In consideration of my use of, and/or presence in, the shooting range and facilities (“Range”) operated by Wista Inc. d/b/a King Shooters Supply, at 346 East Church Road, King of Prussia, PA 19406 (“KSS”) to engage in and/or observe shooting and other activities, I – on behalf of myself and my heirs, next of kin, executors, administrators, guardians, representatives and assigns (collectively referred to hereinafter in the singular as “I”) – agree to this Eligibility Representations, Assumption of the Risk, Waiver, Release, Discharge, Indemnification and Hold Harmless Agreement (“Representations and Agreement”): I have been provided, reviewed, and agree to follow the Range Safety Rules at all times. I acknowledge that I can legally possess or rent a firearm, under penalty of law and perjury. I am physically and mentally competent and able to possess and discharge firearms. I am familiar with the safe use of all firearm(s) that I may possess and use while at the Range. I am not under the influence of alcohol or drugs. I will not use Range practice or training for misconduct with, or inappropriate use of, a firearm. I understand and acknowledge that my use of, and/or presence in, the Range involves inherent and extreme hazards, dangers and risks that may cause death and serious personal injury. These include, but are not limited to, the possibility of being shot by another person on the Range, being struck by ricocheting bullets, ejected cartridge cases, and/or debris from the catastrophic failure of a firearm, the inhalation of lead particles and toxic gasses, exposure to communicable diseases, harm to an unborn child including lead poisoning and noise level impacts, and possibility of a “slip and fall.” I acknowledge that this is not a complete list, and that the above and similar risks cannot be eliminated. I nevertheless freely and voluntarily agree to assume the risk of any and all injuries and damages that may be sustained as a result of the use of, and/or presence in, the Range. I expressly waive, release and discharge KSS and its owners, officers, directors, partners, agents, employees, volunteers, insurers, brokers, assigns and all other related persons, entities, affiliates, predecessors, and successors (“Released Parties”), from any and all claims and causes of action whether in law or equity, demands, rights, damages, costs, loss of services, expenses, compensation or liability of any kind whatsoever arising from any damage (including death, personal injury and property damage) sustained in connection with the use of, and/or presence in, the Range. This waiver, release and discharge provision applies even to claims arising from the negligence (including gross negligence) of the Released Parties in connection with my use of, and/or presence in, the Range, whether based on acts or the failure to act, including, but not limited to, failing to render aid and/or notify authorities if I am injured while using and/or present in the Range. I agree to defend, indemnify, and hold harmless the Released Parties from any claims or lawsuits arising from my use of, and/or presence in, the Range. If I file a lawsuit or court proceeding of any kind against the Released Parties to which this Agreement applies, I agree that I shall pay all costs and expenses (including reasonable attorney fees) incurred by the Released Parties in defending against such lawsuit or court proceeding. I agree to pay KSS for any damage caused to the Range and/or any rental firearms, whether intentionally, willfully, knowingly, recklessly, negligently or without fault, including, but not limited to, damage caused using prohibited armor piercing, steel core, incendiary, tracer, steel or aluminum cased ammunition, or unsafe reloaded ammunition. If KSS is required to file a lawsuit to collect such damages, I agree to pay all costs and expenses (including reasonable attorney fees) incurred by KSS in connection with such lawsuit. I agree that the foregoing shall be construed pursuant to the laws of the Commonwealth of Pennsylvania without regard to its conflict of law rules. Any litigation related to this Agreement shall be filed exclusively in a federal or state court located in Montgomery County, Pennsylvania. Argumentative or disruptive behavior will result in your expulsion from the range.
Any unsafe behavior will result in immediate dismissal from the premises.
All firearms must enter and leave the range unloaded and cased; case and uncase on the bench in the Shooting Booth only with the muzzle always pointed downrange.
Firearms are to be handled in the Shooting Booth only, with muzzle always pointed downrange.
Do not fire at anything except the target in your lane. All rounds must impact the rubber backstop. Any damage to the range or any operating components will be assessed to the shooter.
Always keep your firearm unloaded until you are in the Shooting Booth and are ready to fire.
Always keep the action of your firearm open when you are not firing.
Firearms are not to change lanes; the shooter may change lanes.
Eye and ear protection are required at all times in the range.
No person who is a Prohibited Person (per the ATF and PA State Police) can be on the premises for any reason.
Drawing from a holster is not permitted.
All shooting is to be done from the bench; all benches must be locked in the shooting position before any lane can be used.
If you have any malfunctions or issues that need assistance, leave your firearm on the bench with muzzle pointed directly downrange and use the call button or come find the Ranger Officer.
Only one loaded gun is allowed on the bench at a time.
Maximum two (2) people per lane, only one (1) person firing.
No private for-hire instruction is permitted.
No tracers, armor piercing, incendiary rounds, black powder or substitutes. Single projectiles only. No Muzzleloaders, No Black Powder Firearms nor equivalents. No Fully Automatic Fireams or any device that simulates automatic fire including bump fire, slide fire, gatling trigger devices, Binary Triggers such as the Echo Trigger or Forced Reset Triggers, of any name or kind.
No targets may be engaged closer than the three (3) yard line.
All long guns and all firearms with a brace must engage the target at the furthest distance; all rifles must have sights and sights must be used.
All firearms and ammunition are subject to approval.
No refunds or credits for any expulsions. Range Officer has final authority on all expulsions.
Clean up after yourself, including your brass, target, and trash. Leave your area ready for the next shooter. No Food, No Drink, No Smoking, No Cell Phone Use, No Recording of any Kind. I have been provided, reviewed, and agree to follow the Range Safety Rules at all times. Initial: _____ |
