FLIGHT ON ICE - RENAULT WINERY VINTNER WONDERLAND

PARTICIPANT WAIVER

-- READ BEFORE SIGNING --


In consideration of being allowed to participate in any way at the Renault Winery Vintner Wonderland skating rink, related events and activities of ice skating. I, the undersigned, acknowledge, appreciate, and agree that:

1.    The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while guidelines, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

2.    I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown of my participation in ice skating, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3.    I willingly agree to comply with the stated and customary terms and conditions for participation in ice skating. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

4.    I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Flight Entertainment LLC, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.


IN ADDITION, BY RENTING SKATES OR OTHER SKATING EQUIPMENT YOU ARE AGREEING AS FOLLOWS:

ASSUMPTION OF RISK: I am aware that ice skating involves certain inherent risks, dangers and hazards which can result in serious personal injury or death. I am also aware that the use of skating equipment can involve risk of personal injury or death. As such, I hereby freely agree to assume and accept any and all known and unknown risks of injury while skating at a Flight on Ice Skating Rink or using this equipment. I further recognize and acknowledge that the risks inherent in the sport of skating can be greatly reduced by: taking lessons, abiding by Flight on Ice’s Responsibility Code and using common sense.

RELEASE AND WAIVER OF CLAIMS AGREEMENT: In consideration of the loan or rental to me of Ice Skates, I hereby agree to the fullest extent permitted by law, as follows:

1. TO ACCEPT FOR USE AS IS, the equipment described in this Agreement, and to keep it in my possession at all times. 

2. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against Flight on Ice and/or Flight Entertainment LLC. 

3. TO RELEASE Flight on Ice from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer, as a result of my use of the equipment described in this Agreement, due to any cause whatsoever, including negligence or breach of contract regarding the design, manufacture, selection, installation, maintenance or adjustment of the equipment;

BINDING EFFECT OF AGREEMENT: In the event of my death or incapacity, this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and Representatives.

By signing this waiver you also allow Flight Entertainment LLC (dba Flight on Ice), to use your photograph and other media such as video, film or quotations for promotional material and publications both online and through print.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
