Thrive Dance Center's Studio Rental Agreement

1. Studio Use and Guidelines

1.1 Purpose: The Thrive Dance Center studio space is intended for movement-based work such as fitness, martial arts, dance, or movement rehearsals, classes, and workshops.

1.2 Rental Period: The studio will be rented in blocks of time, with a one-hour minimum and half-hour increments. Space may be booked via email.

2. Payment

2.1 Payment Method: Renter must set up a Thrive Dance Center Online Account using a credit card. Renters must pay in advance to reserve their space. Rent can be paid via credit card either in person or online.

3. Cancellation

3.1 Cancellation Policy: Space may be canceled via email with 3 days' notice. If a cancellation is arranged after rent has been paid, the balance will be applied towards future rentals at Thrive Dance Center. No refunds. With less than 72 hours notice, Renters may cancel but will pay the full rental rate for the canceled studio time.

4. Studio Conditions

4.1 Smoking/Incense/Flames: No smoking is allowed anywhere inside the building or within 100 feet of the building. No incense or open flames of any sort are permitted.

4.2 Stereo: The stereo equipment should not be touched without proper instruction. No outside stereo equipment, mixers, or microphones may be connected without prior approval.

4.3 Props: Props must not damage the dance floor. All props must have felt padding on any part that rests on the floor or rolling wheels.

4.4 Storage: Renters may not leave any equipment, costumes, props, or personal belongings anywhere in the studio, hallway, bathroom, or back rooms.

4.5 Keys: Renters agree not to make copies or share the studio key with any other person and will return the key upon completion of the rental period.

4.6 Security: Renters are responsible for the security of the space during the rental period, including locking all doors when not in use.

5. Emergencies

5.1 Urgent Issues: For any urgent issue that might compromise the structure or safety of the studio or the building, please inform the Thrive Dance Center front desk immediately. For accidents, health crises, criminal activities, or fire, call 911.

6. Damage

6.1 Responsibility for Damage: Each renter will assume full responsibility for any damage caused to any part of the studio, including but not limited to floors, windows, mirrors, walls, ceilings, stereo equipment, and more. Payment for damages must be made within ONE MONTH of the damage.

7. Advertising

7.1 No Affiliation: Renters may not suggest or imply that Thrive Dance Center endorses or is affiliated with their activities. The use of Thrive Dance Center's name, Facebook/Instagram page, website, or logo for advertising is strictly prohibited. It is not permitted to tag Thrive Dance Center is any posts, stories or other social media.

8. Liability

8.1 Liability for Injuries: Renters assume liability for injuries to any persons they invite to the space, including students, performers, collaborators, guests, or audience members. All individuals in the group must sign a Thrive Dance Center Release of Liability Form before entering the classrooms. It is the Renter's responsiblity to ensure all participants have signed a Thrive Dance Center Release of Liability Form before entering the classrooms.

9. Insurance (For Long-Term Rentals Only)

9.1 Insurance Requirement: Prior to the commencement of this agreement, Renter shall provide Thrive Dance Center Inc. with a Policy of General Liability Insurance in an amount no less than One Million Dollars for any single incident. Thrive Dance Center Inc. shall be included in said policy as an additional named insured.

10. Housekeeping

10.1 Cleaning Responsibility: Renters are responsible for returning the studio to a good state before leaving. All lights, heaters, air conditioners, and electrical equipment must be turned off. Trash and litter must be removed to the hallway garbage can.

11. Parking

11.1 Parking Location: All renters and guests must park in the upper parking lot.

12. Contracts

12.1 Contract Acknowledgment: Renters will sign and return this contract before using Thrive Dance Center’s studio space.

13. Termination of Agreement

13.1 Termination: Thrive Dance Center reserves the right to terminate this agreement and revoke the rental privileges of the Renter at any time, with or without cause, upon written notice to the Renter.

14. Insurance Requirements (General)

14.1 Insurance Coverage: The Renter shall maintain adequate insurance coverage for the duration of the rental period to cover potential liability, property damage, and other related risks.

15. Indemnification

15.1 Indemnification: The Renter agrees to indemnify and hold harmless Thrive Dance Center, its owners, employees, and agents from any and all claims, demands, losses, liabilities, damages, expenses, or causes of action arising out of the Renter's use of the studio space.

16. Compliance with Laws and Regulations

16.1 Compliance: The Renter agrees to comply with all federal, state, and local laws and regulations that apply to their use of the studio space.

17. No Assignment or Subletting

17.1 No Assignment: The Renter may not assign or sublet the rented studio space without the prior written consent of Thrive Dance Center.

18. Severability

18.1 Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Waiver

19.1 Waiver: The failure of Thrive Dance Center to enforce any provision of this Agreement shall not be construed as a waiver of that provision or any other provision.

20. Entire Agreement

20.1 Entire Agreement: This Agreement contains the entire understanding between the parties and supersedes all prior agreements, oral or written, relating to the subject matter herein.

21. Attorney's Fees

21.1 Attorney's Fees: In the event of any legal action or proceeding arising out of or relating to this Agreement, the prevailing party shall be entitled to recover its reasonable attorney's fees and costs.

22. Governing Law and Jurisdiction

22.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of California.

23. Entire Agreement

23.1 Binding Agreement: By signing this Rental Contract, the Renter acknowledges having read and understood the terms of this contract and acknowledges that this Rental Contract is binding on both the parties and the organizations they represent.
