AGREEMENT & RELEASE OF LIABILITY
I HEREBY ACKNOWLEDGE that as a member of the Fox Valley Snowdrifters Ski Club, I have voluntarily applied to participate in the Snowdrifters’ activities and events which may include but are not limited to ski trips, other sporting activities, club events, dinners, and club meetings. I AM AWARE THAT SKIING AND OTHER CLUB FUNCTIONS CAN BE HAZARDOUS ACTIVITIES, AND I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE' DANGER INVOLVED AND HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH.
AS LAWFUL CONSIDERATION for being permitted by Fox Valley Snowdrifters Ski Club to participate in these activities and use their facilities, I hereby agree that I, my heirs, distributees, guardians, legal representatives and assigns will not make a claim against, sue, attach the property of, or prosecute Fox Valley Snowdrifters Ski Club for Injury or damage resulting from the negligence or other acts, however caused by, any officer, agent, representative, or member of Fox Valley Ski club, as a result of my participation in skiing or other club activities. In addition, I hereby release and discharge Fox Valley Snowdrifters Ski Club from all actions, claims or demands I, my heirs, distributees, guardians, legal representatives, or assigns now have or may hereafter have for injury or damage resulting from my participation in skiing or other club activities.
I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND FOX VALLEY SNOWDRIFTERS SKI CLUB AND SIGN IT OF MY OWN FREE WILL. December 2, 2023
TRIP CANCELATIONS and REFUNDS
You may cancel your trip registration and receive a full refund of amounts paid if the cancellation occurs within 30 days of the date the trip was first put on sale. If you cancel your registration after 30 days your refund will be reduced by the larger of the following:
The minimum cancellation fee is $50 per person for trips to destination resorts in the US and internationally.
The minimum cancellation fee for midwestern trips (e.g. weekend bus trips) is 10% of the full trip price.
The cancellation fee may be increased if the club has incurred any unrecoverable charges. These charges include but are not limited to air, room, board, bus, and lift tickets. If the amount of these unrecoverable charges exceeds $50, the cancellation fee will be equal to the charges incurred.
Unrecoverable funds are defined as non-returned amounts paid or owed to a contractor or third party in anticipation of the person being on the trip, whether the actual payment was made before or after notification of the cancellation. Assessments of appropriate amounts are made on an individual basis. The Trip committee and Trip Leader will make a reasonable effort to minimize unrecoverable amounts.
The refund will be paid as soon as possible following the cancellation. In some cases, it may take time to resolve cancellations with the vendors prior to determining the amount of the charges that cannot be recovered by the club.
Cancellations from the waiting list may be made at any time with no penalty and the deposit will be refunded as soon as possible.
If you must cancel at the last minute and there is no one on the trip waiting list to take your place, it is possible that substantially all your trip payments have become unrecoverable funds. You may then act independently to sell your spot on the trip to a replacement providing all the following conditions are met.
The trip leader approves. This is important, as trip arrangements such as rooming assignments can be affected.
The club has received the full trip price from you or your replacement.
The replacement meets all trip eligibility requirements (e.g. your replacement is or becomes a club member).
The replacement submits the required liability release waiver to the trip leader.
You collect the price you sold the trip for directly from your replacement. You will not receive a refund from the club.
While the club will waive the cancellation fee, any fees incurred to make this substitution (e.g. airline fees for changing the traveler’s name) must be paid by either you or your replacement prior to travel.
When the club has collected more funds than were needed for the trip, the surplus will be returned to the trip participants, subject to the following:
The surplus must be at least 10 dollars per person. Only full dollar amounts will be paid or credited
Rebates may be prorated based on the amount each member has paid for the trip.
Surplus funds may be refunded to participants or recorded as a credit toward future club activities.
Trip prices are based on current airline fuel surcharges and taxes, and when applicable, exchange rates; and might have adjustments by final payment.
I have read, understood, and will abide by this policy. December 2, 2023
