Participation Agreement

In consideration of being permitted to utilize the facilities, services and programs of Schutt Performance & Fitness, LLC  for any purpose including, but not limited to, observation or use of the facilities or equipment, or participation in any Schutt Performance & Fitness, LLC program (the “Activities”) on or off-site at the Yorkville Christian High School gym and facilities, the undersigned hereby agrees for him/herself and for any minor child for which this adult seeks participation (the “Participants”) as follows:

INFORMED CONSENT/ASSUMPTION OF RISK:

Participants understand that the Activities provided by Schutt Performance & Fitness, LLC will include activities with risks that are inherent in the field of personal training and sports performance training and cannot be eliminated without destroying the unique character of the activity and which could result in injury or illness to Participants.  Participants hereby certify that they know of no medical problems or allergies that would increase Participants’ risk of injury or illness as a result of participation in the Activities. Participants acknowledge Schutt Performance & Fitness, LLC  informed them that there exists the possibility of adverse physical effects including, but not limited to, sprains/strains or possible fractures of the ankles, knees, low back, jammed or pinched fingers, rope burns, calluses, muscle strains, and other serious health risks including death, arising from focused and intense physical training, and Participants fully understand the same.


With Participants’ full understanding of the above information, Participants chose to participate in the Activities and agree to assume any and all risk associated with participation in the Activities.  Participants also assume the risk of loss for any items of personal property brought by Participants to the Activities. 


RELEASE:

In full consideration of the above mentioned risks and hazards and in full consideration of the fact that Participants are willingly and voluntarily participating in the Activities, and with full understanding of all of the above, Participants hereby waive, release, remise and discharge Schutt Performance & Fitness, LLC and all parties associated with Yorkville Christian High School and  their  affiliates, agents, officers, principals and employees, contractors, and volunteers (“Releasesees”), of any and all liability, claims, demands, actions or rights of action, or damages of any kind related to, arising from, or in any way connected with, participation in the Activities, including those allegedly attributed to the negligent acts or omissions of the Releasees. This Agreement shall be binding upon Participants, their successors, representatives, heirs, executors, assigns, or transferees. If any portion of this Agreement is held invalid, Participants agree that the remainder of this Agreement shall remain in full legal force and effect. 


INDEMNIFICATION:

Participants further agree to indemnify and hold harmless the Releasees from liability for the injury or death of any person(s) and damage to property that may result from Participants’ negligent or intentional act or omission while participating in Activities.  Should the Releasees, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this Agreement, I agree to reimburse them for such fees and costs.


MEDICAL AUTHORIZATION:

If Participant is signing for a minor child, he/she hereby gives full permission for any person connected with Schutt Performance & Fitness, LLC  to administer first aid deemed necessary, and in case of serious illness or injury, Participant as parent or legal guardian gives permission to call for medical and or surgical care for his/her child and to transport the child to a medical facility as deemed necessary. 


MEDIA AUTHORIZATION:

Participants agree to allow Schutt Performance & Fitness, LLC  the use of picture(s), film, video, voice recordings, and/or likenesses of Participants for performing the Activities and for advertising the Activities.  Participants acknowledges that if there is any exception to this authorization, Participant will notify Schutt Performance & Fitness, LLC  in writing, prior to that Participant’s first day of participation in the Activities.


I have fully read and fully understand the foregoing assumption of risk, release of liability, indemnification and authorization and I understand that by signing this document, I am obligated to indemnify the parties named for any liability for injury or death of any person and damage to property caused by the negligent or intentional act or omission by me or my child. I understand that by signing this form I am waiving valuable legal rights.
