RELEASE OF LIABILITY & WAIVER OF CLAIMS AGREEMENT 

BY PARENT, GUARDIAN, GUEST, PARTICIPANT, SPECTATOR

Facility: Superdome Sports Brick and its affiliates and subsidiaries (“Facility”)
Location: 780 NJ-70, Brick Township, NJ 08723,
Participant: The undersigned adult and/or any minor child(ren) listed below, and any accompanying guests (“Participant”).

In consideration of being permitted to enter and use the Facility and/or to participate in any programs, rentals, classes, clinics, events, or activities at the Facility (collectively, “Programs”), the Participant agrees to the following, to the fullest extent permitted by law:

1) WAIVER OF CLAIMS

Participant waives and releases any and all claims against the Facility and its owners, employees, staff, directors, officers, agents, affiliates, and contractors (collectively, “Released Parties”) arising from or related to:

  • entry into or presence at the Facility;
  • participation in Programs; or
  • use of any equipment or property provided by the Facility or any other person.

This waiver includes claims for injury, illness, death, or property damage, including those caused in whole or in part by the negligence of any Released Party, to the fullest extent allowed by law.

2) ASSUMPTION OF RISK

Participant understands and voluntarily assumes allrisks associated with entering the Facility and participating in Programs. These risks may be foreseen or unforeseen and may include serious injury, permanent disability, illness, or death.

Participant also acknowledges the risk of exposure to infectiousdiseases (including, but not limited to, influenza, COVID-19, and other viruses or contagions). Participant agrees not to enter the Facility or participate in any activity if feeling ill, experiencing fever or symptoms, or otherwise believes it may be inappropriate to attend.

3) MARKETING & PROMOTIONAL CONSENT

By signing this Agreement, Participant grants permission for the Facility to use photographs, video, and audio recordings of Participant taken at the Facility for marketing and promotional purposes, including social media, website content, brochures, and advertising. Participant understands that no compensation will be provided.

Participant also consents to receive promotional communications from Superdome Sports and may opt out at any time via provided unsubscribe instructions or by contacting the Facility.

4) RELEASE OF LIABILITY

Participant releases and agrees to hold harmless the Released Parties from any liability for loss, damage, injury, illness, death, or expense arising from participation in Programs or use of equipment.

Participant understands participation is voluntary and confirms they have the opportunity to inspect the Facility prior to participation. Participant agrees to follow all Facility and Program rules and acknowledges that personal awareness and common sense reduce risk.

If Participant observes any unsafe condition, they will immediately stop participation and notify Facility staff. If a refund is applicable under Facility policy, it will be handled after notice to the Facility.

5) INDEMNIFICATION

Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, demands, actions, damages, or costs (including reasonable attorneys’ fees) arising out of or related to Participant’s entry into the Facility or participation in Programs.

6) SEVERABILITY

If any portion of this Agreement is found invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect.

ACKNOWLEDGEMENT & SIGNATURES

By signing below, Participant confirms:

  • they have read and understood this Agreement;
  • they understand they are waivinglegalrights, including the right to sue;
  • they are signing voluntarily and intend to be legally bound.

Adults: Sign for yourself.
Minors: A parent/legal guardian must sign on the minor’s behalf.
