SERVICE WAIVER / RELEASE (1 of 3)
(This must be signed by the Parent / Legal Guardian as well as the athlete if under 18 years old) Please check the box after each section and sign after the last section. We need to know you have read these at least once, acknowledge each of these, and are in agree to the terms of service. SECTION 1: LIABILITY WAIVER I, client of Tread Athletics, hereby state and represent as follows: - I have no known medical problems that would preclude me from participation in any of Tread Athletics’ programs, and the information I have provided to Tread Athletics regarding my medical condition and physical condition is true and correct to the best of my knowledge.
- My participation in any of Tread Athletics’ programs is voluntary, and I have the right to withdraw from any of the programs at any time. If I withdraw from the programs, however, I am still responsible for any monetary obligations that I may have incurred in the course of my participation.
- Neither Tread Athletics, nor any of its agents or representatives, has guaranteed me success in any of the programs.
- I hereby agree to forever waive any and all claims that I have against Tread Athletics or its agents or employees as a result of my participation in any of Tread Athletics’ programs. This release shall be binding on my heirs, legal representatives and assigns.
- I hereby consent to and permit Tread Athletics to use the data obtained as a result of my participation in Tread Athletics’ programs in public or private reports or publications.
- I hereby grant Tread Athletics permission to use my likeness in a photograph, video, or other digital media in any and all of its publications, including web-based publications, without payment or other consideration.
- In the event of physical injury resulting from my participation in any of Tread Athletics’ programs either remotely or on-site, no medical or monetary compensation will be provided to me by Tread Athletics. I will assume and pay, either personally or through my own medical insurance coverage, for all medical bills or expenses incurred as a result of my participation in Tread Athletics’ programs.
- Risk and discomforts - the nature of participating in athletic development programs, as with any sport/athletic activity, there exists a possibility of straining muscles and spraining or tearing ligaments. Tread Athletics will try to minimize these risks. It is also not uncommon to experience some delayed onset muscle soreness when starting a physical training program. Your coach will work with you to manage your body’s response to training stimulus.
SECTION 2: INFORMED RISK - Throwing a baseball is one of the most potentially injurious acts in all of sports. Just as increased velocity massively increases an athlete’s chances of prolonging his career and achieving a chance to play at the next level, it is also a risk factor for arm injury. As the muscles of the body strengthen and the arm is taught to move quicker, more stress is passed through the muscles, tendons and ligaments of the forearm, elbow and shoulder. With proper training, assessment, throwing management and communication, these risks can be minimized, but due to the nature of throwing, and particularly, high velocity throwing, they cannot be fully eliminated.
SECTION 3: INJURY NOTIFICATION - If anything hurts at any point during the execution of your program, or if any injury occurs during any outside activity (for whatever reason), it is the athlete’s responsibility to notify Tread and his coaches, at which point we will touch base and make appropriate accommodations within the program. For example, if you tweak your back during a deadlift, let your coach know, and he or she will modify your activities accordingly. This is imperative for your coach to be able to ensure safe and effective completion of your training plan.

I Agree SERVICE EXPECTATIONS (2 of 3) (This must be signed by the Parent / Legal Guardian as well as the athlete if under 18 years old) SECTION 1: ATHLETE EXPECTATIONS - Service Duration: You will receive 365 days of training access per phase. These days will be organized into “Blocks” based on your Key Dates and adjusted based on progress. If you are struggling to complete training,communicate with your Performance Coach, and he'll assist you in modifying programming. He is equipped to help you integrate Tread’s Programming into your existing schedule limitations. Please do NOT tell any team coaches we have communicated to ignore their advice; we will gladly collaborate with them directly to establish a workable training solution.
- Service Timing: Tread Athletics is a year-round service. We expect you to train with us regardless of season. Our plans are complementary to your evolving Off-Season, Pre-Season, and In-Season needs. In order to maximally leverage your playing experience and career, it's vital to have an adaptable plan available for your use. The best athletes in the world have a support team of professionals who help them elevate their Performance. Tread intends to be exactly that for you for years to come.
- Coaching Connection: You will be assigned a dedicated Performance Coach within 48-hours of registration. Your Performance Coach is singularly responsible for all things training including live calls and messaging, programming modifications, and mechanical analyses.
- Athlete Support: You will have access to Athlete Support, which will provide you administrative support for billing, card updates, in-house training requests, access extensions, etc. Please use the “Athlete Request” feature or initiate a direct chat to request assistance from Athlete Support.
