The High Lonesome Ranch (the "Ranch") provides outdoor and recreational services and amenities for day and overnight guests at the Ranch including lodging, board, hunting, fishing, horseback riding, ATV riding. clay target shooting, rifle/pistol range shooting, archery, limited occupancy transportation, hiking, mountain bicycling, snowmobiling, cross-country skiing, snowshoeing, and other related or similar activities together with related activities (together “Activities”). WARNING An equine professional is not liable for any injury to or death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Section 13-21-119, Colorado Revised Statute (C.R.S. § 13-2 II I 9(5)(b)). An activity instructor or equipment provider or facility person is not liable for any injury to or the death of a participant resulting from the inherent risks of agricultural recreation activities performed or conducted on or in a facility pursuant to Section 13-21-121, Colorado Revised Statute (C.R.S. §13-21-121(3)). FURTHER, FOR THE VALUABLE CONSJDERATION of being permitted by the Ranch to participate in the Activities at the Ranch. THE UNDERSIGNED PROMISES AND AGREES: I am voluntarily participating in the Activities, have the knowledge and ability to use the equipment and/or animals for those Activities, and will use such equipment and animals safely at all times during those Activities. I agree to obey all rules and regulations of the Ranch governing the Activities at the Ranch. and that the Ranch may terminate my participation or involvement in the Activities at any time in its sole and absolute discretion with or without cause. I agree the Ranch is not responsible for determining my physical fitness or level of expertise for participation in any Activity and is further not responsible for providing me with any training for the purpose of engaging in any Activity. I acknowledge that the risks associated with the Activities include but are not limited to (a) loss or damage to personal property; (b) becoming stranded, lost, or disoriented due to wind, foul weather, or related conditions; (c) personal injury such as cuts, bruises, hypothermia, injury, illness. broken bones, permanent trauma, and/or death, due to accidental discharge of firearms; slipping; falling; accidents related to the use of ATV's and/or other vehicles; mounting; riding, and dismounting horses; collisions among animals and/or objects; horses' reactions to sound, sudden movement, unfamiliar objects, person or other animals, surface and subsurface features of the terrain; and/or startled animals, birds. low branches, loose rocks, avalanches or snow conditions. I understand that there may be other risks not specifically listed here, but that are nonetheless assumed by me (or my minor children) that arise out of my (or my minor children) participating in the Activities. Moreover, I understand that any of these risks may have been added to or made more dangerous due to the condition of the ground after the Pine Gulch Fire. Specifically, these added risks may include an exacerbated risk of harm from floods, debris flows, loose or unstable ground, sinking ground, fallen trees, denuded underbrush, and the like. I release, agree not to sue, waive any and all claims against, and agree to defend, indemnify and hold harmless the Ranch, the owner(s) of the land on which the Activities Lake place, all entities associated with the Ranch or the owner of the land on which the Activities take place, as well as all of their managers, members, contractors, agents, employees, and insurers from any and all claims, liabilities, causes of action, actions, demands, expenses (including reasonable attorney’s fees) and damages concerning, but not limited to, injuries or death or damage to property suffered by me (or a minor child for whom I am responsible), resulting from or in any way related to participation or involvement in any of the Activities whether such injury, death or property damage was caused by negligence or any released person or entity or from any other cause. I sell, assign, and grant to the Ranch the right and permission to copy and/or publish photographic portraits of me in which I may be included in whole or in part or composite or reproductions otherwise made through any media for art, advertising, trade or any other similar lawful purpose whatsoever including but not limited to television, product packaging, posters, billboards and Internet usage. I waive my right to inspect and/or approve the finished product or the advertising copy that may be used. I release and discharge the Ranch. its successors, and all persons acting under its permission or authority or those for whom it is acting from any liability by virtue of any blurring, distortion, alteration, optical illusion or use in composite form that may occur or be produced in the taking of said picture or in any processing tending toward the completion of the finished product. I agree if any provisions of this Release of Liability is held invalid, the invalidity shall not affect other provisions or applications of this Release of Liability which can be given effect without the invalid provisions or applications; the provisions of this Release of Liability are to be severable. This Release of Liability shall be binding upon myself as undersigned and my estate, heirs, successors, assigns and any minor children (under the age of eighteen years) for whom I am guardian or custodian who participate in the activities. I have read and understand this agreement and voluntarily enter into it on behalf of myself and the other persons referenced in this paragraph. YOUR SIGNATURE BELOW CERTIFIES THAT YOU HAVE READ THIS RELEASE FULLY AND CAREFULLY AND UNDERSTAND ALL OF ITS PROVISIONS
