RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS,
AND ASSUMPTION OF THE RISK


In consideration of the use of the shooting range and facilities operated by Minneapolis Gun Club, Inc. (“Minneapolis Gun Club” or “Club”) and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Undersigned for himself/herself and any minor therewith agrees to the following:

ASSUMPTION OF THE RISK 

I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IN WHICH I WILL ENGAGE IS A POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES A RISK TO ME AND OTHERS OF SERIOUS INJURIES, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN AS A RESULT OF AN ACTIVITY MAY BE CAUSED OR COMPOUNDED, IN WHOLE OR IN PART, BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF MINNEAPOLIS GUN CLUB AND/OR OTHERS, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF MINNEAPOLIS GUN CLUB AND OR OTHERS.

I UNDERSTAND THE RISK, I ACKNOWLEDGE AND AGREE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE RISK INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISK OF INJURY, DISABILITY, DEATH AND/OR PROPERTY DAMAGE, ARISING FROM MY PARTICIPATION IN ANY ACTIVITY AND PRESENCE AT MINNEAPOLIS GUN CLUB, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF MINNEAPOLIS GUN CLUB, ITS OWNERS, MANAGERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, INDEPENDENT CONTRACTORS, VOLUNTEERS OR AGENTS.

RELEASE, WAIVER, AND COVENANT NOT TO SUE

I hereby expressly waive and release any and all actual, suspected or potential claims, suits, controversies, causes of action, cross-claims, counterclaims, demands, debts or liabilities of any kin in law and in equity, whether known or unknown, suspected or claims, seeking any form of relief including damages (compensatory, punitive, etc.), assessments, attorney’s fees, injunctive or other equitable relief, costs, disbursements and interests (“Claims”) against Minneapolis Gun Club and its owners, officers, directors, members, managers, employees, agents, representatives, employees, contractors, volunteers, affiliates, successors, assigns and other acting at the direction of any of the previously mentioned (collectively “Released Parties”), on account of any injury, disability, death, or property damage arising out of or attributable to any activity engaged in at Minneapolis Gun Club, whether arising out of the ordinary negligence of Minneapolis Gun Club and/or any of the Released Parties or otherwise. 

I covenant not to make or bring any such Claim against Minneapolis Gun Club or any Released Party, and forever release and discharge Minneapolis Gun Club from liability under such Claims.  

INDEMNIFICATION

I understand that I will be participating in an activity under the express condition that Minneapolis Gun Club and Released Parties are free from any and all liability and Claims of damage or any injury to any person. I undertake and agree that I will defend, indemnify, and hold harmless Minneapolis Gun Club and all Released Parties against any and all Claims, liabilities, judgments, settlements, awards, penalties, fines, costs, or expenses of whatever kind, the costs of enforcing any right to indemnification under this Agreement, and the cost of pursuing any insurance provider, incurred by/awarded against Minneapolis Gun Club or any Released Party, arising out of or resulting from any claim or a third party related to any activity at Minneapolis Gun Club, including any claim related to my own negligence or the negligence of Minneapolis Gun Club or Released Party. 

CONSENT TO MEDICAL TREATMENT

I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in any activity at Minneapolis Gun Club. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evaluation. I hereby release, forever discharge, and hold harmless Minneapolis Gun Club and all Released Parties from any claim based on such treatment or other medical services.

MISCELLANEOUS

This Agreement constitutes the sole and entire agreement between Minneapolis Gun Club, the Released Parties, and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. This Agreement is binding and shall inure to the benefit of Minneapolis Gun Club, me, the Released Parties, and our respective successors and assigns. 

Whenever possible, each provision of this Agreement is to be interpreted so as to be valid under applicable laws. If any term or provision of this Agreement is deemed invalid, illegal, or unenforceable in any jurisdiction, such invalidity, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. All matters arising out of or relating to this Agreement or my participation in any activity at Minneapolis Gun Club shall be governed by and construed in accordance with the laws of the State of Minnesota without giving effect to any choice of law provision. Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in or serving Dakota County, Minnesota, and I hereby consent to the exclusive jurisdiction of such courts. 

ACKNOWLEDGMENTS

I understand that I must obey all verbal and written instructions given to me by Minneapolis Gun Club and its instructors and employees while using the Club facilities and grounds including all posted rules and directives. Safety Rules are posted in the clubhouse and throughout the property, and I agree that I have read them and will abide by them.

I will refrain from being under the influence of alcoholic beverages or medications that might impair judgment before and during shooting sports activities. I also understand that any person(s) who, strictly by our observations, appears to be under the influence of alcohol or unlawful drugs or emotionally unstable, shall be denied access to any part of the shooting range facility. 

I understand and acknowledge, under penalty of law and perjury, that I am legally eligible to possess or rent a firearm and that I have no criminal or mental history that would restrict the Undersigned from such possession.

I signed this Agreement for myself and on behalf of myself, all minors with me, and all our executors, administrators, heirs, and assigns.

I affirm that I have read, understand, and will comply with the requirements as set forth herein, and do hereby agree to follow all rules of Minneapolis Gun Club, those attached here or otherwise implemented by Minneapolis Gun Club.

I agree to enforce all shooting range rules, policies and directives with the Minor and to supervise and monitor all activities of the Minor while on the shooting range and facilities and to release, acquit, indemnify and hold harmless Minneapolis Gun club, its shareholders, officers, managers, assigns, heirs, or employees for any harm to, or resulting from the activities of, the Minor while on the shooting range and facilities.