- Communication Expectations: We believe in a two-way street of communication. Failing to maintain consistent communication with your Performance Coach will prove detrimental to your training experience. 99% of our athletes have no issue communicating properly with us, and we expect nothing less from you. We have a '3-Strike Policy' for coach-initiated communications. If you fail to be responsive to three (3) direct inquiries (chat, call) from your Performance Coach, you are expected to re-initiate contact. [Note: Your access will not be suspended, and you will not receive an access extension for failing to communicate with your Performance Coach.]
- Athlete Compliance: The number one driver of a successful experience at Tread is Compliance. Tread possesses best-in-class training data which allows us to procure best-fit training plans for our athletes. Athletes who commit to the habit of training have the best experiences and make the most progress.
- Operating Hours: Tread's Standard Operating Hours are 9:00 AM - 6:00 PM EST, Monday - Friday, with a 2-hour block on Saturdays for servicing Remote Athletes. Tread is closed for business on the following days: July 4th, Labor Day, Thanksgiving Day, December 24th, Christmas Day, December 31st, New Years Day, Coaches' Day. If you contact your Coach or Tread on any of these holidays, you should expect a response the next business day.
- Programming Materials: Your plan and corresponding materials are for use with Tread Athletics and its Performance Coaches ONLY unless otherwise specified. The program, private access, and other materials you have while participating in active coaching are not for redistribution or re-sale.
- Plan Deliverables: These are the explicit deliverables of your Premium Coaching Plan. [Note: You should anticipate multiple points of contact each week with Chat Messages, Audio or Video Calls, Athletes Requests, and Athlete Check-ins.]
- Comprehensive Programming: Initial Custom Buildout including a Movement Assessment, Exercise Form Check, Mechanical Analysis, and comprehensive Movement, Throwing, Strength & Conditioning, and Nutrition Routines.
- Programming Blocks generated based on your key dates (Competitive Seasons, Role, Academic Breaks, Exam Weeks, etc.)
- Dedicated Coaching Support:
- 24-business hour Response Time on Chat Messages.
- 48-business hour Response Time on Programming Modifications.
- 72-business hour Program Generation on new blocks of programming, including the initial buildout
- At least 1 Tread-initiated contact each week.
- At least 1 formal video analysis each month, up to 1 formal analysis each week.
- At least 1 scheduled 20-minute audio or video call each month, up to 1 call each week.
Note: If you ever feel your Performance Coach isn't upholding these deliverables, please initiate contact with Athlete Support, and we will be sure to get any issues addressed promptly. SECTION 2: PARENT EXPECTATIONS - Parent Communication: We wish to have open communication with not just athletes, but their parents as well. Once the program has begun, we prefer questions regarding the execution of the program come from the athlete himself. In our experience, when parents constantly initiate contact with an athlete’s coach, it shifts responsibility from the athlete to the parent, and these athletes tend to underachieve expectations.

SERVICE COMMITMENTS (3 of 3) SECTION 1: PLAN FRAMEWORK - Service Commitment: You are committing to our Annual Training Retainer. The nature of a retainer is a fee paid in advance of services rendered; however, to avoid becoming cost-prohibitive for our athletes, we allow monthly installments as a courtesy at this time. These ‘installments’ are like an apartment lease or car payment; you are liable for completing all these payments in-full.
- Service Suspension: Should any charge on your card fail, you will have 72-hours to update your payment method before services are temporarily suspended. You will regain access to your account once your payment successfully processes. Failure to consistently complete your training payments will result in a revocation of services and immediate loss of access to our proprietary Training Platform. Please submit a request to Athlete Support for further account assistance.
- Service Fit: If you can’t commit to a year of training with Tread, we aren’t the option for you. We want to help you write the best version of your story which requires a long-term investment in your playing experience. Our best athletes spend years under our tutelage refining their craft and are rewarded with a disproportionate advantage over their competition and Return-On-Investment (ROI) – on-field success, playing opportunities, career advancement, scholarships, professional contracts, and career closure.
- Athlete Condition: We operate in this binary fashion to PROTECT you from yourself and the emotional nature of decision making. We’ve been where you are and know that your daily habits – how you train, where you train, and who you train with – will be the defining factors of your experience. We intend to pay-it-forward, using our own unique experiences, to provide you a best-in-class service for the remainder of your career.
