Headwaters Hot Yoga Waiver Agreement

Purpose:

This waiver communicates the risks of practicing yoga, pilates, and other physical activities at Headwaters Hot Yoga and releases Headwaters from liability. By signing or agreeing electronically, you acknowledge understanding of these risks and agree to the terms outlined.

Parties:

"Headwaters" refers to Headwaters Hot Yoga LLC, and "you" refers to the undersigned participant or person who agrees electronically.

Activities:

You will participate in yoga and exercise classes at Headwaters, which include hot pilates, hot yoga blend, 26&2 series, yoga sculpt, and other varieties. This waiver also covers online classes where you are responsible for ensuring the safety of your practice.

Classes may involve stretching, movement, yoga poses, and possibly receiving physical adjustments. If you do not want such adjustments, notify the instructor in advance. Some classes may take place in a heated room (90°F/32°C to 105°F/41°C).

Equipment:

You may use equipment such as yoga blocks, bolsters, mats, straps, resistance bands, weights, etc. Only use equipment as instructed by Headwaters.

Inherent Risks:

Participation in these activities involves risks, including but not limited to muscle strains, cardiovascular issues, dehydration, dizziness, and exposure to communicable diseases, including COVID-19. Online participation carries additional risks due to the lack of in-person supervision. You are responsible for ensuring your own safety during online sessions.

By signing, you affirm your good health and physical condition to participate in these activities. You agree to inform the instructor of any medical conditions, limitations, or injuries, and consult your doctor if necessary. If pregnant, post-natal, or post-surgical, you must have doctor approval to participate.

Voluntary Assumption of Risk:

By signing or agreeing, you acknowledge the risks involved in the Activities and voluntarily assume them. Your participation indicates full understanding and acceptance of these risks.

Code of Conduct:

You agree to follow Headwaters’ policies and studio etiquette. Abusive language or inappropriate behavior, including racial or sexual slurs, obscene gestures, or improper conduct, will result in removal from the studio.

Media Release:

By participating, you grant Headwaters the irrevocable right to use your image, likeness, and audio/video recordings for marketing and promotional purposes. You can request removal of your image at any time.

Release, Waiver, and Indemnity:

You release Headwaters, its affiliates, and employees from liability for any injury, illness, or damages, including the contraction of COVID-19, resulting from your participation. You waive any legal recourse, including damages, against Headwaters for any injuries or illnesses related to the activities. This release applies to you, your family, and legal representatives. 

General Provisions:

  • Jurisdiction: This waiver is governed by Montana state law.
  • Sever-ability: If any part of this waiver is invalid, the rest remains effective.
  • Entire Agreement: This waiver replaces all prior agreements.
  • Online Agreement: This agreement can be signed electronically, which holds the same legal weight as a physical signature.
