In consideration of the services of the Association for Challenge Course Technology, Inc. (“ACCT”) in the presentation of its Annual International Conference and Expo (February 10-13, 2022, in Cleveland, Ohio), I, an adult participant or parent or legal (court-appointed) guardian (“parent”) of a minor (under 18 years of age) participant, acknowledge and agree as follow: Activities: Conference-related activities will include attending and moving between and among a variety of venues, including for presentations, exhibits, meals and social gatherings. Also included are my free-time and independent activities, not scheduled or managed by ACCT. Risk: Attendance at the conference will expose participants to risks, which may cause injury, illness, death or other loss to me and to others. Participants may not be familiar with the conference-related and other venues and circumstances. They may slip and fall, collide with other persons and objects, and over-exert myself in activities involving some heightened level of physical activity. Frequent and close personal contact with others is unavoidable and such contact will expose participants to, among other hazards, the possibility of infection from the still-present Covid 19 virus and its variants (“the virus”). The host hotel and the Conference Center have announced strategies designed to reduce the risk of the virus and participants are urged to be familiar with those strategies and guidelines. Other resources for the identification and control of the virus, include publications of the Center For Disease Control and Prevention (the CDC), health authorities of the State of Ohio and ACCT’s own “Health Considerations”. These resources will be posted at the ACCT website https://acctconference.com/health-considerations/. Participants are urged to read and understand these resources, which are subject to change. Among other precautions, participants will be expected to wear masks indoors, and observe social distancing, recognizing that momentary or brief contacts with others are unavoidable if the conference is to achieve its goals. Persons must not attend the conference if they have any reason to believe they are infected or recently have been in contact with persons who may have been infected. Persons attending must present evidence that they have been fully vaccinated, or have a negative test for the virus within 72 hours of attending (click here for test requirements: https://acctconference.com/health-considerations/). By signing below, I represent that I, or the minor participant for whom I sign below, meet these requirements for attendance. If, while attending the conference, a participant has reason to believe that they may have been exposed to the virus, or exhibit symptoms of the virus, they will immediately withdraw from participation and contact with others and report such circumstances to ACCT staff. A participant who fails to comply with the guidelines described above may be asked to leave the Conference. The risks described above and others are inherent in attending the Conference. I, an adult participant, assume ALL risks of attending the conference and moving within and among its various activity and social sites, inherent and otherwise and whether or not described above. If the participant is a minor, I, parent, have discussed the activities and risks with the minor, who understands them and wishes to participate nevertheless. Agreement of Release and Indemnity: I, an adult participant or parent of a participant who is a minor (as parent, for myself and, to the fullest extent of the law, on behalf of the minor) agree to release, indemnify and not to sue ACCT, its officers, Board members, volunteers, and staff with respect to any and all claims of injury, illness or other loss, including death, related in any way to my or the minor’s enrollment in the Conference, including participating in its activities, moving about presentation and exhibit venues, meals and private and conference social gatherings of any nature. These agreements of indemnity and release include claims arising from the negligence, but not the willful and wanton misconduct, of a released party. These agreements include losses suffered by reason of the virus or other illness, including cancellation of the conference or separation from the conference. Other: I represent that , or the minor participant, have no medical or other condition which might cause me or the minor to be a danger to ourselves or others. In the event the parties to this agreement, including a minor participant, must resort to mediation, arbitration or litigation to resolve a dispute related to the Conference attendance or related activities, the substantive laws of the State of Colorado (not including those laws with may invoke the laws of another jurisdiction) will apply to the dispute, and the venue of any mediation, arbitration or suit will be exclusively in the State of Colorado. This Agreement is intended to be interpreted and enforced to the fullest extent allowed by law. If any portion of this Agreement is deemed unlawful or unenforceable it shall not affect the remaining provisions, and those remaining provisions shall continue in full force and effect. I have carefully read, understand and voluntarily sign this Agreement, and acknowledge that it shall be effective and legally binding upon me, the minor participant, and our respective families and estates. I understand that I am required to show proof of either my COVID Vaccination records OR a negative PCR test result within 72 hours prior to my arrival in Cleveland. I acknowledge that if I intend to provide proof of a negative test result that I will need to be prepared to show that at the registration desk on-site in order to retrieve my attendee badge. I Agree
