MINOR / GUARDIAN WAIVER

MINOR (UNDER 18) RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

(To be signed by a Parent or Legal Guardian — one minor per form)

⚠️ BOULDERING, YOUTH PROGRAMS, CAMPS & CLIMBING ACTIVITIES ARE DANGEROUS

READ CAREFULLY BEFORE SIGNING — BY SIGNING THIS DOCUMENT, YOU GIVE UP THE RIGHT TO SUE ON BEHALF OF THE MINOR.

To: Maple City Climbing Ltd., its owners, shareholders, directors, officers, employees, agents, volunteers, representatives, independent contractors, subcontractors, instructors, coaches, event organizers, sponsors, successors, and assigns (collectively, “the Agents”).

I,  

,       the parent/legal guardian of the above-named minor, sign this Agreement on behalf of the minor, myself, and our heirs, executors, administrators, and assigns.

I acknowledge that this Agreement protects the Agents to the same extent as Maple City Climbing Ltd. (“MCC”), even though the Agents are not formal parties to this Agreement.

ASSUMPTION OF RISKS (FOR MINOR)

I understand and am aware that indoor bouldering, fitness activities, youth programs, birthday parties, summer camps, competitions, and my general use of MCC facilities—including but not limited to bouldering walls, downclimb holds, training/hangboard areas, youth program spaces, competition areas, rental equipment, retail area, seating, walkways, washrooms, change rooms, and parking areas (collectively, the “Facilities”)—involve inherent and significant risks.

These risks include but are not limited to:

·        FALLS FROM HEIGHT, including uncontrolled or awkward landings

·        IMPACT WITH FLOORING, mats, or holds

·        COLLISIONS with walls, holds, objects, or other participants

·        SLIPPING OR TRIPPING on mats, holds, or belongings

·        BEING LANDED ON OR LANDING ON OTHERS

·        DROPPED OBJECTS OR HOLDS

·        EQUIPMENT FAILURE, including rental equipment

·        HUMAN ERROR, including my own, the minor’s, other participants’, or staff

·        NEGLIGENCE by MCC or its Agents

·        MEDICAL EVENTS, such as sprains, fractures, or cardiac events

·        RISKS ASSOCIATED WITH CAMPS OR COMPETITIONS, including running, fast movements, increased unpredictability, and crowding

I freely accept and assume all such risks on behalf of the minor, including the risk of personal injury, property damage, paralysis, or death.

RELEASE OF LIABILITY, WAIVER OF CLAIMS & INDEMNITY (FOR MINOR)

In consideration for the minor’s participation in MCC activities or for permission to use the Facilities at MCC, I agree:

1. TO RELEASE AND FOREVER DISCHARGE MCC AND THE AGENTS

from any and all liability for injury, death, or property damage suffered by the minor arising out of the minor’s use of MCC facilities, including but not limited to negligence, breach of statutory duty under the Occupiers’ Liability Act (Ontario), or equipment failure, to the extent permitted by law.

2. TO WAIVE ANY CLAIMS

that I may have against MCC or the Agents arising from:

·        falls

·        slips or trips

·        collisions

·        equipment malfunction

·        design or placement of holds, mats, or structures

·        participation in youth programs or competitions

·        use of rental equipment

3. TO INDEMNIFY AND HOLD HARMLESS MCC AND THE AGENTS

From liability for injury, death, or property damage to any third party caused by the minor.

4. BINDING EFFECT

This Agreement binds the minor, myself, and our heirs, executors, administrators, assigns, and representatives.

5. GOVERNING LAW

This Agreement is governed by the laws of the Province of Ontario. Any litigation shall take place exclusively in Ontario.

GUARDIAN RULES & RESPONSIBILITIES

I further agree:

1.     The minor will complete a Bouldering Orientation before climbing.

2.     The minor will follow all staff instructions and posted rules.

3.     I understand MCC provides general supervision, not one-on-one supervision unless stated.

4.     I accept responsibility for the minor’s behaviour.

5.     I acknowledge that youth programs and camps involve fast movement and group interaction.

6.     MCC is not responsible for lost or stolen belongings.

7.     I accept responsibility for rental gear issued to the minor.

GUARDIAN ACKNOWLEDGEMENT

I AM THE PARENT OR LEGAL GUARDIAN OF THE MINOR.

I HAVE READ AND UNDERSTOOD THIS AGREEMENT.

I SIGN IT VOLUNTARILY AND ACKNOWLEDGE THAT I AM WAIVING LEGAL RIGHTS FOR THE MINOR AND MYSELF.
