Waiver, Release, and Indemnity Agreement, and Range Rules Agreement

All those who wish to use Sakima’s Ridge Shooting Sports facility in any capacity – whether observing, shooting a personal firearm, shooting a rental firearm, attending a class, participating in a match – must fill out this form in its entirety. All information provided will be kept confidential and will not be distributed to others for any purpose. This waiver is strictly for use by Sakima’s Ridge Shooting Sports.

 

Assumption of Risk: I hereby release Sakima’s Ridge Shooting Sports and its collective entities, its owners, employees, officers, directors, volunteers, instructors, guests, agents, and affiliates from all liability for personal injury or property damage through use, in any way, of the facility, its equipment, its firearms, or my own firearm. I agree to indemnify Sakima’s Ridge Shooting Sports and its collective entities from responsibility for any claims or demands arising out of such use. I agree to accept and assume any and all risks existing at Sakima’s Ridge Shooting Sports facility and its operations located at 24255 W Egypt Rd., Minerva, Ohio 44657. I acknowledge and understand that shooting activities are hazardous and involve risks both known and unanticipated. I agree to assume all responsibility of these risks, which could result in damage to property and serious physical or emotional injury, including paralysis or death, to others or myself. Possible known and unknown injuries may include, but are not limited to: being shot or injured in any manner by myself or others, shooting others, partial or total loss of eyesight or hearing, burns, amputation, being struck by flying or falling debris or projectiles, disability, and death. I agree to assume all liability for any act, acts, or omission to act, even any negligent, reckless, or criminal act by any other or myself.

 


 

Release and Indemnification: I agree that myself and my heirs, guardians, representatives, successors, and assigns release and forever discharge and agree not to sue Sakima’s Ridge Shooting Sports and its collective entities, owners, officers, directors, agents, employees, contractors, volunteers, instructors, and guests. I release and discharge these same parties for any and all claims, demands, damages, expenses, cause of action, attachments of property, or liability of any kind whatsoever that I may have for property damage, personal injury, or death resulting from my entering the premises, using the facilities or equipment, or engaging in or observing shooting and other activities at Sakima’s Ridge Shooting Sports facility and its operations, even if such claims, demands, damages, expenses, cause of action, attachments of property, or liability result from any acts of the Collective Entities, even any negligent act or omission to act including negligent or omitted first-aid or rescue operations or procedures. Further, I agree to indemnify, defend, and hold harmless Sakima’s Ridge Shooting Sports and its collective entities, For any and all claims, damages, demands, cause of action, expenses, attachments of property, attorneys’ fees, court costs, or liability of any kind that any person or entity may have for property damage, personal injury, or death resulting from my entering the premises, using any facilities or equipment, or engaging in or observing shooting and other activities at Sakima’s Ridge Shooting Sports facility and its operations, to the extent that such claims, damages, demands, causes of action, expenses, attachments of property, attorneys’ fees, court costs, or liability result partially or wholly from any negligent act of participant, or any act that would subject participant to strict liability.

 


 

Legal Certification:  I certify that I have no legal convictions such as, but not limited to, a felony that would not allow me to operate a firearm legally.

 


 

Medical Certification: I certify that I have no medical or physical conditions that could compromise my safety and the safety of others in any activities at Sakima’s Ridge Shooting Sports facility. I certify that I have adequate insurance to cover any injury of damage I may cause or suffer, or else I agree to personally bear the cost of such injury or damage.

 


 

Initial Definition of Firearm: For the purpose of this Agreement, a firearm is defined as any pistol/handgun, rifle, shotgun and or machine gun or device of any description or design whether single shot, semiautomatic, or fully automatic which discharges a projectile by the use of gunpowder.

 


 

Range Rules:

 1) Never enter Sakima’s Ridge Shooting Sports with a loaded firearm, other than a CCW weapon or “Open Carry” personal defense weapon, that must remain holstered.

 2) On the firing line, always point muzzle down range. This is the only safe direction.

 3) The use of drugs or alcohol on range is prohibited. Persons under the influence of drugs or alcohol will be denied the use of Sakima’s Ridge Shooting Sports facilities.

 4) Shooters must be 18 years of age or older. Anyone under the age of 18 years of age must be supervised by parent or guardian.

 5) Commands issued by a Range Safety Officer (“RSO”) or any range staff must be followed immediately.

 6) Any violation of the safety rules, operating procedures, or RSO instructions can be cause for removal from the range.

I acknowledge that I have read, understand, and agree with the General Range Rules.

 


 

Firearm and Ammunition Safety Rules:

 1) Know how the firearm operates.

 2) Be sure the firearm and ammunition are compatible.

 3) Keep the chamber open and the firearm unloaded until ready to use. Chamber flags preferred.

 4) Keep fingers off the trigger and outside the trigger guard until ready to shoot.

 5) Tracer, steel core, armor piercing and black or green tip ammunition are not allowed on the range. All ammunition must be inspected by Sakima’s Ridge Shooting Sports personnel before shooting.

 6) As with any gun range involving live ammunition, Sakima’s Ridge Shooting Sports will use its best effort to provide a reasonably safe and effective training environment. However, it is impossible to create an absolutely safe environment. Through this Contract, participant acknowledges this fact and assumes risks associated with using live ammunition.

Range Operating Procedures:

 1) Hearing and eye protection must be worn on the range. See RSO/Instructor if you need to purchase hearing and/or eye protection.

 2) All firearms will be unloaded with the chamber open (or flagged) and magazine removed before entering or leaving the range. Unloaded firearms may be transported in gun cases, with the chamber closed.

 3) All firearms will be placed on shooting tables with the muzzles pointed down range or in the rifle racks provided, chamber flags required.

 4) No one is permitted forward of the firing line, at any time, for any reason until all weapons have been made safe and RSO/Instructor has announced range is clear.

 5) When a cease-fire is called, immediately set your firearm on the table or rifle rack and step back until the RSO/Instructor announces resume fire.

 6) It is your responsibility to clean up after yourself. Retrieve your targets and put spent casings in the provided buckets. If brass is on the ground or in the buckets that does not belong to you, you may NOT take it for yourself unless approved by the RSO/Instructor.

 7) No smoking is preferred. Cigarette butts must NEVER be left on the ground.

I have full and carefully read (1) Waiver, Release, and Indemnity Agreement and (2) Range Rules Agreement and understand their contents. I am aware that this is a release from liability and indemnification agreement and a contract between Saima’s Ridge Shooting Sports including the collective entities and myself and that it imposes limitations to my legal rights. I sign it of my own free will. I certify that I will not operate any firearms or equipment with which I am not completely familiar.

If participant is under the age of 18 years old, a parent or legal guardian must also initial each section and, along with the participant, sign below.
