READ BEFORE SIGNING

 

IN CONSIDERATION OF my child being allowed to participate in any way in the events sponsored, conducted or promoted by Montclair Youth Running, Inc. (“MYRI”) (the “Activities”), the undersigned acknowledges and agrees that:

The risks of injury and illness (e.g. communicable diseases such as MRSA, influenza, and COVID-19) to my child from the Activities are significant, including the potential for property loss, permanent disability and death; and, 

I, for myself, my spouse, my child and my/our heirs, assigns, personal representatives and next of kin, KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS OF PARTICIPATING IN THE ACTIVITIES, both known and unknown, even if arising from the negligence of the Releasees (as defined below) or others, and assume full responsibility for my child’s participation; and,

I agree to comply with MYRI’s stated and customary terms and conditions for participation. I certify that my child is physically fit enough to participate in the Activities and has not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems that would preclude my child’s participation in the Activities.  If I have any concern with my child’s readiness for participation in the Activities and/or in the Activities themselves, I will bring them to the attention of MYRI and/or remove my child from participation in the Activities; and,

I, for myself, my spouse, my child and my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, HOLD HARMLESS AND DISCHARGE FROM ANY AND ALL LIABILITY MYRI; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the Activities (“Releasees”), with respect to any and all injury, illness, disability, death, loss or damage to person or property incident to my child’s involvement or participation in Activities, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law. I understand that these injuries or outcomes may arise from my own or others’ negligence, conditions related to travel to and from the Activities, or from conditions and/or equipment at the Activities location(s).  Nonetheless, I assume all related risks, both known and unknown to me, of my child’s participation in the Activities.  

I, for myself, my spouse, my child and my/our heirs, assigns, personal representatives and next of kin, hereby INDEMNIFY, HOLD HARMLESS AND PROMISE NOT TO SUE all the Releasees from any and all liabilities or claims made incident to my child’s involvement or participation in the Activities, even if arising from the Releasees’ negligence, to the fullest extent permitted by law.

In the event that my child should require emergency medical care or treatment, I authorize MYRI to provide such care, including but not limited to first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment.  

In the event that any damage to equipment or facilities occurs as a result of my or my child’s actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness.

This waiver and release of liability shall remain in effect for the duration of my child’s participation in all MYRI Activities, including during this initial and all subsequent events.  

I HEREBY GRANT MYRI the absolute right and permission to photograph, video and/or audiotape or otherwise record the likeness of my child (the “Images”) and to use and reproduce such Images for any lawful purposes whatsoever, and to authorize others to do the same, including but not limited to use the Images in any MYRI publications or promotional material, without payment or any other consideration.  I hereby release, discharge and agree to indemnify and hold harmless the Releasees from all claims, demands, and causes of action that I or my child have or may have by reason of this authorization or the creation or use of the Images.   

I hereby confirm that I have explained to my child: the risks of the Activities, his/her responsibilities for adhering to MYRI’s rules and regulations, and that my child understands this agreement.

I, FOR MYSELF, MY SPOUSE AND MY CHILD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY.
