their owners, officers, agents, directors, associations or employees . Any claim current or in the future as a result of injuries or damages sustained or incurred by me from whatever the cause while participating as an umpire, including by not limited to negligence breach of contract or other wrongful conduct omissions by the parties hereby released.  This agreement supersedes all previous agreements oral or written between SCA and Umpire, and represents the whole and entire agreement/contract between the parties. No other agreement/contract or representations oral or written have been made by the SCA and the Umpire.  This agreement/contract cannot be altered, modified or amended except in writing, by an authorized agent of the SCA and the Umpire.  This agreement shall be covered by all the laws of the State of California.  By PLACING MY SIGNATURE BELOW, I ACKNOWLEDGE THAT I HAVE READ AND THAT I UNDERSTAND EACH AND EVERY ONE OF THE ABOVE PROVISIONS AND AGREE TO ABIDE BY THEM.