- Perceived Value: There will be months where your perceived value of Tread’s service far exceeds the cost-benefit analysis of your installment and months where it won’t appear to. The aggregate value of this is a consistent, monthly installment that reflects the value we have set for our training services. In doing so, you will have consistent access to the training resources you need, when you need them, to achieve AND maintain a best-case playing experience. Similarly, neglecting to go to your Dentist for routine cleanings or the Auto-Shop for regular tune-ups will spell disaster for otherwise preventable issues with regular attention. Training with Tread is exactly this for your playing experience.
- Approach: We approach training much like Dollar-Cost Averaging (DCA), wherein the uncertain nature of your predicament is mitigated by daily access to training resources that stabilize the otherwise chaotic nature of your training or playing conditions. If you want to be a Daytrader on your experience – Showcases, College Camps, Velocity Programs, Lesson Blocks – Tread’s not the platform you’ll be trading on. We promise that the average value, as well as the clarity and consistency you will experience training with us, is well worth the commitment. We’re the study guide for your big test – a cheat code to hacking into your Physiology, Neurology, Psychology and unlocking your full athletic potential. We believe you can change the trajectory of your experience in 90 days; imagine what you’ll do in a year and beyond with our help.
- Dollars & Cents: You have or will spend tens of thousands of dollars ($) on E-Products, Physical Products, Lessons, Recruiting Events like Showcases and College Camps, 3-Month Velo Programs, etc. in your playing career, not to mention considerable time and emotional energy. The misallocation of your finite resources ends now. The #1 driver of achieving your goals is your PERFORMANCE; the daily training you do is the leading indicator of this. We are here to help you take control of your career one day at a time and assist you in strategically leveraging your resources to maximize your career outcomes.
- Continuous Service: The rate structure and terms of your service arrangement will be honored as long as you maintain continuous service. If you fail to do so, you will be ushered in at the most current rate. Do NOT expect us to honor previous rates if you have not been continuous with your service.
SECTION 2: REFUND POLICY - Due to the substantial time commitment involved in onboarding and creating each athlete’s unique plan, we do NOT offer full or partial refunds for services once service has begun.
SECTION 3: INJURY POLICY - We’ve established that throwing is perhaps one of the highest-risk activities in sports. As such, we provide proactive programming to mitigate the occurrence of injuries; however, they still prove unavoidable at times. This in mind, we possess significant experience successfully navigating the Return-to-Sport Process. In the case that an injury results in missed training time, billing will continue on the scheduled cadence, and we will extend complimentary access for up to 30 days. Please be prepared to provide a Physician’s signed note to qualify for this extension. It’s CRUCIAL to continue training through injuries with specific programming modifications in mind. This includes both non-surgical and surgical-related interventions. An athlete should not expect his account or billing to be put on hold during this time. If an injury proves career-ending, please submit an inquiry to Tread Support.
SECTION 4: ILLNESS POLICY - We understand that illness can often be out of our control, specifically in the small community environment of sports [i.e. locker rooms, buses, dugouts, etc.]. We are often forced to play through illnesses in-season, but it’s important to be able to rest and recover when this approach proves potentially hazardous. As such, if an illness results in missed training time, billing will continue on the scheduled cadence, and we will provide a complimentary, one-time 7-day extension of training access. Please place this request with Athlete Support.
SECTION 5: TERMINATION - Tread Athletics reserves the right to terminate this Service Contract without notice for specific infractions including, but not limited to, athlete noncompliance, abuse of services, stealing, physical altercations, redistribution of training materials, drug use, and criminal complaint or conviction. Training with Tread is a privilege, not a right. It can be revoked at any time.
SECTION 6: IN-HOUSE TRAINING - Training at Tread HQ is exclusive to active Remote Athletes. The In-House Fees are in-addition-to base Remote Training Fees. A training week at Tread Athletics is defined as up to 6 days (Sundays off). Since in-house slots are limited, all fees are non-refundable. If you plan to be on-site during the Holidays, there will be adjusted hours and Open Gym hours. Please request from Athlete Support before reserving your training spot.
I have read the Service Commitments in full and understand the terms and expectations set forth. I Agree The individual, if different, financing this plan has been made aware of and approves all 'Terms of Service'. I Agree -- We know this is a lot of information to digest, so please take some appreciable time to review each section before signing this document. We want to make sure you have the absolute best experience as a Tread Athlete, and that starts with understanding your commitment from the outset.
