COMMUNICABLE DISEASE, INCLUDING COVID-19, RELEASE OF LIABILITY FOR ADULT PARTICIPANTS
READ BEFORE SIGNING

IN CONSIDERATION OF being allowed to participate in any way in Kinetic Training, Inc events and activities, I acknowledge, appreciate, and agree that:

  • Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
  • I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
  • I willingly agree to comply with Kinetic Training Inc’s stated and customary terms and conditions for participation as regards to infectious diseases. If I observe any unusual significant concern or hazard I will remove myself from the participation and bring such to the attention of the nearest coach, instructor, or official immediately;
  • I, myself, and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS KINETIC TRAINING INC; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property incident to my involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I, FOR MYSELF, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK OF COMMUNICABLE DISEASE AGREEMENT IN ITS ENTIRETY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

IN CONSIDERATION OF being allowed to participate in any way in Kinetic Training, Inc events and activities, I, the undersigned acknowledge, appreciate, and agree that:

The risk of injury from the activities involved in these activities is significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

  1. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
  2. I willingly agree to comply with Kinetic Training, Inc’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in readiness for participation and/or in the program itself, I will remove myself from participation and bring such to the attention of the nearest coach, instructor, or official immediately; and,
  3. I, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS KINETIC TRAINING, INC; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property incident to my involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
  4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.
  5. I assert that I understand the risks of the activity and my responsibilities for adhering to the rules and regulations, and agree to comply with my responsibilities.

I, FOR MYSELF, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT IN ITS ENTIRETY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. 

 

KINETIC TRAINING INC PHOTO RELEASE FORM

I hereby agree and consent as follows:

  • I consent and authorize Kinetic Training, Inc to use my likeness in any photograph, video, or other digital media (“Photos”) in any and all publications, including print or web-based publications.
  • I irrevocably authorize Kinetic Training, Inc to copy, edit, enhance, crop, or otherwise alter any said Photo for use in their publications. I also waive any rights for approval or inspection of any said Photos.
  • I understand and agree that all said Photos are the property of Kinetic Training, Inc, and will not be provided to me.
  • I acknowledge that I am not entitled to any compensation or royalties with respect to the use of the Photos.
  • I agree to release and forever discharge Kinetic Training, Inc and its affiliates,
  • successors and assigns, officers, employees, representatives, partners, agents and anyone claiming through them, in their individual and/or corporate capacities from any and all claims, liabilities, obligations, promises, agreements, disputes, demands, damages, causes or action of any nature or kind, known or unknown, which I, and anyone claiming on behalf of me, may claim to have against Release in connection with this Release.
  • I have carefully read and fully understand all the provisions of this Photo Release Form and am freely, knowingly and voluntarily signing.
