Swoop II Party Boat

 

In consideration of Wheeler Marine, LLC or its affiliates (together, "Operator") allowing the undersigned to board SWOOP II Party Boat or any other charter boat operated by Operator (which, with its equipment, is called the "Boat") for transit or fishing, the undersigned hereby releases, and agrees to indemnify, Operator, its shareholders, affiliates, officers, directors, employees and agents (collectively, the "Released Parties"), from any and all present and future liability and claims (and costs of defense including attorneys' fees) resulting from, or connected with, the use, operation, or boarding of the Boat on the date hereof or any future dates, including but not limited to:

I. The negligence or misconduct of the Released Parties.

II. Any loss or damage of personal property, personal injury, or death.

III. Any activities incidental to the boarding and use of boat, wherever, whenever, or however the same shall occur, including resulting from actions or inactions of the Released Parties or other guests of the Boat.

I have read the above release, waiver of liability, and indemnity agreement and understand that by signing it I give up substantial rights I would otherwise have to recover damages for losses and sign it voluntarily and without inducement.

I am aware that my picture could be taken, and I allow Swoop II to take my picture and post it online for social media and website purposes.
