SHOOTING RANGE WAIVER, RELEASE OF LIABILITY, AND ASSUMPTON OF RISK IN CONSIDERATION OF BEING ALLOWED TO USE THE SHOOTING RANGE LOCATED ON THE REAL ESTATE OWNED BY OKEECHOBEE SHOOTING SPORTS & RANGE LANE RENTED BY RPG CUSTOMS LLC.

YOU ARE ASKED TO WAIVE YOUR RIGHTS RELATED TO ORDINARY NEGLIGENCE ISSUES.

I HEREBY: [Initial before each number]


1. Fully understand and appreciate the dangers, hazards, and risks inherent at a firing range, including the inherent risks associated with the use and misuse of firearms.


 2. Acknowledge and understand that I will be voluntarily engaging in activities that involve the discharging of firearms which may result in the risk of serious injury, scarring, loss of an important bodily function, permanent disability, or death, and may cause severe social or economic losses due to not only my own actions, inaction or negligence, but also to the action, inaction or negligence of others or conditions of the premises or of any equipment used. Further, I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time.


 3. Assume all the foregoing risks and accept personal responsibility for the damages following such injury, permanent disability, or death.


 4. Release from, waive and discharge all actions, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or hereafter have for damage or losses on account of injury, including permanent disability and death or damage to property, caused or alleged to be caused in whole or in part by the negligence or other acts of RONALD R GILLETTE or RPG CUSTOMS LLC., and its shareholders, directors, officers, employees or agents, as a result of my participation in any gun-related activities. I hereby agree and covenant to save and hold harmless, indemnify, and defend any claim against RONALD R GILLETTE or RPG CUSTOMS LLC., and its shareholders, directors, officers, employees or agents, as a result of my participation in any gun-related activities. I hereby agree and covenant to save and hold harmless, indemnify, and defend any claim against RONALD R GILLETTE or RPG CUSTOMS LLC., and its shareholders, directors, officers, employees or agents, arising out of my use of the firing range.


 5. Agree to comply with all Florida State laws regarding the use and possession of firearms.


 6. [Parents of minors only] Agree (if a Parent(s) or legal guardian(s) of minor participants (age 17 and below)) to instruct the minor participant to the above warnings and conditions and their ramifications, and consent to the minor’s participation. If I am signing for a minor I have full legal authority to sign as their guardian and waive their rights. Further more if there is a challenge to my right/s as legal guardian authority I will pay for any expenses including legal fees Involved in any lawsuit or action that may arise.


 6a. If I am a minor under the age of 18 years old I will not handle any firearm/s without explicit instruction/s and supervision by the Range Safety Officer and/or a representative of RPG CUSTOMS LLC., and its shareholders, directors, officers, employees or agents.


 7. I am not under the influence of drugs or alcohol. I will not use drugs or alcohol while handle firearms or participating in the shooting sports.


 8. I am lawfully permitted to possess and handle a firearm/s. I have not been convicted of a felony or domestic violence.


 9. I am not depressed or having suicidal or homicidal thoughts nor have I made plans to carry out an act of suicide or homicide.


 10. I understand any firearm/s provide for use by RPG CUSTOMS LLC., are not permitted to leave the property or be used in a manner other then what was specified at the time of rental/use.  And all said firearm/s are in proper working order to best of RPG CUSTOMS LLC., and its shareholders, directors, officers, employees or agents knowledge.


 11. I understand that  I am responsible for any damage to myself, property or persons by my use or misuse of any firearms or actions while on site of Okeechobee Shooting Sports, LLC.


 12. I understand that these risks, hazards, and dangers include without limitation:

The risks of handling firearms and being near other that have firearms in their possession.

The risk of ear damage from noise. The risk of injury from ammunition, target pieces and shot from other guns. Ricochets from targets or projectiles. Inclement weather conditions and animals or insects found on or near the range or in the wild. The risk of damage to property by others flying debris or projectiles. If I do not understand a range rule or procedure or feel there is a safety risk to myself or other I will notify a Ranger Safety Office immediately.


 13. Any and all firearm/s brought on to the range by any & all participants are to be in proper working order and proper ammunition for said firearm/s to be used at all times, and that RONALD R GILLETTE or RPG CUSTOMS LLC., and its shareholders, directors, officers, employees or agents can/will at anytime ask a participant to safely unload and remove any firearm/s from the range without explanation or compensation, That RONALD R GILLETTE or RPG CUSTOMS LLC., and its shareholders, directors, officers, employees or agents feel are unsafe or being mishandled and/or misused. Furthermore no participant shall hold RONALD R GILLETTE or RPG CUSTOMS LLC., and its shareholders, directors, officers, employees or  agents liable for any damages including death cause by participants own personal, rented firearm/s.

I HAVE CAREFULLY READ THE ABOVE WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT AND I DO SIGN IT VOLUNTARILY. I AGREE TO PARTICIPATE KNOWING THE RISKS AND CONDITIONS INVOLVED AND DO SO ENTIRELY OF MY OWN FREE WILL. I ACKNOWLEDGE RECEIVING A COPY OF THE RULES AND REGULATIONS OF THE FIRING RANGE AND AGREE TO ABIDE BY THEM.

Range rules

All visitors must read and abide by the General Range Rules of Okeechobee Shooting Sports and RPG CUSTOMS LLC.

  • No open toed shoes.
  • Eye and ear protection must be worn at all times near any shooting area.
  • All actions must be kept open unless on the firing line and the range is hot.
  • No loaded firearms behind the firing line or while people are down range.
  • All firearms must be pointed in a safe direction at ALL TIMES whether transporting them to the firing line or on the firing line.
  • All firearms are subject to inspection at any time by RSO.
  • A Range Safety Officer (RSO) must be present at all times.
  • If an RSO is not present, please notify RPG CUSTOMS LLC at 561-603-3905.
  • Only use the range designated for your course of fire.
  • Be courteous and aware of shooters around you and on other ranges.
  • Notify your RSO or range staff of any unsafe firearm handling or behavior.
  • If you have any questions or are unclear about any safety procedures, please speak with range staff prior to handling any firearm.
  • Be absolutely sure of what is behind your target and where your bullets will be going after they have hit or passed through their intended target or if they miss the intended target!
  • If a bullet goes over the berm, or if you have an accidental discharge, you will not be permitted to shoot the rest of the day.
  • No firing from the hip on any range.
  • Yes, you can bring your own ammo! However, make sure the ammunition you intend to use is permitted on the range you intend to use it on. And is the correct caliber/type for your firearm.
